Psychologically based accounts of personal identity over time start from a view of persons as experiencing subjects. Derek Parfit argues that if such an account is to justify the importance we attach to identity it will need to provide a deep unity of consciousness throughout the life of a person, and no such unity is possible. In response, many philosophers have switched to a view of persons as essentially agents, arguing that the importance of identity depends upon agential unity rather than unity of consciousness. While this shift contributes significantly to the discussion, it does not offer a fully satisfying alternative. Unity of consciousness still seems required if identity is to be as important as we think it is. Views of identity based on agential unity do, however, point to a new understanding of unity of consciousness which meets Parfit's challenge, yielding an integrated view of identity which sees persons as both subjects and agents.

When Benjamin Franklin suggested that man is by nature a tool-making animal, he summed up what was for his fellow Americans the common sense of the matter. It is not, then, surprising that, when Britain's colonists in North America broke with the mother country over the issue of an unrepresentative parliament's right to tax and govern the colonies, they defended their right to the property they owned on the ground that it was in a most thorough-going sense an extension of themselves: the fruits of their own labor. This understanding they learned from John Locke, who based the argument of his Two Treatises of Government on the unorthodox account of providence and of man's place within the natural world that Sir Francis Bacon had been the first to articulate. All of this helps explain why the framers of the American constitution included within it a clause giving sanction to property in ideas of practical use.

Robert Nozick worked in a Lockean tradition of political philosophy, a tradition with deep resonance in the American political culture. This paper attempts to explore the formative moments of that culture and at the same time to clarify the role of Lockean philosophy in the American Revolution. One of the currently dominant approaches to the revolution emphasizes the colonists' commitments to their rights, but identifies the relevant rights as “the rights of Englishmen,” not natural rights in the Lockean mode. This approach misses, however, the way the Americans construed their positive or constitutional rights in the light of a Lockean background theory. In a word, the Americans recreated an amalgam of traditional constitutional principles and Lockean philosophy, an amalgam that nearly guaranteed that they and the British would speak past each other. The ambiguities and uncertainties of the British constitution as extended to the colonies provided an incentive to the Americans (but not the British) to look to Locke as a guide to their rights, thereby helping win a place for Lockean theory in American political thinking.

According to the Constitution View of persons, a human person is wholly constituted by (but not identical to) a human organism. This view does justice both to our similarities to other animals and to our uniqueness. As a proponent of the Constitution View, I defend the thesis that the coming-into-existence of a human person is not simply a matter of the coming-into-existence of an organism, even if that organism ultimately comes to constitute a person. Marshalling some support from developmental psychology, I give a broadly materialistic account of the coming-into-existence of a human person. I argue for the metaphysical superiority of the Constitution View to Biological Animalism, Thomistic Animalism, and other forms of Substance Dualism. I conclude by discussing the single implication of the Constitution View for thinking about abortion.

Critics of Robert Nozick's libertarian political theory often allege that the theory in general and its account of property rights in particular lack sufficient foundations. A key difficulty is thought to lie in his account of how portions of the world which no one yet owns can justly come to be initially acquired. But the difficulty is illusory, because (contrary to what both Nozick and his critics assume) the concept of justice does not meaningfully apply to initial acquisition in the first place. Moreover, the principle of self-ownership provides a solid foundation for Nozick's libertarianism, and when seen in the light of that principle and its full implications, the standard purported examples of injustices in acquisition are revealed to be nothing of the kind.

The constitution view of persons, according to which a person is constituted by a body, has both interesting extensions as well as limitations. Here I shall leave discussion of the limitations for another time and concentrate on several extensions. The chief extensions of the constitution view that I shall explore here concern the implications of combining it with ontological pluralism, and applications of it (or something like it) to thinking about various forms of social agency.

To the extent that dualism is even taken to be a serious option in contemporary discussions of personal identity and the philosophy of mind, it is almost exclusively either Cartesian dualism or property dualism that is considered. The more traditional dualism defended by Aristotelians and Thomists, what I call hylemorphic dualism, has only received scattered attention. In this essay I set out the main lines of the hylemorphic dualist position, with particular reference to personal identity. First I argue that overemphasis of the problem of consciousness has had an unhealthy effect on recent debate, claiming instead that we should emphasize the concept of form. Then I bring in the concept of identity by means of the notion of substantial form. I continue by analyzing the relation between form and matter, defending the traditional theses of prime matter and of the unicity of substantial form. I then argue for the immateriality of the substantial form of the human person, viz. the soul, from an account of the human intellect. From this follows the soul's essential independence of matter. Finally, although the soul is the immaterial bearer of personal identity, that identity is still the identity of an essentially embodied being. I explain how these ideas are to be reconciled.

Do property entitlements define the moral environment in which rights to well-being are defined, or do rights to well-being define the moral environment in which property entitlements are defined? Robert Nozick argued for the former alternative and he denied that any serious attempt had been made to state the latter alternative (what he called “the ‘reverse’ theory”). I actually think John Locke's approach to property can be seen as an instance of the “reverse” theory. And Nozick's can too, inasmuch as it shares a number of features with the Lockean approach. But my paper is not intended as a criticism of Nozick; on the contrary, it acknowledges the integrity and the importance of his insistence that welfare, property, and justice be integrated into a single theory with clearly established priorities.

Natural rights theorists such as John Locke and Robert Nozick provide arguments for limited government that are grounded on the individual's possession of natural rights to life, liberty, and property. Resting on natural rights, such arguments can be no more persuasive than the underlying arguments for the existence of such rights, which are notoriously weak. In this article, John Hasnas offers an alternative conception of natural rights, “empirical natural rights,” that are not beset by the objections typically raised against traditional natural rights. Empirical natural rights are rights that evolve in the state of nature rather than those that individuals are antecedently endowed with in that state. Professor Hasnas argues that empirical natural rights are true natural rights, that is, pre-political rights with natural grounds that can be possessed in the state of nature, and that, when taken together, they form a close approximation of the Lockean rights to life, liberty, and property. He furthers argues that empirical natural rights are normatively well-grounded because respecting them is productive of social peace, which possesses instrumental moral value regardless of one's conception inherent value. Professor Hasnas thus offers his conception of rights as solved problems as an alternative and potentially more secure footing for the traditional natural rights arguments for limited government associated with Locke and Nozick.

Defenders of the thesis of self-ownership generally focus on the “ownership” part of the thesis and say little about the metaphysics of the self that is said to be self-owned. But not all accounts of the self are consistent with robust self-ownership. Philosophical accounts of the self are typically enshrined in theories of personal identity, and the paper examines various such theories with a view to determining their suitability for grounding a metaphysics of the self consistent with self-ownership. As it happens, only one such theory is suitable: the hylemorphic theory of Aristotle and Aquinas. To adopt such a theory, however, is to see that self-ownership may in some respects have implications different from those many of its defenders take it to have.

This essay compares Rawls's and Nozick's theories of justice. Nozick thinks patterned principles of justice are false, and offers a historical alternative. Along the way, Nozick accepts Rawls's claim that the natural distribution of talent is morally arbitrary, but denies that there is any short step from this premise to any conclusion that the natural distribution is unjust. Nozick also agrees with Rawls on the core idea of natural rights liberalism: namely, that we are separate persons. However, Rawls and Nozick interpret that idea in different ways-momentously different ways. The tension between their interpretations is among the forces shaping political philosophy to this day.

Derek Parfit's “reductionist” account of personal identity (including the rejection of anything like a soul) is coupled with the rejection of a commonsensical intuition of essential self-unity, as in his defense of the counter-intuitive claim that “identity does not matter.” His argument for this claim is based on reflection on the possibility of personal fission. To the contrary, Simon Blackburn claims that the “unity reaction” to fission has an absolute grip on practical reasoning. Now David Lewis denied Parfit's claim that reductionism contravenes common sense, so I revisit the debate between Parfit and Lewis, showing why Parfit wins it. Is reductionism about persons then inherently at odds with the unity reaction? Not necessarily; David Velleman presents a reductionist theory according to which fission does not conflict with the unity reaction. Nonetheless, relying on the distinction between person level descriptions of first-person states and the first-person perspective itself, I argue that Velleman's theory does not eliminate fission-based conflict with the unity reaction.

In this essay Loren Lomasky wryly proposes that the views of Rawls and Nozick might not be as radically divergent as is conventionally supposed. To demonstrate this proposition, Lomasky invents “Twin Harvard” counterparts of Rawls and Nozick. The twist is that Twin Rawls turns out to be a leading libertarian theorist while Twin Nozick endorses a regime of sweeping redistribution. In each case the position follows from familiar elements in the theories of their respective, real-world counterparts. Lomasky concludes that Twin Rawls actually makes better use of familiar Rawlsian themes-such as the veil of ignorance, strains of commitment, and the priority of liberty-than does Rawls himself. Moreover, Rawls's own attempts at combating libertarianism are seen to be weak, sometimes embarrassingly so. Libertarianism is a specter that he devoutly wishes to exorcize, but cannot. Conversely, the rejection of libertarianism by Twin Nozick (and Nozick?) is striking but shallow.

In this essay, I propose a standard of practical rationality and a grounding for the standard that rests on the idea of autonomous agency. This grounding is intended to explain the “normativity” of the standard. The basic idea is this: To be autonomous is to be self-governing. To be rational is at least in part to be self-governing; it is to do well in governing oneself. I argue that a person's values are aspects of her identity—of her “self-esteem identity”—in a way that most of her ends are not, and that it therefore is plausible to view action governed by one's values as self-governed. This is also plausible on independent grounds. Given this, I say, rational agents comply with a standard—the “values standard”—that requires them to serve their values, and to seek what they need in order to continue to be able to serve their values.

Diggins observes in this essay that, while Nozick and Hook shared a passion for freedom and for understanding liberty in all its complexities, the two philosophers, one a libertarian and the other a democratic socialist, occupied different worlds when it came to how they viewed property and power. Nozick believed that freedom and justice depended upon a minimal state that would be severely restricted in its exercise of power. Sidney Hook never renounced his conviction, born of his early attraction to Marxism, that truly dangerous power is wielded not principally by government but by private individuals of great material wealth: by industrialists. Diggins examines the divergent views of these two seminal thinkers on such issues as human rights, private property, democracy, and judicial review. The differences are profound, yet they shared a common interest in the life of the mind and in exploring such hoary philosophical topics as free will versus determinism and the grounding of moral values.

What does a person really want when he asks for an apology? Why do people so often find it difficult to give an apology? Repentance is relevant to personal identity because the unrepentant soul has his own theory of personal identity. The unrepentant person believes he is his preference, and that he is entitled to the behavior that flows from those preferences. This fact can explain why people are so often reluctant to admit wrongdoing, why people place so much importance upon receiving an apology and other behaviors that would be otherwise inexplicable. The unrepentant person uses something akin to a naive economic theory of human behavior. The naive version of homo economicus, or economic man, can never truly be sorry for anything, and as a result, will be almost impossible to live with. A person who identifies himself too closely with his preferences will bring misery to himself and those around him.

At 30 years' distance, it is safe to say that Nozick's Anarchy, State and Utopia has achieved the status of a classic. It is not only the central text for all contemporary academic discussions of libertarianism; with Rawls's A Theory of Justice, it arguably frames the landscape of academic political philosophy in second half of 20th century. Many factors, obviously account for the prominence of the book. This paper considers one: the book's use of rhetoric to charm and disarm its readers, simultaneously establishing Nozick's credibility with readers, turning them on his ideological opponents, and helping his argument over some of its more serious substantive difficulties.

The so-called “problem of personal identity” can be viewed as either a metaphysical or an epistemological issue. Metaphysicians want to know what it is for one individual to be the same person as another. Epistemologists want to know how to decide if an individual is the same person as someone else. These two problems converge around evidence from mediumship and apparent reincarnation cases, suggesting personal survival of bodily death and dissolution. These cases make us wonder how it might be possible for a person to survive death and either temporarily or permanently animate another body. And they make us wonder how we could decide if such postmortem survival has actually occurred. In this essay I argue, first, that metaphysical worries about postmortem survival are less important than many have supposed. Next, I'll consider briefly why cases suggesting postmortem survival can be so intriguing and compelling, and I'll survey our principal explanatory options and challenges. Then, I'll consider why we need to be circumspect in our appraisal of evidence for mind-body correlations. And finally, I'll try to draw a few tentative and provocative conclusions.

The four kinds of explanation identified by Aquinas at the beginning of his commentary on Aristotle's Ethics are deployed to show that the identity of the human person is sui generis and mysterious, even though each of its elements is more or less readily accessible to our understanding. The essay attends particularly to the explorations by Aquinas and, with different techniques, by Shakespeare of the experience and understanding of (a) one's lasting presence to oneself as one and the same bodily and mental self, and (b) one's self-shaping by one's free choices, especially of commitments. Shakespeare further explores these, quite deliberately, through displays of mistaken identity and humiliating deflations of the personas one constructs for life in society.

In chapter four of Anarchy, State, and Utopia, Robert Nozick raised interesting questions about whether or not it is ever morally acceptable to act against what are agreed to be an individual's natural moral rights. The pursuit of these questions opens up issues concerning the specific content of these individual rights. This essay explores Nozick's questions by posing examples and using our considered responses to them to specify the shape of individual rights. The exploration provisionally concludes that a conception of individual moral rights quite different from Nozick's looks attractive and merits further development.
