At one level, the Comstock Act built upon previous legislation. The first federal law against obscene literature was the Tariff Act of 1842, which gave authority to customs officials to seize obscene material. During the Civil War, Congress had passed a law in 1865 against mailing obscene literature. In comparison to these two laws, the Comstock Act was more far-reaching in its scope.
