To the Kings most excellent Majesty.
The humble petition of John Heath, Attorney of Your Majestys Dutchy of Lancaster
Sheweth
That the office of Clarke of Assizes of Oxfordshire, Berks., etc. became voyd by the death of Mr [George] Cradock in the yeere 1643, and in the power of your petitioners father of right to dispose of, hee then being not only senior but the only judge of assisse of that circuite, who granted the same to your petitioner for his life, and your petitioner, at the summer assisses 1643, was accordingly admitted and sworne Clarke of Assisse of that circuit in open court, and from that time executed the same office, untiU the delivery of Oxford garrison.
Your petitioner haveing ever since that time bin kept out of possession thereof, and now makeing his application to Mr Justice Mallet (designed judge of assisse for that circuite) to be restored to the said office according to his just right, the sayd Mr Justice Mallet seemes unsatisfyed of your petitioners right thereto.
Your petitioner humbly prays Your Majesty will please to signify your pleasure to the right honourable the Lord Chancellor of England that hee speake with Mr Justice Mallet about the same. And that his lordship take care the petitioner bee put into the commissions for this summer circuite to execute the sayd office, if his lordship finde hee hath just right thereto.
