Summary
After a few years of enforcement experience, it can be said that the competition law regime in Hong Kong has been off to a satisfactory start. While it cannot be said that enforcement has been highly active, a sufficient number of cases have been brought to keep the Competition Ordinance (the Ordinance) in public attention. Aside from enforcement action, the Competition Commission (the Commission) has handled a number of applications for a block exemption order and a decision under the exclusions for ‘[a]greements enhancing overall economic efficiency’ and ‘[c]ompliance with legal requirements’ and completed a market study on the auto-fuel retail sector. It has also done an excellent job in its advocacy and outreach to the business community through public seminars and consultations. It has recruited some highly qualified staff locally and overseas and secured for itself a fairly generous litigation and operational budget, despite some initial foot-dragging by the government over the former. It has taken Hong Kong a long time to embark on this journey towards a credible competition law regime.
