  • Scholars have generally assumed that authoritarianism and rule of law are mutually incompatible. Convinced that free markets and rule of law must tip authoritarian societies in a liberal direction, nearly all studies of law and contemporary politics have neglected that improbable coupling: authoritarian rule of law. Through a focus on Singapore, this book presents an analysis of authoritarian legalism. It shows how prosperity, public discourse, and a rigorous observance of legal procedure have enabled a reconfigured rule of law such that liberal form encases illiberal content. Institutions and process at the bedrock of rule of law and liberal democracy become tools to constrain dissent while augmenting discretionary political power - even as the national and international legitimacy of the state is secured. This book offers a valuable and original contribution to understanding the complexities of law, language and legitimacy in our time.

  • For decades, scholars and politicians have vigorously debated whether Confucianism is compatible with democracy, yet little is known about how it affects the process of democratization in East Asia. In this book, Doh Chull Shin examines the prevalence of core Confucian legacies and their impacts on civic and political orientations in six Confucian countries: China, Japan, South Korea, Singapore, Taiwan, and Vietnam. Analyses of the Asian Barometer and World Values surveys reveal that popular attachment to Confucian legacies has mixed results on democratic demand. While Confucian political legacies encourage demand for a non-liberal democratic government that prioritizes the economic welfare of the community over the freedom of individual citizens, its social legacies promote interpersonal trust and tolerance, which are critical components of democratic civic life. Thus, the author argues that citizens of historically Confucian Asia have an opportunity to combine the best of Confucian ideals and democratic principles in a novel, particularly East Asian brand of democracy.

Collective Killings in Rural China during the Cultural Revolution

  • The violence of Mao's China is well known, but its extreme form is not. In 1967 and 1968, during the Cultural Revolution, collective killings were widespread in rural China in the form of public execution. Victims included women, children, and the elderly. This book is the first to systematically document and analyze these atrocities, drawing data from local archives, government documents, and interviews with survivors in two southern provinces. This book extracts from the Chinese case lessons that challenge the prevailing models of genocide and mass killings and contributes to the historiography of the Cultural Revolution, in which scholarship has mainly focused on events in urban areas.

  • As countries in Asia try to create unified polities, many face challenges from minority groups within their own borders seeking independence. This volume brings together international experts on countries in all regions of Asia to debate how differently they have responded to this problem. Why have some Asian countries, for example, clamped down on their national minorities in favour of homogeneity, whereas others have been willing to accommodate statehood or at least some form of political autonomy? Together they suggest broad patterns and explanatory factors that are rooted in the domestic arena, including state structure and regime type, as well as historical trajectories. In particular, they find that the paths to independence, as well as the cultural elements that have been selected to define post-colonial identities, have decisively influenced state strategies.

  • Examines the fundamental issue of how citizens get government officials to provide them with the roads, schools, and other public services they need by studying communities in rural China. In authoritarian and transitional systems, formal institutions for holding government officials accountable are often weak. The state often lacks sufficient resources to monitor its officials closely, and citizens are limited in their power to elect officials they believe will perform well and to remove them when they do not. The answer, Lily L. Tsai found, lies in a community's social institutions. Even when formal democratic and bureaucratic institutions of accountability are weak, government officials can still be subject to informal rules and norms created by community solidary groups that have earned high moral standing in the community.
