Summary

Physicians who practice in hospitals and other health care organizations are regulated by medical staff bylaws that are, in turn, governed in part by Joint Commission and other oversight body requirements. Medical Practice Acts and Medical Staff Bylaws require that physicians who are suspected of impairment submit to professional evaluation as a condition of continued practice, and physicians who are suspected of dyscompetence undergo practice reviews. This chapter discusses the writing of reports subsequent to a psychiatric evaluation or review. Evaluating psychiatrists may be retained by the Board of Medicine, a Health Care Organization (HCO), or the respondent physician's attorney. The role of the psychiatrist evaluator in Board of Medicine sexual misconduct cases is usually limited to providing insight into psychological factors that led to the sexual misconduct and for opining on a respondent physician's rehabilitation potential.
