In this article we distinguish two versions of the non-identity problem: one involving positive well-being and one involving negative well-being. Intuitively, there seems to be a difference between the two versions of the problem. In the negative case it is clear that one ought to cause the better-off person to exist. However, it has recently been suggested that this is not so in the positive case. We argue that such an asymmetrical treatment of the two versions should be rejected and that this is evidence against views according to which it is permissible to cause the less well-off person to exist in the positive non-identity case.

Sidgwick's seminal text The Methods of Ethics left off with an unresolved problem that Sidgwick referred to as the dualism of practical reason. The problem is that employing Sidgwick's methodology of rational intuitionism appears to show that there are reasons to favour both egoism and utilitarianism. Katarzyna de Lazari-Radek and Peter Singer offer a solution in the form of an evolutionary debunking argument: the appeal of egoism is explainable in terms of evolutionary theory. I argue that like rational prudence, rational benevolence is subject to debunking arguments and so problematic, but also – and more importantly – that debunking arguments are irrelevant in the debate over the dualism of practical reason on the view of reason and rational intuitionism that Lazari-Radek and Singer embrace. Either both egoism and utilitarianism are debunked, or neither are. If I am right, Sidgwick's dualism is left standing.

As editor in chief of Utilitas, it is my great pleasure to announce the appointment of two new associate editors. Dr. Emmanuelle de Champs is Professor of British History and Civilisation at the University of Cergy-Pontoise. She is the author of Enlightenment and Utility: Bentham in France, Bentham in French (Cambridge University Press, 2015) and La déontologie politique ou La pensée constitutionnelle de Jeremy Bentham (Droz, 2008). Dr. Holly Smith is Distinguished Professor of Philosophy at Rutgers University. Her Making Morality Work has just been published by Oxford University Press. So we have now strengthen our editorial roster in both the history of ideas and contemporary moral philosophy.

Sometimes, agents do the right thing for the right reason. What's the normative significance of this phenomenon? According to proponents of the special status view, when an agent acts for the right reason, her actions enjoy a special normative status, namely, worthiness. Proponents of this view claim that self-effacing forms of consequentialism cannot say this plausible thing, and, worse, are blocked from having a perspicuous view of matters by the self-effacing nature of their consequentialism. In this article, I argue that this claim is based on an illicit assumption. I show that whatever version of the special status view proponents of that view prefer, self-effacing consequentialists can adopt a version of it. Moreover, I show that proponents of extant versions of the special status view have reason to prefer the specific version of that view I articulate on behalf of self-effacing consequentialists.

The principle known as ‘anonymous Pareto’ has it that an alternative A is better than another, B, in case it is (strictly, non-anonymously) Pareto superior to either B or a permutation of it. It is an attractive idea, offering to apply Pareto-based judgments to a broader range of cases while preserving some of the intuitive appeal of the standard, more familiar principle. This essay considers some ways in which anonymous Pareto is defended and argues against each separately, as well as in more general lines. It suggests that the reasons in light of which people find strict Pareto so compelling are the reasons for doubting the anonymous variation of that principle.

A number of philosophers have claimed that we should take not just empirical uncertainty but also fundamental moral uncertainty into account in our decision-making, and that, despite widespread moral disagreement, doing so would allow us to draw robust lessons for some issues in practical ethics. In this article, I argue that, so far, the implications for practical ethics have been drawn too simplistically. First, the implications of moral uncertainty for normative ethics are far more wide-ranging than has been noted so far. Second, one can't straightforwardly argue from moral uncertainty to particular conclusions in practical ethics, both because of ‘interaction’ effects between moral issues, and because of the variety of different possible intertheoretic comparisons that one can reasonably endorse.

This article considers two different ways of formulating a desire-satisfaction theory of prudential value. The first version of the theory (the object view) assigns basic prudential value to the state of affairs that is the object of a person's desire. The second version (the combo view) assigns basic prudential value to the compound state of affairs in which (a) a person desires some state of affairs and (b) this state of affairs obtains. My aims in this article are twofold. First, I aim to highlight that these are not mere notational variants, but in fact have quite different implications, so that this distinction is not one that the theorist of prudential value should ignore. More positively, I argue that the object view is better able to capture what is distinctive and appealing about subjective theories of prudential value, on any plausible account of what the central subjectivist insight is.

Many people believe that the wrongness of killing a person does not depend on factors like her age, condition, or how much she has to lose by dying – a view Jeff McMahan calls the ‘Equal Wrongness Thesis’. This article argues that we should reject the Equal Wrongness Thesis on the basis of the moral equivalence between killing a person and knocking her unconscious.

Preference-based theories of prudential value seem to generate an absurd result when combined with commonplace platitudes about prudential rationality: it would seem that if the satisfaction of our preferences is the source (or even a source) of prudential value, then prudential rationality must be neutral (in, at least, a troubling range of cases) between taking steps to achieve the objects of one's preferences and merely engineering one's preferences to take as their object(s) that which obtains. Either way, one seems to conform to the prudential demand to promote one's well-being. But this is widely held to be counterintuitive. In this article, I argue that this verdict arises only given eminently controvertible interpretations of a preference-based axiology and of the constitution of prudential reasons.

In Introduction Bentham considers a difficulty. If the immediate aim of punishment is to deter agents considering breaking the law, then the severity of the threat of punishment must increase if they are strongly tempted to offend. But it seems intuitively that some people who were strongly tempted to offend should be punished leniently. Bentham argues in response that all potential offenders capable of being deterred must be deterred. He makes three mistakes. (i) It is possible that it would produce the most happiness at t2 to punish an offender who could have been deterred at t1, but was not. (ii) The Principle of Utility might condemn the threats that would be needed to deter all potential offenders who can be deterred. (iii) Given the dispositions to reoffend of some strongly tempted offenders, their punishments should be relatively lenient. There is more room for leniency in Bentham's theory than he realized.

There are puzzle cases that forfeiture theory has trouble handling, such as the issue of what happens to the rights of two qualitatively identical people who simultaneously launch unprovoked attacks against the other. Each person either has or lacks the right to defend against the other. If one attacker has the right, then the other does not and vice versa. Yet the two are qualitatively identical so it is impossible for one to have the right if the other does not. The Problem of Symmetrical Attackers is a problem for non-consequentialism because the most plausible non-consequentialist theories assume that people have rights and can lose them by forfeiting them (consider, for example, self-defence, punishment, and compensation) or waiving them (consider, for example, consent). This article considers whether consequentialism can get around this problem.

How should anti-paternalists deal with policies that seem to be simultaneously reasonable and paternalistic? In the literature, anti-paternalists have sought to show that many policies that prevent people from harming themselves can be justified without appeal to the good accruing to the people interfered with; that is, without appeal to paternalistic reasons. However, while perhaps identifying sufficient non-paternalistic reasons for supporting these policies under realistic circumstances, anti-paternalists often fail, I argue, to identify satisfactory reasons that adequately reflect our underlying concerns pertaining to such policies. Included in those concerns are arguably the interests and well-being of the people whose choices are restricted by the policy in question. In this way, this article reveals that the strategy of reconciling anti-paternalism with seemingly paternalistic policies is beset by serious problems.

The moral psychologist Joshua Greene has proposed a number of arguments for the normative significance of empirical research and for the unreliability of deontological intuitions. For these arguments, much hinges on the combination of various components of Greene's research – namely the dual-process theory of moral judgement, ‘personalness’ as a factor in moral decision-making, and his functional understanding of deontology and consequentialism. Incorporating these components, I reconstruct three distinct arguments and show that the Personalness Argument for the claim that empirical research can advance normative ethics and the Combined Argument against deontology are both sound and interesting in themselves. They do not, however, cast doubt on traditional deontology or reserve a specific role for neuroscience. The Indirect Route argument overcomes some of the other arguments’ limitations. It is, however, invalid. I conclude by pointing out the broader philosophical relevance of Greene's arguments as shedding light on second-order morality.

The article assesses recent attempts to deflect two persistent objections to Positive Egalitarianism (PE), the view that equality adds to the goodness of a state of affairs. The first says that PE entails bringing into existence individuals who are equal to each other in leading horrible lives, such that they are worth not living. I assess three strategies for deflecting this objection: offering a restricted version of PE; biting the bullet; and pressing a levelling out counter-objection. The second objection points out that for any world A containing many individuals all leading very satisfying lives, and in perfect equality, PE prefers a much larger, perfectly equal population Z with much lower (yet positive) well-being. I review two main strategies for avoiding this Repellent Conclusion: a Capped Model and making egalitarianism sensitive to welfare levels. Both solutions, I show, are worse than the problems they are meant to solve.

Pedro Galvão claims that, on the ideal rule-consequentialist code, all sentient humans have rights, whereas animals do not. Because agents are not impartial, total well-being would be lower if they were aware of a general disposition to harm in order to promote the good. Animals cannot be aware of that disposition, so it would be justified to harm them when that is best. Galvão also claims it is wrong to help an animal, even when optimific, if that harms another animal. I argue he is misguided. First, impartial agents would err in the moral calculus, causing falsely optimific harms. To compensate for that, all sentient individuals must have rights – though those protecting some humans may be stronger. Second, when helping is optimific, it is at least permitted. Moreover, since most sentient beings are wild animals with net negative lives, agents should be generally disposed to intervene in nature on their behalf.

One of the main objections against effective altruism (EA) is the so-called institutional critique, according to which the EA movement neglects interventions that affect large-scale institutions. Alexander Dietz has recently put forward an interesting version of this critique, based on a theoretical problem affecting act-utilitarianism, which he deems as potentially conclusive against effective altruism. In this article I argue that his critique is not as promising as it seems. I then go on to propose another version of the institutional critique. In contrast to Dietz's version, it targets not the core principles of effective altruism but rather some important methodological assumptions made in EA research, namely diminishing marginal returns and low-hanging fruits. One key conclusion is that it may be time for critics of effective altruism to shift their attention from the theoretical core principles of effective altruism towards the methodological tools actually employed in practice by the EA movement.

The use of Quality-Adjusted Life Years (QALYs) in healthcare allocation has been criticized as discriminatory against people with disabilities. This article considers a response to this criticism from Nick Beckstead and Toby Ord. They say that even if QALYs are discriminatory, attempting to avoid discrimination – when coupled with other central principles that an allocation system should favour – sometimes leads to irrationality in the form of cyclic preferences. I suggest that while Beckstead and Ord have identified a problem, it is a misdiagnosis to lay it at the feet of an anti-discrimination principle. The problem in fact comes from a basic tension between respecting reasonable patient preferences and other ways of ranking treatment options. As such, adopting a QALY system does not solve the problem they identify.

James Mill's History of British India (1817) made a rather strange claim: first-hand experience of India was not vital in writing a history – potentially, it led to false ideas about its subject-matter: eyewitnesses are susceptible to bias. The historian was thus to perform his task as a judge: sifting through various testimonies to obtain a ‘more perfect’ conception of the whole than those who witnessed its various parts. Although strange, Mill's claim does not bewilder his readers: after all, Mill was a ‘militant’ exponent of theorizing utilitarianism. I argue that such a reading of Mill's method is injudiciously restrictive. Not only did Mill draw on well-known methodological concerns in contemporary historiographical practice, not necessarily linked with Jeremy Bentham or the Scottish theoretical historiography, but he also seemed to adopt the vocabulary of forensic rhetoric, making his claim that his was a ‘judging’ history more literal than it has been supposed.

I have two aims in this article. The first is to break the deadlocked exchange between John Skorupski and John Broome concerning how best to understand Thomas Nagel's distinction between agent-neutral and agent-relative reasons for action. The second is to provide a reformulation of the distinction which captures an uncontroversial distinction between those reason-giving considerations which encapsulate an indexical relationship between an agent and an object of moral concern, and those which do not. The resolution of this exchange, and subsequent reformulation of the dichotomy, has two important ramifications for contemporary debates in moral philosophy. First and foremost, it reveals the true, pre-theoretical nature of the distinction between agent-neutral and agent-relative reasons for action, and how the notion of agent-relativity cannot be utilized to underwrite the existence of deontic constraints. And, second, it provides definitive support for Skorupski's claim that agent-relative reasons are not the defining feature of deontological ethics.

Many people think that if you're uncertain about which moral theory is correct, you ought to maximize the expected choice-worthiness of your actions. This idea presupposes that the strengths of our moral reasons are comparable across theories – for instance, that our reasons to create new people, according to total utilitarianism, can be stronger than our reasons to benefit an existing person, according to a person-affecting view. But how can we make sense of such comparisons? In this article, I introduce a constructivist account of intertheoretic comparisons. On this account, such comparisons don't hold independently of facts about morally uncertain agents. They're simply the result of an ideal deliberation in terms of certain epistemic norms about what you ought to do in light of your uncertainty. If I'm right, this account is metaphysically more parsimonious than some existing proposals, and yet has plausible and strong implications.
