Note from the Editors: The November 25, 1998 decision (later vacated) of the House of Lords was published in 37 I.L.M. 1302 (1998). That decision overturned the present decision of the Queen's Bench Divisional Court. A new 7-member panel of the House of Lords is expected to release a decision in early February 1999. ILM expects to publish that decision once it is available.
