Since it was not read in, a decision whether to return the accused was, like the allegedly implied terms, “a matter outside of the Treaty.” 112 S.Ct. at 2196 (emphasis added); see also id. at 2193 (“The Treaty says nothing about the obligations … or the consequences under the Treaty if such an abduction occurs”). Only the treaty as such was before the Court (this is the way “outside” was consistently used in 112 S.Ct. at 2194–96; see also Halberstam, supra note 9, at 737 n.7, 740–41 n.35, emphasizing what the majority “could” have said but actually did not say; Semmelman, supra, at 820).
