Contrary to predominant European constitutional narratives assuming the alignment between the European Union legal framework and national constitutional orders, this Article points at the current misalignment between the prevailingly purposive European Union institutional order and the prevailingly open character of the Democratic and Social Constitutional State. The evolutionary trajectories leading to the current status quo are examined by distinguishing an age of openness, in which the institutional frameworks of both the European Economic Communities and the Democratic and Social Constitutional State lent themselves to a range of competing legislative renderings, from an age of purposiveness opened by the Treaty of Maastricht, in which a neoliberal policy agenda was gradually entrenched in the Treaties, with the result of undermining the adaptability and inclusiveness of European public law structures. To counter this development, this Article identifies in a drastic deconstitutionalization of the Economic and Monetary Union the key move to favor the realignment of the European Union and the Democratic and Social Constitutional State.

In The Architectonic of Reason, Lea Ypi provides an illuminating and innovative interpretation of the Architectonic in the first Critique. Ypi argues that Kant’s project of uniting practical and theoretical uses of reason in a critical metaphysics ultimately fails because practical reason does not have its own domain in which to legislate. This article challenges Ypi’s objection to practical reason’s lack of a domain in the first Critique. Its main contention is that reason’s need for unity in legislation may be satisfied by a belief in God as a necessary practical presupposition rather than a dogmatic metaphysical reality.

Given the central place organisms occupy in Kant’s account of living nature, it might seem unlikely that his claims about biological wholes could be relevant to current debates over the problem of biological individuality. These debates acknowledge the multiple realizability of biological individuality in vastly different forms, including parts of organisms and complex groups of organisms at various levels of the biological hierarchy, sparking much controversy in attempts to characterize a biological individual. I argue that, far from being irrelevant to this controversy, Kant’s account provides a key insight for addressing the multiple realizability problem. I show how the reciprocal causality between a self-organizing whole and its parts, which Kant thinks characterizes a natural end, is not limited to organisms but is exhibited by numerous types of beings in living nature. Self-organizing wholes of various kinds, and at various biological levels, may count as biological individuals, depending on the degree to which their functionally integrated parts are represented by reflective judgement as a natural end.

This article examines Kant’s treatment of the design argument for the existence of God, or physicotheology. It criticizes the interpretation that, for Kant, the assumption of intelligent design satisfies an internal demand of inquiry. It argues that Kant’s positive appraisal of physicotheology is instead better understood in terms of its polemical utility for rebutting objections to practical belief in God upon which Kant’s ethicotheological argument rests, and thus as an instrument in the transition from theoretical to practical philosophy. Kantian physicotheology plays this role (a) by criticizing alternative speculative accounts of the ground of nature, and (b) by analogizing from the structure of finite rational agency in order to represent more clearly the action of an ideal agent.

This article demonstrates the relevance of Kant to the interpretation of contemporary art. The defining properties of contemporary art are the impossibility of definition in material, formal or stylistic terms, and the central role that concepts play in the interpretation of a work. Danto and Osborne suggest how concepts might be applied but they do not develop their proposals. Kant’s theory of judgement can provide a fuller account on the basis of the notions of purposiveness and play. The way in which these notions explain the application of concepts to the world, I argue, provides a model of how concepts can be combined to form an interpretation of a work of contemporary art. A detailed example is given.

Kant interpreters have contrasting views on what Kant takes to be the basis for human dignity. Several commentators have argued that human dignity can be traced back to some feature of human beings. Others contend that humans in themselves lack dignity, but dignity can be attributed to them because the moral law demands respect for humanity. I argue, alternatively, that human dignity in Kant’s system can be seen to be grounded in the reciprocal relationship between the dignity of the moral law and the dignity inherent in the human constitution. The latter includes the dignity of personhood, construed as rational inner purposiveness, and the dignity of giving oneself the law and striving to follow it.

This paper shows that Kant’s investigation into mathematical purposiveness was central to the development of his understanding of synthetic a priori knowledge. Specifically, it provides a clear historical explanation as to why Kant points to mathematics as an exemplary case of the synthetic a priori, argues that his early analysis of mathematical purposiveness provides a clue to the metaphysical context and motives from which his understanding of synthetic a-priori knowledge emerged, and provides an analysis of the underlying structure of mathematical purposiveness itself, which can be described as unintentional, but also as objective and unlimited.
