1 Although defendant also claimed the benefit of 22 U. S. Code § 1351, vesting in the Federal courts exclusive jurisdiction of civil actions against foreign consuls or vice consuls, contending that he held the rank of vice consul, the court stated that letters from the Department of State showed that defendant had never been recognized as an official with consular or diplomatic capacity, and hence ruled that he was not entitled to the exclusive Federal forum.
