  • How did women come to be seen as 'at-risk' for HIV? In the early years of the AIDS crisis, scientific and public health experts questioned whether women were likely to contract HIV in significant numbers and rolled out a response that effectively excluded women. Against a linear narrative of scientific discovery and progress, Risk and Resistance shows that it was the work of feminist lawyers and activists who altered the legal and public health response to the AIDS epidemic. Feminist AIDS activists and their allies took to the streets, legislatures, administrative agencies, and courts to demand the recognition of women in the HIV response. Risk and Resistance recovers a key story in feminist legal history – one of strategy, struggle, and competing feminist visions for a just and healthy society.   • Outgunned No More comprehensively addresses the changed legal landscape under which governments and private citizens can sue the gun industry for contributing to and sustaining the gun violence epidemic in the US and Mexico. The book canvasses federal and state efforts to regulate firearms through gun control measures, arguing that these regulatory measures have proven ineffective to stem gun violence. Instead, recourse to robust consumer protection and mass tort litigation provides the best avenue for holding the firearms industry accountable. Chapters highlight three important interventions: the 1998 Tobacco Master Settlement Agreement, the Connecticut Sandy Hook Elementary School litigation, and the recent enactment of consumer protection and public nuisance firearms statutes in nine states. These innovative statutes have created an avenue for litigation that overcomes the firearm industry's historical immunity. Outgunned No More concludes that a firearms mass tort litigation, modeled after the resolution of claims in the tobacco industry, is the best path forward.

  • This Element explores how Congress has designed laws reliant on an assumption of presidential self-restraint, an expectation that presidents would respect statutory goals by declining to use their formal powers in ways that were legally permissible but contrary to stated congressional intent. Examining several laws addressing political appointments since the 1970s – statutes involving the FBI director, Office of Personnel Management director, chairman of the Joint Chiefs of Staff, director of national intelligence, Federal Emergency Management Agency administrator, inspectors general, Senior Executive Service, vacancies, Social Security Administration commissioner, and Consumer Financial Protection Bureau director – the authors demonstrate lawmakers' reliance on presidential self-restraint in statutory design and identify a variety of institutional tools used to signal those expectations. Furthermore, the authors identify a developmental dilemma: the combined rise of polarization, presidentialism, and constitutional formalism threatens to leave Congress more dependent on presidential self-restraint, even as that norm's reliability is increasingly questionable.

  • Critics of populism and advocates of elitist democracy often place greater confidence in political elites than in the general public. However, this trust may be misplaced. In five experiments with local politicians, state legislators, and members of the public, the author finds a similar willingness across all groups to entrench their party's power when given the opportunity – a self-serving majoritarianism that transcends partisan lines. This tendency is strongest among committed ideologues, politicians running in highly competitive districts, and those who perceive opponents as especially threatening. Local elected officials even appear more focused on securing their party's next presidential victory than on opposing bans against their political rivals. These findings challenge the conventional mass/elite dichotomy, revealing little differences in undemocratic attitudes. Safeguarding democracy likely requires shifting focus from those individual attitudes to strengthening institutional restraints against majority abuses.   • As climate change intensifies, conflict-prone tropical regions face heightened vulnerabilities, yet little is known about how climate adaptation and food security efforts affect conflict dynamics. Using South Sudan – a country highly susceptible to climate stress and conflict – as a test case, this Element analyzes how international nongovernmental organizations' (INGO) climate adaptation interventions influence civil war and local social conflicts. It develops a theoretical framework linking climate adaptation to conflict, positing both positive and negative externalities. Drawing on original high-resolution data on INGO-driven adaptation and food security efforts, alongside climate, conflict, and development data, findings are substantiated with interviews from policy workers in South Sudan. The results indicate that while adaptation generally does not reduce conflict, interventions that promote preparedness and are implemented during periods of high climate stress can mitigate social conflicts between militias, pastoralists, and farmers. These insights provide guidance for designing climate adaptation strategies that reduce conflict risks.

  • This is a study of the dynamics of partisan polarization in the United States. It has three objectives: (1) to identify and explain why some Republicans and Democrats – but not others – have polarized, particularly over the last twenty years; (2) to demonstrate that they have done so not on this or that issue but systematically, programmatically – domain versus issue sorting; and (3) to bring into the open profound asymmetries in polarization between the two parties, not least that Republicans polarized early and thoroughly on issues of race, while Democrats in the largest number stayed neutral or even conservative until only recently. Emerging from the reasoning and results is a revised theory of party identification that specifies the conditions under which ordinary Republicans and Democrats can become ideological partisans – real-life conservatives and liberals in their behavior – in the choices they make on candidates, policies, and parties.
