This chapter considers how and in what contexts the reasonable person standard was applied by the selected colonial courts of the British Empire. The key question is whether the reasonable person imported from England remained English in substance – whether it continued to resemble a man on the Clapham omnibus – or the courts tailored the standard to the specific circumstances before them. As the first section shows, there are many cases in which the reasonable person was equated with an Englishman. This suggests that the standard was static in nature. However, the second section of the chapter complicates this conclusion by introducing numerous cases and settings in which the standard was adapted to specific, local contexts – sometimes so successfully that local variants of it developed. Drawing together the first two sections, the final part considers the nexus between a standard’s resemblance to the people to whom it is applied and the authority of law.

Over the past two decades, we have seen a significant shift in the norms literature away from the idea that a norm reflects a fixed and universally accepted shared understanding to notions that any norm – even those which appear to be widely institutionalised in international organisations of global governance – remains subject to contestation and interpretation at multiple sites in world politics. In this chapter, we take up the challenge of studying these diverse types of norms and their meaning, use, and role in practice. We begin by returning to the three moves laid out in the introduction and use as a vignette the forced landing of Ryanair Flight 4978 in Belarus in May 2021 to explore how each of these three moves can explain these events. We then draw out three sets of conclusions from the book, focusing on the process of contestation. We end by noting that the distinct approaches to norm research developed over the past thirty years do speak to one another in meaningful and innovative ways. By focusing on contestation in a holistic way, we can not only understand norms in a unique way but also how they constitute the world.

Chapter 14 concludes the book, highlighting its major theoretical and practical insights for the study of EU integration and for the prospects of democracy in Europe. The technocratic design of the EU’s new economic governance (NEG) regime eschewed citizens’ and workers’ political rights to have a say in policymaking; and the commodifying bent of its prescriptions eroded their social rights to be protected from the vagaries of the market. After the pandemic, the technocratic bent in EU economic governance endured, as the National Recovery and Resilience Plans were co-designed by national and EU executives without any meaningful input from unions and social movements, and without national parliaments and the European Parliament making any amendments. The commodifying direction of the NEG regime also endured post-Covid, albeit with some concessions, notably in employment relations. EU executives have had to face the prospect that the hollowing out of social rights that resulted from commodification is pushing electorates towards Eurosceptic parties. In the current unstable context, labour politics matters a lot. Unions and social movements are essential in framing the social and political struggles about the policy direction of EU economic governance along a commodification–decommodification axis rather than a national–EU politics axis.

One of the important choices historians must make is to decide the time frame to apply to the event they are interpreting. They can narrow the lens through which they approach the subject and study factors in the immediate realm of the particular event. The advantage of a narrow focus or microhistory is that it allows the exploration of the event in great depth. One historian, for example, wrote on how the Chinese Revolution affected a village of a few hundred families. “By getting in very close, tightening your focus to a single person or tiny corner of the world, you can operate on a level, the nitty-gritty of social history, invisible to historians who work on a more general register.” Historians can widen the lens to see history in a broader time perspective. Choice of a broader time frame can shed light on larger historical developments conducive to explaining the event. It may demonstrate that the event being studied was shaped and influenced by longer-term processes than were first perceived.

This chapter concludes the book by considering whether IP law is responsive to reason, or whether IP law is increasingly informed by other values, such as faith.

Neither southern Africa’s archaeology nor its history or contemporary social and political structure can be understood without reference to its experience of colonialism and conquest or of the resistance to this. This chapter therefore looks at the archaeology of Portuguese exploration and subsequent settlement in Mozambique, as well as at the much more expansive colonisation of southern Africa set in motion by the establishment of a Dutch East India Company (VOC) base at Cape Town in 1652. It traces the spread of European settlement into the region’s interior, the emergence of new creolised populations on and beyond the frontiers of that settlement, the institutionalisation of the social, economic, and political structures that led to apartheid, and – crucially – the resistance of Indigenous societies to this. Chapter 13 also discusses the Mfecane and the emergence of the Zulu, Basotho, Ndebele, and Swazi states, among others, to emphasise their contemporaneity and potential connections with European settler expansion and to encourage comparative study of processes of state formation, migration, and population incorporation common to both.

Focusing on the history of Henry Wadsworth Longfellow's 1865 abolitionist poem “Christmas Bells,” this chapter argues that the mediation, reproduction, and circulation of poetry in the digital age are best understood in relation to a longer history of poetry's technological mediation and reproduction by print and older nonprint media. Analyzing how the text of “Christmas Bells” has been edited, cut, reformatted, repurposed, and reproduced for a wide range of media and media platforms over a period of 150 years (via print periodical, postcard, rubber crafting stamp, musical performance, gift tag, television broadcast, YouTube video, dinner menu, souvenir plate, Wikipedia page, and more) reveals not only the common and ongoing mutability of the poetic text in the age of its mechanical reproduction but also the need for new critical models that reassess notions of the poem, author, reader, and book as cardinal points of poetry studies. Reimagining poetry studies in the digital age also means reimagining the study of poetry produced centuries before; it means reconsidering the longer history of poetry's remediation that the digital age inherits, extends, and remakes.

Chapter 2 relates the shocking death of Elmer Ellsworth, the effect it had on his men, and the regiment’s first battle experience at Bull Run. Conflicting accounts emerged in the aftermath of the fight: some positive, heralding the Fire Zouaves’ reckless bravery; but many others were damning, painting a portrait of the men’s panic and fear.

This chapter examines the concept of style in terms of language and of representation. The style of a poem may first be understood as a problem of language at the level of the sentence. The analysis of style is then concerned with diction, syntax, meter, and other such linguistic features, and analysis can approach style as either a conscious choice or an unconscious reflex. But style is therefore also a problem of representation. For example, style may index the poet's character, gender, class, or any other aspect of their identity, and in this way, style is entangled in the specificities of social and historical life. Through detailed readings of poems by Margaret Cavendish and Harryette Mullen, the chapter then argues that the concept of style, both as language and representation, mediates between the one poem and the many. On the one hand, style customarily links one poem to other poems and indeed to other discourses and artforms. On the other, precisely because styles are shared and repeated a given poem may allude to or incorporate styles as part of its material and may, through this very process, affirm its own difference or even singularity.

Chapter 3 details the connection between the utopian novel and vegetarianism. It argues that vegetarianism plays an important role in the two most significant texts in the development of the genre in the late-nineteenth century: Bulwer-Lytton’s The Coming Race and Samuel Butler’s Erewhon. It suggests that while H. G. Wells’s conflicted personal views on vegetarianism means that the subject is treated with a marked ambivalence, ultimately benefiting the fiction, the wholehearted endorsement of vegetarianism in Bellamy’s Equality is one element amongst several that reduces the text to little more than didactic screed. Here the important connection between women’s writing and vegetarianism and veganism is brought to the fore in a discussion of the British writer Mrs George Corbett and the American Charlotte Perkins Gilman.
