The ICRC learned with great sorrow of the death of Mr. Marc Blaser, a radio operator in Angola, on 16 December 1985.

Twenty-one years old and single, Marc Blaser went to Angola in October 1985 on his first mission for the ICRC. In the evening of 16 December, while in the neighbourhood of Lobito, he was killed in an armed attack. An inquiry is in progress to determine the exact circumstances of this tragic incident.

Although he had only recently joined the institution, Marc Blaser was highly thought of by all his colleagues for his good nature and his competence. The ICRC is grieved by the loss of this young delegate and has expressed to his parents and friends its profound sympathy.

En general, se acepta que la asistencia humanitaria se ha convertido en un tema importantísimo debido a los recientes acontecimientos, que han incrementado el sufrimiento humano en muchas partes del mundo. Las situaciones que pueden darse son de diversa índole y los casos específicos de Irak, Somalia y ex Yugoslavia no son necesariamente típicos.

Del debate pudieron sacarse algunas conclusiones generales. Todos los participantes opinaban que en el derecho internacional humanitario se reglamentan detailadamente todas las cuestiones básicas relacionadas con la asistencia humanitaria en conflictos armados internacionales. No obstante, es necesario lograr que las normas del derecho internacional humanitario se apliquen por completo y de forma efectiva en todas las situaciones de conflicto armado.

In 1976 the League adopted a new constitution. Four years of study, research and discussion were necessary until the special commission, set up by the Board of Governors in 1973, with the co-operation of National Societies, came up with what is to be the charter of the League for years to come.

En 1919, Bela Kun, le révolutionnaire hongrois qui, pendant quelques mois, fut à la tête de la République soviétique de Hongrie, déclara au délégué du CICR qu'il comprenait pleinement la position et le rôle du Comité international. Cette association privée de citoyens suisses qui, indépendante de tout lien gouvernemental, apportait aide et réconfort aux victimes de la guerre, où qu'elles se trouvent et sans aucune distinction de nationalité, de confession ou d'idéologie, lui parut représenter véritablement le peuple suisse. Pour lui, le CICR, en raison même de son indépendance et parce qu'il s'adressait directement aux gouvernements en leur rappelant leurs obligations morales envers les prisonniers qu'ils détenaient et les soldats des forces adverses, appartenait au camp révolutionnaire.

En su libra «Recuerdo de Solferino», Henry Dunant expuso dos propuestas de acción a nivel internacional para aliviar el sufrimiento de las víctimas de la guerra: la primera era que los Gobiernos aprobasen un tratado internacional que debía respetarse en tiempo de guerra; y la segunda, que se estableciese una estructura organizativa para garantizar el cumplimiento de estas obligaciones internacionales. Dunant parecía darse cuenta de que solo podía inducir a los Gobiernos a actuar como deseaba combinando ciertas obligaciones internacionales, basadas en tratados, con una organización para aplicarlas. El resultado de sus propuestas fue, por supuesto, la aprobación del Convenio de Ginebra de 1864, por un lado, y la fundación del Movimiento de la Cruz Roja, por otro.

On 2 September 1984, Mr. Jean Pictet celebrated his seventieth birthday; his family, friends and colleagues congratulated him and conveyed their good wishes.

Mr. Pictet joined the ICRC as legal secretary in 1937. He was later appointed Director, then Director-General; he became a member of the International Committee in 1967 and a Vice-President in 1971. Having reached retirement age, he stepped down in 1979 after 42 years of service, but remained a member of the Assembly.

Increasingly a number of non-governmental organisations (NGOs) appear to be demanding the right to provide humanitarian assistance and at the same time the right to denounce any violations of human rights. Whereas these are fine and understandable aspirations, they do not coincide with accepted principles of relief law and practice. This short article will explore certain aspects of this subject, primarily in relation to the treaty law applicable to circumstances of armed conflict and in occupied territories (International Humanitarian Law).

Following the technical notes it has previously published, International Review of the Red Cross is now starting a series of synopses on various current topics in the field of international humanitarian law. The following is the first of such summaries, entitled “Protecting Power”.

El Reglamento relativo al uso del emblema de la cruz roja y de la media luna roja por las Sociedades Nacionales, aprobado por la XX Conferencia International, celebrada en Viena el año 1965, fue revisado por el Consejo de Delegados de Budapest, en noviembre de 1991. Tras el aplazamiento de la XXVI Conferencia International, el CICR sometió el texto del actual Reglamento a todos los Estados Partes en los Convenios de Ginebra solicitándoles que le comunicaran las eventuates objeciones en un plazo de seis meses. Puesto que no se ha recibido solicitud alguna de modificación, el Reglamento entró en vigor en esa fecha.

Las principals normas relativas al uso del emblema figuran en los Convenios de Ginebra y muchos países las han incluido en la respectiva legislación national, para poder sancionar los abusos, especialmente. En el nuevo Reglamento se puntualizan las diversas modalidades del empleo del signo por las Sociedades Nacionales y sus miembros.

One of the principles underlying international law applicable in armed conflicts is that no act of war is permitted against the civilian population, consisting, by definition, of persons who take no part in the hostilities.

Until the holocaust of 1939–45, international law gave practically no real protection to the civilian population in the event of war, and was not even intended to do so since up to that time war was considered to be a State activity from which civilians remained aloof. There were, nonetheless, general principles and rules in various international treaties which, in one way or another, related also to the civilian population.

One of the basic principles of the Geneva Conventions and of Protocol I is that the persons protected shall be treated without any adverse distinction, in particular one founded on sex (C. I and II, art. 12; C. III, art. 16; C IV, art. 27; P. I, art. 75) and that women shall in all cases benefit by treatment as favourable as that granted to men (C. III, art. 14).

International humanitarian law and human rights law share a common goal, namely to protect the individual and to ensure respect for human dignity. Yet these two branches of international public law each have their own characteristics and origins and have evolved in different ways.

Nevertheless, the troubled aftermath of the Second World War, the unchecked rise of violence and poverty in recent decades and the resulting need for improved protection of the ever-growing number of victims of violations of fundamental human rights have all contributed not only to the evolution of the two branches of law but also to their convergence, like “two poor crutches on which disarmed victims can lean simultaneously”, to quote an expressive image by Karel Vasak. This expert went so far as to estimate in 1984 that “the convergence of the two branches has led to an overlapping both on paper and, increasingly, in practice as well”.

En la XXV Conferencia Internacional de la Cruz Roja (Ginebra, 23–31 de octubre de 1986), el CICR presentó un informe sobre la identificación de los medios de transporte sanitarios, incluido el cumplimiento dado a la resolución VIII de la XXIV Conferencia. En ese documento se ponía de relieve que, en un conflicto naval, la protección de los transportes sanitarios marítimos depende en gran medida de los medios técnicos disponibles en el ámbito de la identificación.

La XXV Conferencia reconoció la necesidad de esforzarse continuamente por adaptar los medios de identificación y de señialización del personal, de las unidades y de los medios de transporte sanitarios al desarrollo técnico y aprobó la resolution III: «Identification de los medios de transporte sanitarios»

Rara vez los debates originados por lo que algunos califican de derecho o de deber de injerencia, vinculándolo posteriormente al concepto de derecho de asistencia, han dado a las cuestiones humanitarias tal publicidad. A diferentes niveles de comprensión, el público en general, los medios de comunicación y los juristas especializados se han apasionado por esta cuestión; incluso han llegado a encararse.

En el fondo no es una mala cosa, porque estas pasiones no dejan indiferentes a los Gobiernos y así se puede avanzar en el ámbito humanitario. De hecho, es indiscutible que se han planteado, y aún se plantean, importantes cuestiones.
