Judiciary and litigation are the two most prominent types of activities within the legal profession. The judicial aspect of the profession entails the interpretation of laws and the administration of justice in a fair and impartial manner. As a concept, justice entails protecting society from offenders and evildoers who deviate from society’s norms and engage in illegal behaviour by punishing and sentencing them. Due to the predominance of the human factor in the legal profession, which has such a significant impact on the lives of all members of society, it is crucial to investigate whether there is a guiding force behind dispensing justice and, if so, how effective these guidelines or policy measures have been. As crime rates rise and societal standards fall in the contemporary era, the legal profession grapples with the complexities of modern criminal behaviour. Particularly in the realm of judicial sentencing, there is a need for guidelines that account for the diversity of crimes and their individualistic nature. In India, long pungencies in court cases and a decline in the State’s conviction rate further exacerbate these issues. This paper examines the pressing need for comprehensive, well-structured sentencing guidelines that promote transparency, fairness and efficiency in the judicial process. Through a detailed review of recent high-profile court cases and an analysis of current practices and policies, this paper highlights the urgency of reform in the sentencing process to enhance public trust in the legal system. This article provides additional information on the subject.

The current article reports the results of a systematic study of 42 intimate partner femicide–suicides with 91 fatal casualties in Eswatini, Africa, from 2009 to 2022. The study used a media-surveillance methodology to identify the 42 cases from a major local online newspaper. Information on all identified cases was subjected to careful criminological analyses. Six of the cases involved seven collateral, or corollary, homicide victims. Results indicate that assailants and victims were generally of lower socio-economic background; assailants tended to be older than their victims; stabbing with a knife, shooting with a gun and slashing with a machete were the dominant homicide methods; ingestion of weevil tablets and other poisons, hanging and shooting with a firearm were the predominant suicide means. The results further show that femicide incidents overwhelmingly involved overkill, with the assailant using inordinately high levels of aggression against the victim. Male sexual jealousy, rage over the female partner’s abrogation of the relationship, and interpersonal disputes of variable origin were the major precipitants. It is recommended that deterrent sentences should be used to teach wife assaulters and would-be assaulters that society does not tolerate assaultive behaviour within intimate relationships. More resources should be provided for women who are victims of domestic violence. This should include legal aid, financial resources and refuges for women in danger and their children. Measures should be taken to control the proliferation of firearms in society.

Enforced disappearance is one of the most horrific crimes of our time. This is a crime that causes excruciating suffering to its victims: the disappeared and their families and relatives. Thousands of people have suffered, and are still suffering, all over the world from enforced disappearances. To combat this scourge, a United Nations Convention was adopted in 2006 and entered into force in 2010. It adopted a definition of enforced disappearance that includes an important element: the direct or indirect involvement of the State Party in the commission of the enforced disappearance. Yet, private entities (commonly referred to as non-State actors) can also commit acts similar to enforced disappearances. However, in the absence of the element of the State Party’s involvement, can we go so far as to qualify the acts perpetrated by non-State actors as enforced disappearances? This question has generated and continues to generate an interesting debate.

This article studies the juvenile justice system in juxtaposition to policing in India. To start with, it conducts a comprehensive data analysis of juvenile crimes in India in the last two decades. The author conducted a study involving 400 juveniles in conflict with the law through “Disha,” a project in juvenile re-entry systems. It further marshals the incidences based on social parameters like education, age, and family. Here, the paper impresses upon the “heinousness factor” of the crimes to evaluate the law and institutional response. The article examines the growth of the legal framework on juvenile justice in India and the causal determinants which may have driven its increase. It also scrutinizes the policing systems as far as the legal framework on juvenile justice makes them responsible. It delves deeply into the interactions between juvenile justice and police systems at the institutional and procedural levels. It conducts a detailed inquiry into the international legal framework of juvenile justice systems. Here, it studies such systems in the Americas, Europe, and Asia to suggest the way forward for a transparent, robust and sensitive juvenile justice system in India.

Global views of the police (often termed “legitimacy”, “trust”, “satisfaction” or “support”) are frequently regarded as the product of micro-level, police-related consideration: beliefs about what the police are doing and how they are doing it. Studies taking a sociological or political perspective have revealed that views unrelated to policing, such as satisfaction with the government, may also be important predictors of global views of the police. However, police-related and non-police-related considerations are frequently not considered together as antecedents of macro-level views of the police. This study aims to illuminate the respective roles of police-related versus non-police-related considerations in shaping citizens’ diffused support for the police while utilizing the context of the COVID-19 pandemic. Data from a panel survey carried out during the first and third peaks of the pandemic in Israel reveal that the only factor which had a direct effect on the drop in diffused support for the police was the public’s assessment of the government’s (not the police’s) performance in handling the pandemic. We conclude by calling for more sophisticated measurement and interpretation of public approval of the police and its antecedents.

This study examines the intricate relationship between religion and attitudes towards terrorist violence, with a specific focus on individual sympathy for al-Qaeda and justification for suicide bombings. While religion has the capacity to promote both harmony and social cohesion, as well as division and conflict, it is crucial to explore the complex and contradictory nature of religious beliefs in relation to individuals’ attitudes towards terrorism. To address this paradox, the study differentiates between religion as a belief and religion as an ideology. Drawing from a subset of the 2011 Pew Global Attitudes Survey, encompassing countries with substantial Muslim populations (Egypt, Indonesia, Jordan, Lebanon, and Turkey), the research investigates how religiosity and political Islam influence public attitudes towards terrorism, considering political and economic grievances in these contexts. Multivariate statistical analysis suggests that religiosity and political Islam exhibit distinct associations with the justification of suicide bombings and support for al-Qaeda, and these dynamics vary across countries. Ultimately, the study underscores the importance of perceiving religiosity not as a threat but as a potential remedy to prevent extremism by fostering an educated and deeper understanding of religious principles.

We use data on street segments in Tel Aviv-Yafo to examine whether general or specific crime factors are key to understanding crime rates on street segments. We pose two questions. (1) What causal factors explain the property and violent crimes at the same locations? (2) What are the differences and similarities between the risk factors of the two crime types? Our study capitalizes on data drawn from the Israeli Central Bureau of Statistics (CBS) to identify social and opportunity data at the street segment level. The dependent variable is the average counts of violent and property crimes in Tel Aviv-Yafo between 2010 and 2014. Zero-inflated negative binomial (ZINB) regression explains violent and property crime variations. While many of the significant factors that explain crime are similar between the two crime types, there are also distinct criminogenic factors predicting violent and property crime. Overall, our results support the position of common or general crime causes at places, but at the same time, they suggest the importance of understanding specific causes for specific crime types.

Social re-entry in the criminal justice system cannot be avoided since virtually all prisoners are released sooner or later. These initiatives are the outcome of a restorative justice approach which aims to reduce future offences by bringing back offenders to normal life by rehabilitation and restoration. Prisoners’ lives in prisons were very difficult in the Indian context till the last decade. Different rehabilitative approaches have been introduced inside prisons but, after release, the number of social re-entry initiatives is much less. The released face many psycho-social and economic issues which may destroy a person’s ability to adjust with the services provided. The national prison policy of India recommends aftercare services for the rehabilitation of released prisoners. The labelling and social stigma due to the crime hinders prisoners’ ability to re-enter society after release. In this context, the present paper explored the issues and challenges faced by the released prisoners during their social re-entry and came up with rehabilitative initiatives for a better restoration process in the Indian context.

The present study verified the existence of psychological profiles among Brazilian adolescent offenders, using data from a sample (n=858) collected with the Brazilian version of the Revised Jesness Inventory (JI-R-Br). This instrument is a comprehensive, self-report measure of personal dispositions (traits) that are associated with vulnerability to antisocial behavior (Impulsivity, Aggression/Hostility, Sensation Seeking) and adaptive patterns (Antisocial Values/Beliefs and Antisocial Attitudes). Cluster analyses showed three significantly distinct groups: group 1 (n=276), called Asocial, was comprised of impulsive/aggressive adolescents with high antisocial motivation, low self-control and very focused on their own needs. Group 2 (n=346), called Neurotic Antisocial, was comprised of adolescents with high rates of depression and anxiety, as well as low self-control, but with less antisocial motivation when compared with group 1. Group 3 (n=236) was similar to group 4 (normative group; n=572). Our results corroborate those described by other studies in the literature. They show the importance of different practices and/or interventions when working with offenders, given that there are different profiles based on different psychological characteristics/needs for this population.

The current paper examines the aetiology of persecution committed against the Rohingya in Myanmar from a criminological perspective. Criminological theories focusing on one level of analysis may not fully explain the incidents concerning the systematic implementation of policies of persecution against the Rohingya for decades. Thus, the author scrutinizes the factors which are involved in the aetiology of persecution at three different levels: macro (national), meso (organizational) and micro (local community and individual) within four dynamics – namely, motivation, opportunity, control and constraint. This paper employs the case study method and collects data through focus group discussions with the Rohingya in the Kutupalong refugee camp in the Cox’s Bazar region of Bangladesh. It limits its analysis to the data that covers the events of persecution against the Rohingya in Myanmar, such as revocation of their citizenship, deprivation of their fundamental rights, and different forms of atrocity crimes, from 1962 to 2019. It reveals that, despite the heterogeneity of the actions that led to atrocity crimes against the Rohingya, the military leaders in charge of Myanmar (and somewhat Myanmar’s civilian government), military personnel and other security force members, paramilitaries and vigilantes played various roles in the perpetration of such crimes.

The phenomenon of female migration to ISIS (Islamic State in Iraq and Syria) is in fact an undervalued form of revolution for Muslim women. It is, however, a bitter form of striving for women’s emancipation. By transmitting extremist thoughts in the education of children and on the Internet, women empower their position in a patriarchal environment. The women of ISIS use their traditional role of motherhood to participate in the global jihad. By staying in her own tradition, the mother is the first one to create would-be fighters. Hence, the martyr becomes the mother’s creation. They use the mass weapon of education in a reactionary way to demand their place between the men. The process of jihadism amongst women is multidimensional. Herein lies the girl power that can be considered as a manifest aspect. Women recruit potential supporters of ISIS, translate documents, write poems and give Islamic lectures on the Internet. The phenomenon of female migration to IS can also be seen as a romantic urge to return to the golden era of the Moorish caliphate and even to the beginning of Islam in the 7th century. The women of ISIS make efforts to emancipate, however, by making a U-turn.

Cet article présente un certain nombre de réflexions sur le processus de coévolution socio-technique qui voit les technologies issues de la révolution numérique (téléphonie sans fil, internet, robotique, big data, etc.) faire l'objet d'exploitations systématiques à des fins délinquantes. Il est organisé en cinq sections: après avoir examiné le contexte économique permettant au cybercrime de devenir une activité extrêmement lucrative, on aborde dans les deux sections suivantes quelques-unes des principales manifestations de la délinquance numérique en s'appuyant sur une perspective canadienne. Dans une quatrième section, nous déplacerons notre regard vers la réponse que les institutions chargées du contrôle social, la police en l'occurrence, apportent à ce problème et sur les innovations possibles en matière de régulation des déviances numériques. Finalement, la dernière partie de cet article adopte une approche prospective inspirée de la théorie des brèches afin d'essayer d'identifier les technologies émergentes de la prochaine décennie qui offriront des opportunités attractives aux délinquants.

A correct understanding of the dynamics and mechanisms that make it possible for a woman to become a victim of intra-family violence allows the necessary measures to be taken so that she can escape from the situation of victimization. Emilio C. Viano, President of the International Society of Criminology, defines the victim of an abuse as “any subject injured or that has suffered wrongdoing on the part of others, who perceives herself to be a victim, who shares the experience with others looking for help, assistance and compensation, who is recognized as a victim and who presumably is being helped by public, private or collective agencies/structures”. Before the birth of Anti-Violence Centers it was believed that the awareness of being a victim was the necessary condition for a woman to ask for help. Experience has shown that, in reality, it is the request for help that allows her to begin a process of awareness together with the operators in the Anti-Violence Centers. This reflection has led to the creation of a theoretical model called “The Circular Model of Victimization”. The aim of the research, and which is presented here, was to verify whether the Italian Anti-Violence Centers recognize the Circular Model in the daily operational reality, and thus to ascertain whether this model can be considered a real empirical model, as well as a theoretical explanatory model. In conclusion, the revisited Circular Model of Victimization will be presented, in which it is assumed that the way out of the circuit of violence passes from a first moment of perception of victimization to arrive at a real awareness of the same.

This contribution will present the observational method, whose main goal is the in-depth analysis of the criminal situation concerning both the dynamics that are triggered within the relationship – therefore interpreting them through the eyes of the individuals involved – and the dynamics faced by those who observe the relationship from the outside and then have to represent or judge it. The method is the result of the encounter between two approaches, narrative criminology and visual criminology, from which it borrows the concepts of narrative and image. Narrative, in this case, means the stories produced by individuals, who describe the events through their point of observation, and the arguments produced by criminologists and operators based on the perspective they adopted in observing the story; therefore, the narrative plays a central role. The observational method defines the relationship metaphorically as if it were a room within which the protagonists act and perceive themselves according to where they are placed and what they see subjectively. Those who observe the room from the outside will describe it as if it were a photograph. Here the concept of image borrowed from visual criminology returns. Starting with the first activities that are carried out talking about criminal acts (fact-crimes) and then the inspection activities (technical–judicial and psycho-criminological), we will highlight the role of the criminologist and the narrative approach that distinguishes his or her work.

This article examines culture, an ambiguous yet prevalent concept in comparisons of crime and justice. It investigates the extent to which culture’s application and meaning across research reflects Western-centric bias in criminological knowledge-production despite it being a concept meant to advance understanding on different groups and places beyond the “Western” worldview. The article extends the discussion on Western-centric bias but also on culture in criminology by tracing the use of this concept on East Asian populations and by identifying patterns of application and meaning in international and comparative research through a scoping review of 230 journal publications. The findings address patterns of culture’s appearance in criminology journals in the past two decades and its meaning. Similar to previous scholarship on Western-centrism in criminology, the article finds that this bias does, too, exist in uses of culture but also shows how culture’s conceptual ambiguity is conducive to this bias, in that some groups and places are given one meaning of culture while others receive another.

This work presents validation of the Jesness Inventory, particularly its revised version, to the Brazilian reality. It was developed by Carl Jesness, based on his clinical experience and research programs for juvenile offenders, to assess juvenile offenders, particularly to understand the functioning of their personality, offering clues to customize psychosocial intervention, and verification of results from this, in terms of changes in adolescents’ beliefs/values and attitudes. Regarding the psychometric properties, the revised version showed an adequate internal consistency and temporal stability. For the evidence of validity, the results of the concurrent criterion and simultaneous validity were in agreement with those found in other studies, emphasizing the specific capacities of this instrument to distinguish adolescent offenders from non-offenders and properly classify them, denoting its quality in helping the diagnostic process. Research to verify predictive and construct validity is being carried out.

Historically, women in Pakistan’s northwestern territories bordering Afghanistan have played a critical role in providing money and men to jihadist organizations such as the Taliban, Al-Qaeda, and “Islamic State in Iraq and Syria” (ISIS). Lack of education, too little exposure and a male-dominated conservative milieu constitute some of the ingredients of support for these outfits. This was true for over three decades and the phenomenon remained restricted to the rural, backward northwestern regions. But since the early 1990s, outfits such as the Al-Hudda Foundation – an exclusively women-focused organization – began serving as the initial hooks for middle- and upper-class women whom the Foundation targets. It brainwashes women into using hijab, and also into believing that they need to forge an alliance against the West and work for an Islamic, Sharia-based state. This advocacy turns many affluent women into religious radicals who can potentially work as the first line of recruits for extremist outfits like Daesh/IS. However small their numbers, these women represent a big threat to the global liberal values of society.

Forensic science is undergoing an unprecedented period of reform. Wrongful convictions and errors of impunity have been attributed largely to forensic evidence, and concerns over the scientific foundations of many forensic disciplines have been raised in key official reports. In these turbulent times, it becomes particularly interesting to understand how forensic evidence is understood by the general public. Is it idealized? Are its inherent limitations recognized? The present study seeks to contribute to this growing body of work by addressing two main questions: (1) How does the general public perceive forensic science?; (2) How correct are individuals in their evaluations of specific types of forensic evidence? A survey of the Israeli public reveals considerable trust in the ability of forensics to reliably identify the perpetrator of a crime, although less trust is expressed when questions lead respondents to consider specific stages in the forensic process. Furthermore, respondents were often incorrect in their evaluations of the reliability of specific types of forensic evidence. The implications of these findings for police legitimacy, the practice of the criminal justice system, and the future study of attitudes toward forensic evidence, are discussed.
