In this article I am going to propose a modification in the theory of pure restitution, in the hope that such modification will eliminate at least some sources of resistance to the theory, while preserving the theory's distinct place among the philosophical approaches to the institution of legal punishment.

The first part of this essay was read at a Symposium on “Hegel and Schelling” at the Conference of the Canadian Philosophical Association at the University of Manitoba, Winnipeg, Manitoba in June 1985. The text was then discussed as a whole by George di Giovanni and Michael Vater. Since their commentaries are here published with it, I have allowed the mistakes which they identified to remain clearly visible. The few revisions of substance that I have made (in order to keep the reader from thinking that I still hold the positions originally maintained) are clearly indicated in the footnotes; and the justification of my final position is given in this Postscript.

Le nominalisme est « le refus d'admettre toute entité autre qu'indivi-duelle » (Goodman, 1977, 26). II doit, pour justifier la simplicité de son ontologie, proposer une théorie de laconnaissance et une théorie sémantique qui ne présupposent ni l'une ni l'autre l'existence réelle des univer-saux. Certaines des voies qui s'ouvrent à cette entreprise délicate ont été systématiquement explorées vers la fin du Moyen Age et il y a tout à parier que, malgré les ruptures épistémologiques, les révolutions scientifiques et autres changements d'epistémè, les nominalistes contemporains pourraient encore profiter de quelque façon de l'immense travail théorique accompli par leurs prédécesseurs médiévaux. C'est dans cet esprit que je voudrais procéder à une reconstruction sommaire de la théorie sémantique avancée au début du quatorzième siècle par le Fran-ciscain Guillaume d'Occam (12857?–1349). Je ne m'engagerai pas dans une comparaison détaillée entre Occam et les auteurs contemporains, mais j'essaierai de présenter sans en trahir l'esprit la sémantique occa-miste de manière à en faire apparaître la pertinence pour les débats actuels. II serait possible, me semble-t-il, d'aller encore plus loin dans cette voie en mettant à profit les techniques formelles récentes pour axiomatiser la théorie d'Occam. Pour l'instant cependant, je me limiterai à une présentation plutôt informelle.

Piaget's work represents, f?om his own point of view, not only a study of intelligence, but a remedy for philosophical studies of the same subject matter. Philosophy in general, according to Piaget, “does not give us knowledge, as it lacks methods of verification”, that is, it does not give knowledge of anything except the personality of the philosopher “sim-ply meditating in his study by the light of his own reason”. Philosophical reflection can serve a heuristic function, but cannot yield objective knowledge, of truth. Piaget succinctly states this crucial methodologicalposition as follows:

Although speculative reflection is a fertile and even necessary heuristic introduction to all inquiry, it can only lead to the elaboration of hypotheses, as sweeping as you like, to be sure, but as long as one does not seek verification by a group of facts established experimentally or by a deduction conforming to an exact algorithm (as in logic), the criterion of truth can only remain subjective, in the manner of an intuitive satisfaction, of “self-evidence,” etc.

It is commonplace that negative duties are more stringent than positive duties: for example that it is harder to justify killing than letting die. It is almost equally commonplace that this distinction requires defence, in particular against those who regard it as a mere apology for the privileges of the wealthy and secure.

G. A. Cohen in “More on Exploitation and the Labour Theory of Value” defends the thesis that the Marxist charge of exploitation against the capitalist cannot be supported by way of the labour theory of value. He suggests an alternative, non-labour-theoretic argument for this charge which depends on premises he takes to be more obvious than the labour theory of value. Cohen claims that his argument (which he calls the “Plain Argument”) is the only way a Marxist couldjustify attributions of “exploitation” to the capitalist, if any such justification is possible. In this paper, I will argue that, given Cohen's objections to the labour-theoretic argument, his “Plain Argument” itself retains too great a similarity to that argument. A new interpretation of the basis of the charge of exploitation is offered which requires neither the labour theory nor that which is dubious in Cohen's formulation.

La philosophie morale, pas moins que les autres branches de la philosophie, est caractérisée par des contradictions et des dichotomies (par exemple, le déterminisme versus la liberté, le naturalisme versus l'antinaturalisme, l'émotion versus la raison) qui aboutissent à des discussions sans fin. On garde l'impression que l'expérience morale doit être extrêmement individualisée; sans cela, comment des philosophes, également, sinon exceptionnellement, doués intellectuellement, en arrivent-ils à des conclusions aussi diverses quand ils réfléchissent à la question? Et le problème est plus qu'un problème intellectuel. La valeur de l'existence humaine et l'existence humaine elle-même dépendent de valeurs morales et d'impératifs selon lesquels l'homme dirige sa vie. Comprendre de façon cohérente et réaliste la moralité constitue un besoin perpétuellement urgent que la philosophie jusqu'à maintenant, du moins, n'a pu satisfaire.

Dans son article de 1915 sur l'inconscient, Freud pose la question suivante: « Nous disions qu'il y avait des représentations conscientes et des représentations inconscientes; mais y a-t-il aussi des motions pulsion-nelles, des sentiments, des sensations inconscients, ou bien, dans leur cas, de telles alliances de mots sont-elles dénuées de sens?»

Foundations of Illocutionary Logic (FIL) de John Searle et Daniel Vanderveken constitue, à ma connaissance, la première suggestion sérieuse d'un cadre formel destiné à l'élaboration d'une logique de l'illocutoire. Les phénomènes illocutoires sont en effet d'une telle com-plexité que, souvent, les schèmes explicatifs proposés n'ont qu'une valeur très locale et ne constituent une explication que pour quelques exemples bien précis, ceux qui justement ont servi de base empirique sur laquelle ces schèmes se sont élaborés. La prévention de FIL est tout autre. On ne saurait en aucun cas faire un reproche de provincialisme aux auteurs dont le but explicite est d'élaborer un véritable cadre théorique général à l'intérieur duquel tous les phénomènes illocutoires pourront trouver une explication.

Il y a un certain nombre d'années que je lis quotidiennement des articles ou des ouvrages concernant l'histoire des théories linguistiques. J'ai rarement éprouvé autant de plaisir qu'à la lecture du livre de Marc Dominicy. Je crois qu'il y a à cela une raison tres claire: c'est la façon de travailler de l'auteur. Pour lui, d'une part les théories formulées dans le passé sont descriptibles dans une langue moderne qui les rend comparables (voir ma note 12) entre elles et avec les theories plus modernes (10), d'autre part la pratique historiographique est cumulative. Le second point est sans doute dans son esprit une conséquence du premier, ou du moins il est la conséquence d'un axiome très fort assurant l'existence d'un principe de démarcation entre la science et la non-science (ibid.). Je pense qu'on peutfaire l'économie du principe de démarcation, si on part du principe que l'historiographie doit être cumulative. Cela suppose en effet que l'historien discute des représentations de prédécesseurs, mais plus encore que les leurs comme les siennes soient discutables, et par conséquent qu'elles soient formulables dans un Iangage qui les rende comparables. Dans le livre de l'auteur cela se traduit doublement par: a) une bibliographic importante et l'attribution assez générale, dans le cours du texte, des thèses avancées à ceux qui les ont émises; b) une représentation formalisée de la théorie qu'il décrit. Il y a là une grande rigueur autant méthodologique que déontologique.

What is the difference between a reading of a play and a performance of it? In both, the same text is uttered. Both may occur on stage. In both different people may recite the lines of different characters. But unlike a mere reading, in a performance of a play what happens on stage conforms to the text being pronounced.

In the longrunning war between the friends of knowledge and their sceptical enemies the moral front has always been one of the busiest. Here the sceptic assails us in the guise of the cunning and resourceful amoralist who disavows all ethical constraints. Some philosophers, seeing no prospect of defeating the amoralist by rational methods, have fallen back on a policy of containment by means of social and political sanctions. But others of a more truculent frame of mind have continued to seek a decisive argumentative victory.

In an article which appeared in The Philosophical Review Karl Ameriks argues in favour of the rather surprising thesis that Husserl, his own statements and a host of commentators and critics notwithstanding, was a realist, i.e., a philosopher who held that “there are physical objects which exist outside consciousness and are not wholly dependent on it” (498). More recently, Harrison Hall, in his contribution to the volume Husserl, Intentionality, and Cognitive Science, has argued that in Husserl's view there is no legitimate philosophical issue between realism and idealism, because philosophy is concerned exclusively with meanings. Both interpretations are careful, documenting each point with texts, and contain several elements that are illuminating. Yet they are fundamentally mistaken as regards their main thesis, as I shall argue in this paper.

Opuscula Aesthetica Nostra is a pioneering publishing effort, blazing a trail which specialists in other philosophical fields should consider following. It purports to represent what is happening in aesthetics throughout English-speaking and French-speaking Canada today, and in consequence it is an intriguing exercise in Canadian bilingualism. It purports also to show, as co-editor Calvin Seerveld says in the Preface, that “aesthetics deserves its own bona fide place in the national market place of ideas”; so the editors have reprinted strong previously published papers, in addition to soliciting new material on the occasion of the Tenth International Congress of Aesthetics held in Montreal in 1984. The result is a satisfying pot-pourri of ideas.

This remarkable reconstruction of Søren Kierkegaard's (SK) work based on a reading of original Danish sources could have been entitled Phenomenology of (Finite) Spirit or, perhaps, Itinerarium Cordis Ad Deum. In ten chapters it attempts to uncover SK's ethico-religious understanding of the humanjourney towards the transcendent God. It is a journey away from speculative absorption in nature and universal history, away from the hubris of poetical self-creation, away even from ethical awareness of the universally human and a kind of Pelagian self-confidence in one's ability to do the good. Thejourney ends with the recognition of one's own powerlessness and nothingness—a recognition that can lead either to prideful despair or to humble faith.

J'aborde, ici, une question que personne, à ma connaissance, n'a soulevée sous cette forme en lisant Aristote et, en même temps, le commentaire d'un passage qui, toujours à ma connaissance, n'a reçu l'attention qu'il mérite chez aucun interprète.

Deux remarques préliminaires s'imposent, afin de préciser mon propos.

Le tome premier du livre de P. Ricoeur contient les deux premiéres parties, consacrées respectivement au cercle entre temporalité et narrativité et a la configuration dans le récit historique. Le tome deux contient la troisième partie consacrée à la configuration dans le récit de fiction. Le dernier tome rassemble les différentes réflexions suscitées par les études antérieures et porte sur la refiguration du temps par le récit. Les deux premières parties du livre constituent une mise en place des difficultés de la phénoménologie du temps et une discussion approfondie des travaux consacres au statut épistémologique de la compréhension narrative et de l'explication par des lois scientifiques en histoire. Sous le terme general de récit deux grands sous-ensembles sont distingués selon que les récits se réfèrent au monde ayant réellement existé comme en histoire ou qu'ils se réfèrent à un monde fictif comme dans le roman ou l'épopée. Cette division oriente les études préparatoires des tomes un et deux, après lesquelles la parenthèse pourra être levée et la question de la référence à la vérité reformulée.

Nuclear War, edited by Fox and Groarke, is one of five recent anthologies containing new essays by philosophers on the subject of nuclear war. The Blake and Pole volumes, containing essays mainly by British philosophers, are distinguished by unrelenting and comprehensive opposition to British and American policy, and by the fame of the contributors, which include Anthony Kenny, Michael Dummett, and Bernard Williams. The Chicago volume contains a number of excellent papers by philosophers and the added bonus of nine papers by established specialists in national security issues; it attempts, with partial success, to cover the full range of strategic nuclear options. The Cohen and Lee and the Fox and Groarke volumes consist largely of papers by strategic outsiders far from the centres of political power; the debate in these volumes is not between the principal versions of nuclear deterrence but between nuclear deterrence in any form and some scheme that transcends the present arrangement of mutually deterring superpowers. Of these last two books, Cohen and Lee contains relatively longer and more detailed essays.
