Mathew Carey promoted the high tariff as a political expression of humane sentiments that relieved American workers of the misery caused by low wages and unemployment. This made him an early example of a state-builder working outside the state itself, building ideological frames and using emotional appeals to promote the expansion of state capacity. Although other aspects of his protectionism appealed to the republican tradition, Carey meshed his sentimental appeal with the liberalism. Later reformers integrated sensibility with liberalism by reference to the rights of vulnerable parties, but Carey added an appeal to an enlightened self-interest that allowed American manufacturers to profit while protecting workers. Although he became a well-known advocate for the organized provision of social welfare, his continued opposition to the widespread distribution of outdoor relief also suggests that he viewed the policy as a circumscribed federal social-welfare measure providing work rather than direct aid.

The early Speakers of the US House of Representatives, most historians and political scientists have agreed, aspired only to facilitate legislative business; the office served as an “impartial moderator,” its functions were “largely ceremonial,” and its occupants of no more consequence than a mere “traffic cop.” This article challenges that conclusion by presenting episodes from the tenures of four early Speakers—Jonathan Dayton, Theodore Sedgwick, Nathaniel Macon, and Joseph B. Varnum—to illustrate their contributions to debates that still occupy us today: the relationship between Congress and president; the scope of federal power; the extent of constitutional freedoms; and the functions and limitations of party government. At a moment when scholars are showing renewed interest in the historical mechanics of lawmaking, this article argues for reinserting the Speakership back into the heart of that process, where it has always belonged.

Relatively little is known about how late nineteenth-century associations worked to get their policy goals adopted by state governments. We study this question here, considering the Woman’s Christian Temperance Union (WCTU) and three policies it supported: scientific temperance instruction, increasing the age of consent, and prohibiting tobacco sales to minors. Overall, WCTU-supported legislation was more likely to succeed in states with unified Republican state legislatures, aided by neighboring state adoptions (scientific temperance) and greater WCTU membership (increasing age of consent and prohibiting tobacco sales to minors). These findings are supported by historical evidence, which reveals how WCTU leadership targeted particular states when lobbying for scientific temperance instruction laws and utilized its broad membership base to pressure state legislatures on the other two issues. In total, these results show how one late nineteenth-century membership group was able to facilitate the successful spread of its policies throughout the nation.

The mission of the United States Navy expanded significantly because of the presence of the institution of racial slavery on American soil. Most important, both proslavery and antislavery forces favored, for very different reasons, a substantial naval buildup in the late 1850s. The navy had, however, long been engaged in securing the nation’s borders against slave smuggling, an activity that also seemed to have broad support at the time. Finally, somewhat more controversially, the navy had been associated with the American Colonization Society’s Liberian enterprise from its very inception, deciding to deploy vessels to Africa in an otherwise unimaginable time frame. The relationship between the presence of slavery and the pre–Civil War activities of the navy is a largely untold—or, at best, half-told—story of American state development.

The 1972 abortion-initiative campaign in North Dakota provides an example where elites on one side of an issue were able to provide cues and get supporters to participate in an election while the other side was unable to do so. North Dakota Right to Life through the formation of branch chapters and its work with the Catholic churches became the focus of the anti-initiative campaign. Flush with resources, the NDRL made sure that its supporters turned out to such an extent that initiative voters outnumbered presidential voters in most counties. While the pro-initiative elements proved effective at getting the question on the ballot, they were unable to get their message out, let alone galvanize supporters. The result was confusion among potential supports and lower turnout rates in the most populous counties.

Architects of social welfare policy in the Kennedy and Johnson administrations viewed the military as a site for strengthening the male breadwinner as the head of the “traditional family.” Daniel Patrick Moynihan and Robert McNamara—men not often mentioned in the same conversations—both spoke of “salvaging” young men through military service. The Department of Defense created Project Transition, a vocational jobs-training program for GIs getting ready to leave the military, and Project 100,000, which lowered draft requirements in order to put men who were previously unqualified into the military. The Department of Defense also made significant moves to end housing discrimination in communities surrounding military installations. Policymakers were convinced that any extension of social welfare demanded reciprocal responsibility from its male citizens. During the longest peacetime draft in American history, policymakers viewed programs to expand civil rights and social welfare as also expanding the umbrella of the obligations of citizenship.

Although originalism’s emergence as an important theory of constitutional interpretation is usually attributed to efforts by the Reagan administration, the role the theory played in the South’s determined resistance to civil rights legislation in the 1960s actually helped create the Reagan coalition in the first place. North Carolina Senator Sam Ervin Jr., the constitutional theorist of the Southern Caucus, developed and deployed originalism because he saw its potential to stymie civil rights legislation and stabilize a Democratic coalition under significant stress. Ervin failed in those efforts, but his turn to originalism had lasting effects. The theory helped Ervin and other conservative southerners explain to outsiders and to themselves why they shifted from support for an interventionist state powerful enough to enforce segregation to an ideology founded on individual rights and liberty. It thus eased the South’s integration with the emerging New Right.

The rise of crack cocaine in the late 1980s propelled the war on drugs. The experience of Canton, Ohio, shows how the response to crack solidified mass incarceration. A declining industrial city of 84,000 people in northeast Ohio with deep-seated racial divides, it was overwhelmed by aggressive, enterprising crack dealers from outside the city. In response, politicians and residents united behind the strategy of incessant arrests and drastic prison sentences. The law-enforcement offensive worsened conditions while pursuing African Americans at blatantly disproportionate rates, but few people engaged in reframing the drug problem. Instead, a punitive citizenry positioned punishment as the principal remedy. The emergency foreclosed on more comprehensive assessments of the city’s tribulations, while the criminal justice system emerged as the paramount institution.

President Franklin Delano Roosevelt shaped the role of the modern president in part with his relentless pursuit of grand policies and his ability to marshal historic legislation through Congress. In this article, I focus on one legislative tactic employed by FDR that has received little attention—the detailing of Executive Branch staff to select Senate committees. This tactic, effectively a blending of legislative powers, was used to implement FDR’s ambitious postwar domestic agenda as detailed in his Second Bill of Rights. I find that the tactic, used late in FDR’s presidency, was moderately effective, served as a substitute for the personal energy FDR applied to the presidency in his first term, and created a backlash that contributed to the adoption of the Legislative Reform Act of 1946. With these findings I conclude that FDR deserves credit as a transitionary figure for the modernity of Congress, as well as the presidency.

This article reveals how the politics of federalism in the 1920s stifled the U.S. Children’s Bureau’s ability to collect national data on the workings of the Sheppard-Towner Act. The Bureau staff’s reliance on state administrators for data hindered their efforts to collect standardized national statistics on the states’ use of federal dollars. Ultimately, this barrier contributed to Sheppard-Towner’s defeat in 1929. Though the law was short-lived, the problems the Children’s Bureau encountered administering it provide insights into how federal matching grant programs began to shape federal and state relations before the New Deal. As this article shows, Bureau staff learned from their experience administering Sheppard-Towner that they needed to implement more stringent federal oversight over state-level accounting in their administration of Title V of the Social Security Act.

Over the last thirty years, historians and historically minded political scientists have effectively overturned the long-held perception of the nineteenth-century United States as a polity defined by its lack of an effective state. By highlighting the myriad interventions of its energetic and enterprising federal government and by incorporating subnational governments and private actors and organizations as evidence of its impressive “infrastructural” power, a generation of scholars have, collectively, described a nineteenth-century state that was both more assertive and more robust than was previously thought. Yet other scholars have begun to ask whether this interpretation has concocted a state stronger and more coherent in prospect than it was in practice. By highlighting the piecemeal and often partial nature of the nation’s institutional development and the contradictions and incoherence that accompanied its infrastructural power, these scholars have laid the foundations for a new “improvisational synthesis” that stresses the equivocal nature of American state-building and considers its enduring vulnerabilities.

As revolutions swept across Central and South America in the 1820s and 1830s, Andrew Jackson’s administration undertook a landmark reform that transformed the US foreign policy apparatus into the nation’s first global bureaucracy. With the introduction of Edward Livingston’s 1833 consular reform bill to Congress, the nation embarked on a long path toward the modernization of its consular service in line with the powers of Europe and the new American republics. Despite the popularity of Livingston’s plan to turn a dated US consular service comprised of mercantile elites into a salaried professional bureaucracy, the Jacksonian consular reform dragged on for more than two decades before the passing of a consular bill in 1856. Contrary to Weberian models positing a straightforward path toward bureaucratization, the trajectory of Jacksonian consular reform demonstrates the power of mercantile elites to resist central government regulation just as much as it highlights how petty partisans—the protégé consuls appointed via the Jacksonian “spoils system”—powerfully shaped government policy to achieve personal advantages. In the constant tug-of-war between merchant-consuls and Jacksonian protégés, both groups mobilized competing visions of the “national character” in their correspondence with the Department of State and in the national press. Ultimately, the Jacksonian reform vision of an egalitarian and loyal consular officialdom prevailed over the old mercantile model of consulship as a promoter of national prestige and commercial expertise, but only after protégé consuls successfully exploited merchant-consuls’ perceived inability to compete with the salaried European officials across the sister-republics of the southwestern hemisphere.

This article analyzes how policy ideas already adopted in Europe, particularly in France, were taken into consideration for the design of Uruguay’s National Public Assistance (NPA) policy. Established in 1910, the NPA was a pioneering government social policy for the time and for the region.

Some have argued that the design of the NPA law followed the secular and republican model instituted in France at the end of the nineteenth century when France established the Assistance Publique, particularly regarding the extent of public assistance to the poor, the role of the state in the provision of health care (as opposed to charity-based provision) and the centralization of health-care services (as opposed to a decentralized health-care system).

We analyze how these revolutionary ideas were discussed by the technicians and politicians who participated in the process that culminated in the approval of the law in Uruguay discussed these revolutionary ideas. We explore the factors that motivated the creation of the commission that developed the law. We also review available documentation on the drafting of the bill and the parliamentary debate that culminated in its approval. We find that the design of the NPA included many ideas diffused mainly from France. The French model was not simply emulated, however. Rather, the authors of the NPA thoroughly analyzed and considered the features and main consequences of the Assistance Publique, suggesting that diffusion in this case was more a process of learning than of simple mimicry.

This policy perspective discusses three important social welfare programs—Social Security Disability Insurance, Medicare, and Temporary Aid to Needy Families—and offers an explanation of how they have expanded over time.

The United States Constitution requires the government “to provide for the common defense.” As a prime topic featured prominently throughout the legislative blueprint of American society, the “common defense” is conspicuously uncommon in today’s policy scholarship and education. Ironically, the policy discipline largely ignores defense issues despite defense serving as the catalyst for establishing policy studies as an academic field in the 1940s. Through decades of military conflict since and obvious relevance to practitioner behavior, defense issues remain ironically absent the public policy scholarly landscape and are instead hosted primarily within strategic and security studies mediums. This article offers an historical examination of the evolution, development, and scholarly shifts in defense policy over time. It also presents perceived reasons for the lack of defense policy dialogue, recommends approaches to reintegrate the topic back into the scholarly discourse, and concludes arguing defense policy warrants greater attention in academic scholarship and teaching.

Since the presidency of Richard Nixon, policymakers have sought “energy independence” as the goal of energy policy. But that goal, unclear to begin with, has grown more opaque over time. “Energy independence” has meant different things at different times with no clear definition. Nevertheless, the goal is evocative, with symbolism that draws on key narratives from American history. This article argues that the idea of “energy independence” has become a trope and as such a major component of the energy-policy discourse. It describes the shifting (often only apparent) definitions of the trope both in energy-policy rhetoric and in energy legislation, and also explains how the discourse has shifted in recent years due to resource development and the realities of climate change.
