Before the 20th century, most rules of international law were in the form of customary international law. Since then, the increased complexity of international relations and rapid international development have led to a substantial growth in the number and diversity of treaties. Article 38(1)(a) of the Statute of the International Court of Justice (‘ICJ Statute’) recognises treaties as a (material) source of international law by referring to ‘international conventions, whether general or particular, establishing rules expressly recognized by the contesting states’. Treaties now regulate trade, communications, environmental protection, military cooperation and defence, and human rights, to name but a few of the myriad topics. International environmental law, for example, is almost entirely governed by treaties, and international trade, investment and communications ‘are unimaginable without treaties’. The main rules in the law of treaties are contained in the 1969 Vienna Convention on the Law of Treaties (‘VCLT’), which governs treaty relations between states and is the focus of this chapter.

Ostensibly the most privileged of the diarists considered in this book, Violet Dickinson had one of the most difficult lives. She had a fraught, distant relationship with her mother, her often-absent art dealer father played an ambivalent role in her life, and for many years the family had no permanent home. As a young woman, underneath the superficial, nouveau-riche assurance, Dickinson was deeply uncertain of her direction in life. She fled her high-society milieu for the safety of an East Kent smallholding, in company with her younger brother Cedric. Rural self-sufficiency and craftwork appears to have provided a measure of stability, fulfilment and peace of mind for Dickinson. However, her successive moves to smallholdings in Sussex and then Somerset were indicative of continuing emotional tensions (some linked to her closet lesbianism), and her efforts to construct a new ‘family’ about her in these secluded rural settings were only partially successful.

Although the Vienna Convention on the Law of Treaties devotes nine articles to invalidity of treaties, cases rarely arise in practice. Circumstances covered by the Convention include violation of internal law, error, fraud, corruption, coercion and violation of a peremptory norm of international law (jus cogens). Article 46 of the Convention covers the first of these, providing that a state may not invoke the fact that its consent to be bound has been expressed in violation of its internal law unless that violation was manifest and concerned a rule of fundamental importance. The chapter examines the meaning of the key terms of this provision and possible cases in which this might arise. In the context of coercion, the chapter looks at treaties which might be concluded by the threat or use of force, peace treaties and unequal treaties. The scope of peremptory norms (jus cogens) is also discussed, together with the consequences of invalidity.

This concluding chapter draws together some threads of the book, byfacing some objections about negation and more generally about theconceptions of truth, falsity, validity, invalidity, and theirinterrelations. The main question – why are there paradoxes?– is asked three last times.

Since antiquity, arbitration has been well known in the Italian peninsula.1 Basic rules of arbitration are today spelled out in the Italian civil procedure code (hereinafter CCP). The code was enacted in 1940, but has, since then, undergone radical changes, including a comprehensive reform in 2006.2 Despite the fact that current rules are largely in line with those of other countries and with international legal standards, Italy is generally perceived, by insiders and outsiders alike, as a nonfriendly arbitration country.3
