This study argues that women's ownership of land – an important component of their status – changed little, if at all, after the Black Death of the mid-fourteenth century. Using rentals and obit data from court rolls, a new formula for measuring female inheritance is devised which shows that daughters received even less of their expected due during the plague years. While high death rates might predict that brotherless daughters would be more likely to inherit land, inheritance practices shifted so that women continued to hold much the same total area as before. The article considers several reasons for this continuity, concluding that women found it especially hard to compete in an era of acute labour shortage.

Marriage ceremonies in London were easily available at a wide range of locations before Hardwicke's Marriage Act put a stop to clandestine marriages in 1754. Not constrained to their own parish church, many wed at centres of clandestine marriage such as the Fleet, or in other churches by licence. For particular parish populations, focusing mainly on the suburban majority but with comparisons with the mercantile city centre, this paper considers the relationship between demographic, geographic and social factors (age, residential location, and propensity to engage in premarital sex) and choice of marriage location between 1610 and 1753.

In many early modern towns of the southern Low Countries, beguinages gave adult single women of all ages the possibility to lead a religious life of contemplation in a secure setting, retaining rights to their property and not having to take permanent vows. This paper re-examines the family networks of these women by means of a micro-study of the wills left by beguines who lived in the Great Beguinage of St Catherine in sixteenth-century Mechelen, a middle-sized city in the Low Countries. By doing so, this research seeks to add nuance to a historiography that has tended to consider beguinages as artificial families, presumably during a period associated with the increasing dominance of the nuclear family and the unravelling ties of extended family.

This article argues, using evidence from Georgian London, that historical demographers need to revisit the effects of two inter-related phenomena: the effects of burial fees on interment practices and the ebb and flow of a very considerable ‘traffic in corpses’. By the eighteenth century burial space in London was at a premium and there was an active market in the provision of suitable, and affordable, burial grounds. This article is based on the sextons' books of the Westminster parish of St Martin in the Fields. These books are very unusual in recording exported ‘certificate’ and ‘arrears’ burials. The ‘traffic in corpses’ revealed by this source is analysed in some detail and burial fees turn out to be of great importance in understanding local fluctuations in interment practices. A neighbouring parish, St Anne, Soho, was acting as a veritable ‘clandestine burial centre’ which interred non-parishioners for profit on a huge scale for most of the eighteenth century. The ‘commodification’ of burial, driven partly by considerations of cost, thus had a major impact on interment practices in the eighteenth-century metropolis. A key finding is that, due to this postmortem flow of corpses, the total number of recorded burials in any one parish may not necessarily have been driven by fluctuations in local mortality rates.

Private contracts of many different kinds were at the heart of the rural economy in medieval and early modern Europe. This article considers some of the key issues involved in the study of those contracts, and of the institutions that facilitated their registration and enforcement. Drawing on examples from medieval England as well as the articles in this special issue of the journal, it is argued that complex and effective ‘public-order’ structures for contract registration and enforcement – principally various kinds of law court – were ubiquitous in European villages and small towns in this era.

This article offers a comprehensive examination of the relationship between foreign residents and the criminal law in early modern England, as well as an investigation of trials ‘de medietate lingue’, trials with half-English and half-foreign juries, in theory and practice. Because England witnessed both a series of foreign migrations and a series of geo-political crises in the years between 1674 and 1750, the article charts patterns of foreign prosecutions across the period in order to place them in their proper historical context. The article concludes that the protections offered by English law to foreign residents were real and significant and that these protections were especially important at points of geo-political stress.

The acceptance of mapmaking in medieval and early modern Europe was neither a uniform nor a linear process. Comparing two neighbouring regions in the Low Countries, we explain the varying appetite for maps and mapmaking first by unravelling how people dealt with space before the introduction of modern mapmaking and, second, by identifying the actors that actively promoted its adoption. In regions where local elites had already been considering space as a commodity with a preference for clear-cut, geometric forms before the introduction of mapmaking, the latter was enthusiastically accepted and rapidly became instrumental in propagating this ‘modern’ concept of space. Other regions did not develop this appetite for mapmaking and continued to prefer different and more negotiable representations of space.

Rural law courts are sometimes believed to have contributed to juridical fragmentation, which led to coordination failures and, hence, to high transaction costs. We present a case study of the village law court of Mijnsheerenland, and pay particular attention to the question of whether non-residents expected villagers to have a ‘home court’ advantage. Our analysis of default risk premiums demanded by participants in various exchanges does not indicate this was the case. We argue that this was caused by one of the peculiarities of the juridical system of Holland, which was fragmented but nevertheless uniform because of the dominance of public courts under central control of the ruler.

When large parts of the south-western Netherlands flooded in the fifteenth and sixteenth centuries the main cause was insufficient maintenance of the sea defences. The subsequent re-embankment of the polders resulted in changes to both soil conditions and property relations in the region. The Church and the local peasants lost land and members of the urban bourgeoisie became the most important landowners. Unlike their risk-averse predecessors, these capitalist landlords were prepared to invest in drainage. They were also able to organise state support for those polders that were at risk of flooding. Tenant and yeomen farmers had an equally important role as they maintained the fertility of the soil and were prepared to invest in the upkeep of the flood defences.

This article addresses the question of the effectiveness of court litigation over private contracts. Through a case study of fourteenth-century Caldes de Malavella, in northeastern Catalonia, it provides an instructive example of contract registration and enforcement. A large peasant clientele made use of the institutional framework provided by a compact jurisdictional estate. We also explore the ways in which the court system within this barony was affected by the demands of external jurisdictions. The article concludes that the whole system was efficient in prosecuting breach of contract, in serving broader mercantile strategies, and even in softening tensions among parties.

This study of St Scholastica's Retreat offers an opportunity to examine a charity for the middle classes and the horizontal relationship between middle-class benefactors and recipients that did not appear to stigmatise middle-class recipients of charity. Middle-class inhabitants accessed a mix of resources, from personal resources, kinship relationships, friendship and charitable networks, as part of a ‘mixed economy of welfare’ so often discussed by welfare historians in Britain. Their ‘choices’ were limited but their personal networks enabled them to maintain their middle-class identities. This research not also demonstrates the flexibility of almshouse accommodation but also the meanings inherent in the domestic space that emphasised middle-class respectability.

This paper analyses the interactions amongst family, household and extended kin through an examination of two ‘circulations’ of children within rural Irish communities during the first half of the twentieth century: (1) the daily journey from home to school; (2) going to live with relatives other than parents. Drawing on life-history narratives, the article develops a new perspective on the stem-family system in Ireland by showing how ‘incomplete’ family households formed integral parts of local kinship circles and were deeply engaged in the everyday lives of ‘complete’ family households, including the promotion of extended family survival and social mobility.

This article studies the role performed by local jurisdictional courts in private credit relations in medieval Catalonia. These courts and their officers were subject to the control of local feudal lords. The courts acted as a guarantor of credit contracts agreed before them in the form of ‘court obligations’, and also carried out procedures related to the enforcement of outstanding debts: prorogations; seizures and auction of goods; and imprisonment. The study focuses on the plain of the Lower Ter, on the northeast Catalan coast. It concludes that although the jurisdictional framework provided by the courts involved a number of different great lords, including the king himself, the juridical mechanisms and collaboration between different courts functioned well enough to sustain a dynamic, complex and widespread credit system.

From the latter half of the nineteenth century, mixed farming in the Alpine regions of Switzerland underwent a gradual process of specialisation. Cereal crops were phased out in favour of feed crops, livestock, viticulture and fruit farming. This article analyses the way in which the land market was affected by this increasingly specialised primary sector and asks whether this market became more efficient as a result of reduced transaction costs. Surveys have shown that the land market remained bound by the inertia inherent in the nature of landed property in the Alpine area. The connection between agricultural diversification and the land market appears to have been only partial and this suggests that the modernisation of farming did not so much alter the main balance of the market itself, as boost the circulation of plots more directly associated with the process of specialisation.

In fifteenth- and sixteenth-century Poland, village courts facilitated the registration of a variety of private transactions among peasants. This article uses the surviving court books of this period to explore the courts' development and functions, and to analyse the numerous peasant credit contracts found in their records. The aim of the article is to show that in late medieval and early modern Poland the village courts provided a well-established system for registering peasant transactions, and that this played an important role in the development of credit and land markets.
