Summary

While the precise definition of international terrorism continues to be disputed, many States are actively involved in the repression of terrorism by the use of force. Outside the conduct of hostilities, law enforcement rules and the additional restrictions imposed by human rights law apply in toto. Key case law is discussed, especially in the European Court of Human Rights, such as in the McCann, Finogenov, Cangöz, and Tagayeva cases.
