When social movement activists achieve an institutional position at the policymaking table, does their political behavior moderate with the norms of that institution? We explore this question by examining the behavior and attitudes of Christian Right activists appointed to serve on the 1997-98 Florida Constitutional Revision Commission (CRC). This commission was marked by an unusually high degree of conflict between three factions—Democrats, business-oriented Republicans, and socially conservative Republicans associated with the Christian Right. We found that by maintaining an outsider, purist political style, the commissioners with Christian Right ties were ineffective, isolated, and estranged from the mainstream Republicans on the CRC. The former remained true to their outsider status, behaving more like purist social movement activists than public officials with professional orientations. While these Christian Right elites adapted outwardly to some institutional norms for strategic purposes, they did not assimilate wholly to the demands of conventional political interchange.

This article examines the role of wealth in the redistricting process in state legislative contests. I argue that the decision by state redistricting mapmakers to pursue a “seatswing” or “protection” strategy involves more than just a choice between where to move partisan voters. Redistricting may also allow parties to consider wealth as an additional resource to be concentrated or dispersed across legislative districts. To test this wealth-based hypothesis, I examine state redistricting plans in California and North Carolina. Logistic regression analyses of census block group exchanges between state legislative districts reveal that income plays a significant role in redistricting decisions.

This article examines the relationship between legislative civility and legislative productivity in US state legislatures. The research employs data from the National Survey of State Legislative Lobbyists and from the State Policy Innovation and Diffusion (SPID) database. The former dataset is used to generate an overall civility index for each state as developed by Kettler et al. The SPID database allows one to measure the legislative productivity of a state legislature. Employing these data, negative binomial and Poisson regression models reveal that state legislatures rated as more civil by their own lobbyists produced significantly more pieces of noteworthy legislation than those legislative bodies rated as less civil. These results suggest that the quality of internal legislative dynamics matters for legislative productivity.

To fully understand state policy outcomes or elections in the US, we need valid over-time measures of state-level public opinion. We contribute to the research on measuring state public opinion in two ways. First, we respond to Berry, Fording, Hanson, and Crofoot’s (BFHC) critique of Enns and Koch’s measure of state policy mood. We show that when BFHC’s analysis is performed using the same states and examining annual change, it validates the Enns and Koch measure and raises questions about the Berry, Ringquist, Fording, and Hanson measure. Second, we generate a new measure of state policy mood building on Enns and Koch’s approach. The new measure has even better properties than the previous measure and relates to state presidential vote and state policy liberalism in similar ways to Caughey and Warshaw’s measure of state economic liberalism. We conclude with recommendations for using the various direct measures of state public opinion.

This article explores diversity within top leadership positions in state governments, specifically, the role that position selection method plays in promoting the inclusion of racial and ethnic minorities into positions of power. We hypothesize that minorities will be more likely to serve in appointed positions as governors consider diversity in making appointments and less likely to serve in elected positions due to the additional hurdles for candidates of color. Using an original data set of state executive leaders from 2001 to 2017 from all 50 states, we find evidence that institutional design influences levels of diversity among state executive leaders. Racial and ethnic minorities are more likely to be appointed than elected to state executive leadership positions. In addition, we find that Democratic governors are more likely than Republican governors to appoint minorities. Ultimately, this evidence is important for understanding how institutional design can have consequences for descriptive representation, specifically for groups that have been historically excluded from political life.

Foundational studies in political science endeavored to explain the dynamics of voter turnout in America over time. Two theories, one focused on legal-institutional factors and the other on behavioral elements such as party mobilization strategies, were born from the need to account for temporal fluctuations in aggregate voter turnout. A comprehensive test of these competing theories has been hindered by the fact that reliable measures of the behavioral factors driving turnout have proven elusive. In this article, I develop and test an interactive theory of voter turnout that focuses on the impact of legal-institutional barriers to the franchise conditional on party organizational strength and mobilization efforts. To this end, I use data on the circulation of party-sponsored newspapers, coupled with information on the spread of voter registration requirements, to capture the effects of both behavioral and legal-institutional factors in Pennsylvania between 1876 and 1948. My results offer modest empirical support for an interactive theory of aggregate voter turnout. In isolation, however, the effects of behavioral factors are quite limited. On the contrary, legal-institutional variables exert a sizable impact on voter turnout in the state. Contrary to other recent work on the subject, careful analysis of the Pennsylvania case therefore provides a great deal of evidence in favor of legal-institutional accounts of the changes in aggregate voter turnout that were witnessed at the beginning of the twentieth century while demonstrating that behavioral factors, such as the decline of the partisan press, served to enhance the deleterious effects of legal reforms on turnout.

State governments have recently adopted many policies creating competition in service provision. These policies typically are expected to reduce costs and improve quality through organizational innovation. I present an analysis of one such initiative—the creation of charter schools. Using evidence from a survey-based study comparing charter schools and traditional public schools, I explore the relationship between competition and organizational innovation. I find that competition does appear to promote innovative local practices. But the evidence also suggests that competition can limit communication within the practitioner community, which, in turn, can stifle the diffusion of innovative ideas. Thus, policy design for local innovation may be more effective when competition is augmented with state-level strategies that promote inter-organizational cooperation and learning.

Rising economic insecurity in recent decades has focused attention on the importance of social welfare programs in managing household financial stability. Some governments are more effective than others in managing this outcome, and informal social institutions help explain why. Social capital is expected to shape economic security through multiple mechanisms, but whether the effect is to magnify or mitigate volatility is an open question. Part of the answer has to do with how social capital interacts with policy implementation, and whether it conditions the effectiveness of government spending. Evidence from the U.S. states from 1986 to 2010 fails to support a benevolent social capital thesis—not only is social capital associated with greater economic insecurity, there is no evidence that it improves social welfare effectiveness. However, greater spending on some social programs can mitigate the adverse impact of social capital on economic security.

Voters often have difficulty making choices on the myriad state constitutional amendments they vote on each year. Without partisan cues, they turn to other sources for these low-salience, high complexity measures. One such source is newspaper endorsements. In this article, we look at newspaper endorsements of ballot measures in Florida over 20 years both on “no” votes and roll-off. We argue that endorsements' effect on “no” votes and roll-off differs in ways not previously appreciated. Newspaper endorsements have a positive impact on no votes, as expected from the information theory of voter participation. Endorsements have little impact on roll-off, which we posit is because roll-off voters are not likely to seek information from newspapers. Thus, newspaper endorsements serve to persuade, but not entice, voters to vote for ballot measures.

This article examines the responses of sub-national governments to international agreements that severely reduce their policy discretion. I focus on their decision to subject public procurement to international competition by joining the Agreement of Government Procurement (GPA) of the World Trade Organization. In a public procurement market, a government becomes both a market participant and a market regulator. I argue that the propensity of governments to join the GPA, thus reducing their discretion as market regulators, depends on the degree of local political competition. Studying state governments in the United States, I find that the degree of political competition positively affects not only the propensity to join the GPA but also the amount of procurement that a government subjects to international competition.

We examine the influence of national politics and changing racial demographics on school board elections. We identify the districts where candidates campaigned on Critical Race Theory, COVID response, or parent control/transparency (what we call “conflict elections”) and examine two related questions. First, what characteristics define school districts that had elections involving these issues? Second, in the places that had conflict elections, how frequently did “conflict candidates” win, and what factors influenced their odds of winning? Utilizing a unique dataset of all school board elections in Wisconsin in 2022, we find that Republican presidential vote share is positively related to both the probability that a school district had a conflict election and that a conflict candidate won. We also find that in communities where the white population declined between 2010 and 2020, there was a higher likelihood that a conflict candidate won compared to communities where the size of the white population grew. Overall, our analysis confirms that school board elections are increasingly mirroring nationalized trends in other elections.

This article examines the impact of electoral politics on state welfare policy in the post-civil rights era South. In contrast to an emerging consensus concluding that southern African Americans materially benefited from rejoining the electorate, this study suggests that higher black registration rates actually reduced states' poverty relief efforts. In the years immediately following the Voting Rights Act (VRA), when Democrats controlled state government, the significant negative relationship between the size of the black electorate and state welfare generosity was moderated to some extent by high levels of partisan competition. In such cases, Democrats ostensibly chose a “core” targeting strategy of pursuing lower-income votes and had the institutional wherewithal to purchase these votes with policy concessions. Overall, however, the liberal “Downsian” policy response to African American mobilization was dominated by an antiredistributive response. In the South, welfare policies were relatively conservative vis-à-vis the other states during Jim Crow and became more so in response to black voting.

The American state legislatures provide a unique opportunity for the study of lawmaking. This essay describes and analyzes state legislative research since 1990 and offers suggestions for future research. The discipline made significant gains during this period, expanding our knowledge on a wide variety of important topics and concerns. Despite these gains, many gaps in our knowledge remain unfilled and many questions remain unanswered. The field has been particularly weak in building theory. Scholars need to make a more concerted effort to develop our theoretical understanding of state legislatures for the field to develop greater direction and coherence.

The current version of the Squire state court of last resort professionalization index is regularly used in studies of state courts. We have updated the index for 2019, producing a second and more recent index. Given the relative stability between this index and its predecessor, it is unlikely that many findings will change. During the 15 years that lapsed between the first index and the more recent one, little changed in most states, while reforms in a few places substantially shifted the relative standing of their court of last resort. It seems unlikely that the nation will experience any sweeping reform movements impacting state courts of last resort across the board. The more likely scenario is the sort of idiosyncratic changes impacting a few courts that were witnessed over the last decade and a half. Thus, looking to the future, it may be prudent to update the index every 5–10 years to capture any notable alterations.

Recent studies of representation at the national and state levels have provided evidence that elected officials' votes, political parties' platforms, and enacted policy choices are more responsive to the preferences of the affluent, while those with average incomes and the poor have little or no impact on the political process. Yet, this research on the dominance of the affluent has overlooked key partisan differences in the electorate. In this era of hyperpartisanship, we argue that representation occurs through the party system, and we test whether taking this reality into account changes the story of policy dominance by the rich. We combine data on public preferences and state party positions to test for income bias in parties' representation of their own co-partisans. The results show an interesting pattern in which underrepresentation of the poor is driven by Democratic parties pushing the more liberal social policy stances of rich Democrats and Republican parties reflecting the particularly conservative economic policy preferences of rich Republicans. Thus, we have ample evidence that the wealthy, more often than not, do call the shots, but that the degree to which this disproportionate party responsiveness produces less representative policies depends on the party in power and the policy dimension being considered. We conclude by linking this pattern of influence and “coincidental representation” to familiar changes which define the transformation of the New Deal party system.

The Commission-based process of local government electoral redistricting in England seeks to balance the tensions between both neutral and party political and mathematic and organic approaches to boundary drawing. We evaluate the success of this process by assessing the impact of redistricting on electoral equality and the strength of the political parties in each local authority. On one hand, the Commission appears to be effective in achieving vote equality by reducing the variability between electoral units in the ratio of electors to councillors. On the other hand, the way that submissions are made to the Commission, together with aspects of social and electoral geography over which it has no influence, can allow one party to receive more electoral benefit than another from redistricting.

In the face of the intensifying global climate crisis, the US has failed to implement comprehensive policies to mitigate greenhouse gas emissions. During the 2000s, the shale oil and gas extraction (i.e., “fracking”) revolution highlighted the American energy economy. Is the fracking boom partially to blame for US lagging on climate policy? Political economy theory suggests that economic resources are primary drivers of policy outcomes. In this paper, I originally evaluate that claim in the context of the American states, the governments most powerful to mitigate emissions while the federal government faces gridlock. I first introduce an original measure of one state-level climate policy: adoption of the low-emission vehicle (LEV) policy from 1991 to 2015. I then frame the US fracking boom of the mid-to-late 2000s as a natural experiment, employing a difference-in-difference design to compare the effects of fracking on two climate policies across the American states – LEV and renewable electricity policy. Results yield evidence of a causal impact of the fracking boom on state LEV adoption and more suggestive evidence of an impact on renewable electricity mandates. I conclude by arguing that efforts to evaluate the influence of business on policy should account for “structural power” mechanisms.

A growing literature has revealed a notable electoral advantage for congressional and gubernatorial candidates with deep local roots in their home districts or states. However, there is a dearth of research on the presence and impact of local roots in state legislative races. In this paper, we close that gap by demonstrating the consistent and significant electoral impacts that state legislators’ local roots have on their reelection efforts. We use data capturing a representative cross-section of state legislative incumbents (N = ~5,000) and calculate a novel index measuring the depth of their local roots modeled after Hunt’s (2022, Home Field Advantage: Roots, Reelection, and Representation in the Modern Congress) measure for the US House. We present evidence that state legislators with deep local roots in the districts they represent run unopposed in their general elections nearly twice as often as incumbents with no such roots. Of those who do attract challengers in their reelection efforts, deeply rooted incumbents enjoy an average of three extra percentage points of vote share. Our results have important implications for candidate emergence in state legislative elections during a time when so many are uncontested. They also demonstrate the limits of electoral nationalization for understanding state politics.

Previous tests of theories of legislative committee development have relied on floor behavior and votes, data which is one step removed from committee behavior itself. I test these prominent theories of committees by looking directly at legislative behavior in committee. I examine the patterns of committee votes in the 2000-01 sessions of the California Legislature to assess the distributive, informational, and partisan theories of committee development. I find some support for all three theories, leading me to conclude that committee behavior varies across time and issue.
