3 This is mainly because the settlement of U.S. nationals’ claims against foreign governments by the U.S. Government is discretionary. Citizens have no right to have their claims settled, and thus no right to review of how a settlement fund is distributed. Presumably, however, this would not bar judicial review of a decision that was violative of a claimant’s constitutional rights.
