1. It is important to note that Rule 61 is not a trial in absentia, which is not provided for in the Tribunal's Statute, under which every accused has the right to attend the trial. Moreover, Rule 61 does not allow for a determination of the accused's guilt; it thereby follows that the Trial Chamber cannot pronounce any sentence.
