[f. 116v) Wheras within this countie of late yeeres there have ben great neglect aswell in the undersheriffes and their deputies by impannelligne of insufficient juries as by the severall bayliffes of hundreds and other places in warninge such jurors, but by a generall summons by the bayliffes only all the freeholders of the county are usually warned to come to the assizes, who are thereby forsed to their great trouble and charge to attend dureinge the whole assizes albeit in truth they have noe particular imployment there, and those who are impanelled and retorned by the sheriffe for want of particuler summons doe not know what his or their service is untell they be called, to the great greivance of the county; and thereby many yssues are unawares lost, and many causes pro defect[u] jurat doe either remaine untried or are supplyed by tales, for the most parte exceedinge the number of those which appeare upon the principall pannells, soe as in effect tales-men are thereby become the principall tryers in most causes, contrary to the ancient writts and formes of lawe; and because an exacte and perfect booke of the freeholders names and of such as are fitt to serve on juries would be a great helpe and direccion to the sheriff, and for that the sheriffes bookes of late have ben very imperfect, and many men therein mencioned are aged, ympotent, and very unable for the service yet are retorned in the jureyes.
