In those cases, the arbitrators were required to determine, under Article 4.11 of the SCM Agreement, “whether the countermeasures [proposed by the complaining Member] are appropriate”. Those cases are therefore not directly relevant for the purposes of determining the Arbitrator's mandate in relation to a determination of “equivalence” under Articles 22.6 and 22.7. Nonetheless, we do not exclude that some aspects of those decisions may be relevant to our determinations.
