Après un endormissement remontant à la période prépandémique, la pratique conventionnelle du Canada en matière d’investissement connaît un regain de vigueur en 2023. L’adoption de codes de conduite pour les arbitres et les juges constitue le premier résultat tangible des discussions en cours au Groupe de travail III de la Commission des Nations Unies pour le droit commercial international (CNUDCI) sur la réforme du règlement des différends entre investisseurs et États (RDIE).1 Le redémarrage du programme de conclusion d’accords sur la promotion et la protection des investissements étrangers (APIE) permet de mettre en application pour la première fois l’APIE-type du Canada de 2021.2 Sur le plan du contentieux d’investissement, le 30 juin 2023 marque la fin du régime transitoire de RDIE de l’Accord entre le Canada, les États-Unis et le Mexique (ACÉUM).3 Bien que le Canada et les États-Unis ne font pas l’objet d’une avalanche de réclamations avec la fin du RDIE dans leurs rapports réciproques, une controverse importante subsiste dans plusieurs affaires pendantes quant à la portée de ce régime transitoire. Par ailleurs, le contentieux impliquant les investisseurs canadiens à l’étranger montre un nouveau visage en 2023 avec les deux premières réclamations de la part de sociétés d’État. Les codes de conduite de la CNUDCI font l’objet d’une analyse détaillée dans la chronique cette année. Un tour d’horizon des principaux autres faits marquants de 2023 est d’abord effectué en ce qui concerne la pratique conventionnelle et la pratique contentieuse du Canada.

The disappearance of migrants, which has reached preoccupying high numbers in recent decades, is related both to the particular vulnerability of migrants traversing dangerous migratory routes and to the high degree of impunity that characterizes investigation and search efforts required. This article argues that the disappearance of migrants at the hands of non-state actors in contexts of systematic impunity and in situations where the state had knowledge or should have had knowledge of a serious risk of such disappearance, but failed to act to prevent it, can be considered to have occurred with the acquiescence of the state. Thus, given that all further elements of the definition of enforced disappearance have been satisfied, this factual situation qualifies as an “enforced disappearance” for the purposes of international human rights law. Key to this demonstration is the concept of knowledge, which is an essential component of acquiescence. This article not only addresses the normative framework of acquiescence and its interpretation by international and regional human rights bodies, including how it relies on the element of state knowledge, but it also examines the extent to which this factor is critical to understanding states’ due diligence obligations to prevent, investigate, and sanction human rights obligations, including disappearances. In order to better understand the factors that should be taken into consideration while assessing a state‘s knowledge of migrant disappearances, including in the context of systematic impunity, it is then suggested to borrow from the international criminal law test related to the concept of “constructive knowledge” and to the doctrine of command responsibility. These considerations should inform a test for assessing whether disappearances of migrants occurring in contexts of systematic impunity can be considered as having been known by the state and as having occurred with its acquiescence and, thus, as constituting “enforced disappearances” under international human rights law.

Au sein de l’Organisation des États américains (OÉA),1 la Commission interaméricaine des Droits de l’Homme (CIDH) et la Cour interaméricaines des Droits de l’Homme sont les deux principaux organes chargés de veiller à la protection des droits de la personne dans les Amériques.2 Ces instances sont habilitées à instruire des recours individuels intentés contre des États membres et portant sur des allégations de violations de la Convention américaine relative aux Droits de l’Homme (CADH)3 et d’autres instruments interaméricains applicables.4 La présente chronique portera sur certaines décisions rendues par la Cour pendant l’année 2023.

Arctic governance has entered a period of turmoil following the March 2022 Arctic Council pause in operations and, subsequently, the strained relations between the member states. As climate change dramatically alters the Arctic environment, opening the region to new economic possibilities and more global attention, the need for cooperation is greater than ever. This article examines the current geopolitical and environmental pressures that are undermining the Arctic Council’s legitimacy and operations at a critical juncture in Arctic governance. It contends that the Arctic Council must rethink how it engages with Arctic Council observers and the wider global community to ensure that pressing ecological, economic, and social issues are addressed judiciously to prevent potentially irreparable harm in the region. Specifically, the case is made that a shift to “inclusive regionalism” could secure the Arctic Council’s position as the pre-eminent forum to address Arctic issues and to re-establish the spirit of collaboration that reigned for a quarter century.

Human rights due diligence (HRDD) is a buzzword in business and human rights (BHR) activities. However, multinational corporations (MNCs) often conduct it as a tick-box exercise without transparency. Using a relational contract theory, this article argues that when MNCs contract with local communities through community development agreements (CDAs) to perform HRDD, such contracts are internationalized relational contracts that attract a level of good faith. An established principle in international economic law, good faith serves as a standard for assessing conduct designed to discharge obligations in international contracts between states and MNCs (investor-state contracts). Similar to how investor-state arbitration tribunals use good faith jurisprudence in regulating the relationship between states and MNCs, this article proposes a BHR good faith jurisprudence to prescribe how HRDD obligations should be discharged. The article concludes that a good faith interpretational exercise in BHR would (1) reduce MNCs’ cosmetic compliance with HRDD principles; (2) increase transparency in the HRDD exercise; and (3) become a source of rights for local communities to enforce corporate accountability.

This article outlines and tackles two inter-related puzzles regarding the comparatively much less robust human rights impact that the ECOWAS Court (in effect, West Africa’s international human rights court) has had on the generally more democratic legislative/judicial branch of decision-making and action in Nigeria vis-à-vis the generally more authoritarian executive branch within Nigeria, the country that is the source of most of the cases filed before the court. The article then discusses and analyzes the examples and extent of the court’s human rights impact on legislative/judicial branch decision-making and action in that key country. This is followed by the development of a set of analytical, multi-factorial, explanations for the two inter-connected puzzles that animate the enquiry in this article. In the end, the article argues that several factors have combined to produce the comparatively much less robust human rights impact that the ECOWAS Court has had on domestic legislative and judicial decision-making, process, and action in Nigeria, through restricting the extent to which the latter could mobilize more robustly the court’s human rights-relevant processes and rulings.

Poursuite de l’invasion de l’Ukraine, guerre dans la bande de Gaza, crise alimentaire, transition énergétique sans précédent, rééquilibrage géostratégique, montée du populisme, ingérence de toute sorte, explosion du recours à l’intelligence artificielle, inflation à maîtriser, voilà autant de traits caractérisant l’année 2023 et ayant eu le potentiel de redéfinir les relations commerciales mondiales. Dans ce contexte, mu par une nouvelle diplomatie pragmatique,1 le Canada tente d’innover tout en renouant avec son rôle d’antan: préserver ses partenaires usuels tout en développant de nouvelles relations d’opportunité (au risque parfois de piler sur ses valeurs), réinvestir les enceintes internationales avec le dessein de les moderniser, diversifier ses relations en déployant des forces diplomatiques dans de nouveaux territoires et réaffirmer sa souveraineté face à toute sorte de menaces que ce soit en Arctique ou dans le cadre électoral canadien. Ce contexte a nécessairement eu des impacts sur les choix que fait le Canada en matière commerciale.

La Cour pénale internationale s’est penchée récemment sur la question nouvelle de la réparation des préjudices transgénérationnels. Dans son analyse, la cour s’appuie sur un type de préjudice qui dépasse la victime immédiate et qui en vise une qui n’a vécu l’événement traumatique original, que par l’entremise d’un transfert générationnel. En ce qui concerne la réparation, il faut établir si ce préjudice est spécifique et autonome justifiant une reconnaissance et, par conséquent, une mesure de réparation. La question de réparer un préjudice transgénérationnel est d’actualité et encore peu étudiée en droit pénal international. Le présent article vise à apporter une contribution dans ce domaine en examinant la façon dont le préjudice transgénérationnel est juridiquement élaboré dans certains exemples s’inscrivant dans un contexte de violations massives et graves des droits humains. Enfin, l’article analyse la jurisprudence de la Cour pénale internationale, mettant en lumière les difficultés et les dilemmes générés par la reconnaissance des préjudices transgénérationnels dans la sphère juridique pénale.

While many investor-state dispute settlement (ISDS) proceedings based on international investment agreements have dealt, directly or incidentally, with environmental issues, state measures relating to the mitigation and adaptation to climate change have been subject to a small number of reported cases. This article demonstrates that there is a significant gap between the number of investor-state disputes having a direct relevance with climate change, on the one hand, and the number of such cases that have actually raised climate change as a material legal or factual issue. In addition, arbitral tribunals faced with disputes related to measures or sectors that are of direct relevance to climate action have, to date, virtually never engaged in any sort of substantial analysis of international climate change treaties and related instruments, rules, or practices. Against this backdrop, this article will explore ways for arbitrators and parties to ISDS proceedings to better consider the climate regime — in particular, the Paris Agreement and instruments arising therefrom — in ISDS proceedings beyond its current limited role as an element of context. While the literature has mostly focused on integrating climate change concerns in ISDS, this article goes further by exploring how states’ international climate obligations could play a greater role in the adjudication of investor-state disputes, including by providing states with a justification for implementing more ambitious regulations as well as tribunals with guidance for interpreting substantive obligations in investment treaties.

Le présent article se propose de concevoir l’influence de la notion de légitimité au-delà du rôle lui étant communément attribué en droit international humanitaire (DIH), en s’intéressant particulièrement à la relation entre ce dernier et les causes de la guerre, la nature des acteurs impliqués dans les conflits armés ainsi que les motivations des parties. En remettant notamment en question de l’idée d’une stricte séparation entre jus in bello et jus ad bellum, il est soutenu que les tentatives visant à isoler le DIH de ces questions de légitimité sont à la fois vaines, mais également à rebours de l’évolution et des logiques du régime. Il est en revanche défendu que la notion de légitimité en DIH se manifeste à travers deux modes de légitimation — l’un dérivant du statut, l’autre de la cause — à partir desquels la distribution de droits, devoirs, immunités, privilèges ou encore statuts s’opère et se voit justifiée au sein du régime. Ce faisant, de nombreux discours empruntant au second registre, souvent qualifiés d’aberrations du point de vue du DIH, ou dont la nature juridique est contestée, s’avèrent finalement être des arguments juridiques parfaitement valides et ancrés dans l’évolution et les logiques du DIH.
