This paper discusses the relationship between justice and identity. While it is widely agreed that justice requires us to go beyond loyalty to our simplest identity – being just oneself – there is less common ground on how far we must go beyond self-centredness. How relevant are group identities to the requirements of justice, or must we transcend those too? The author draws attention to the trap of confinement to nationality and citizenship in determining the requirements of justice, particularly under the social-contract approach, and also to the danger of exclusive concentration on some other identity such as religion and race. He concludes that it is critically important to pay attention to every human being's multiple identities related to the different groups to which a person belongs; the priorities have to be chosen by reason, rather than any single identity being imposed on a person on grounds of some extrinsic precedence. Justice is closely linked with the pursuit of impartiality, but that pursuit has to be open rather than closed, resisting closure through nationality or ethnicity or any other allegedly all-conquering single identity. This paper examines the increasingly popular view that new insights from the science of subjective well-being (SSWB) should play a prominent role in the determination of public policy. Though there are instrumental reasons for caring about societal happiness too, these political aspirations of the SSWB appear to be mostly intrinsically motivated. As the intrinsic value of happiness is endorsed across the political–philosophical spectrum, there is some initial plausibility to the expectation that it should not be too difficult to develop intrinsically motivated policies that can count on widespread support. This paper argues, however, that intrinsically motivated policies based on SSWB findings will always be highly controversial. This is because, although happiness is widely held to be intrinsically valuable, it is usually not deemed unconditionally valuable. By exploring the policy implications of three different views of this conditionality – happiness as a fitting response to the state of the world, authenticity, and merit – it is shown that different views of the conditionality of the intrinsic value of happiness have widely diverging policy implications, which greatly undermines the political aspirations of the SSWB.

My essay “Let's Take the Con out of Econometrics” is intended to be an amusing, titillating, and even annoying distillation of ideas that I have published in a more formal, academic style in many different locations over the course of several years. As far as I could tell, these ideas were widely ignored until I adopted the more contentious style of “Con,” which, since its publication two years ago, has been reprinted in two volumes and excerpted in two others. There is something to be learned from this episode about the sociology of ideas. Notoriety, however, is a mixed blessing, since now I find myself spending too much of my time trying to explain what I meant.

Since a paradigmatic approach is judged in part by the range of phenomena it can explain, neoclassical microeconomists have no doubt gained assurance about the power of their paradigm by the invasion of economics into a number of related fields, what Hirschleifer (1985) has referred to as the “expanding domain of economics.” Moreover, even beyond these excursions into the provinces of other social sciences concerned with human behavior, economics has also recently expanded into the analysis of animal behavior (cf. Battalio, Kagel, and McDonald, 1985). This development not only adds more scientific prestige to the approach, but allows economists to use research techniques developed in more experimentally oriented disciplines.

In the January 6, 1991, issue of the Washington Post Magazine, reporter Walt Harrington wrote a profile of Bryan Stevenson. Mr. Stevenson is a 31-year-old working-class African-American from Delaware who graduated from Harvard Law School and the Kennedy School of Government. Like the typical graduate of Harvard Law School, Mr. Stevenson had the opportunity to join the worlds of six-figure corporate law or high-visibility politics. Rather than follow his colleagues, however, Mr. Stevenson works seven-day, eighty-hour weeks as director of the Alabama Capital Representation Center. He appeals death sentences, handling twenty-four death-row cases himself, supervises five other lawyers who cover about thirty cases, and raises federal government and foundation funding. He does this living a Spartan existence on a salary of $24,000, refusing even the $50,000 directorship salary offered to him.

According to the priority view, or prioritarianism, it matters more to benefit people the worse off they are. But how exactly should the priority view be defined? This article argues for a highly general characterization which essentially involves risk, but makes no use of evaluative measurements or the expected utility axioms. A representation theorem is provided, and when further assumptions are added, common accounts of the priority view are recovered. A defence of the key idea behind the priority view, the priority principle, is provided. But it is argued that the priority view fails on both ethical and conceptual grounds.

The seminal contribution of Sen (1976) led to a new way to conceptualize and measure absolute poverty, by arguing for the need to ‘take note of the inequality among the poor’ (Sen 1976: 227). Since then, the ‘Inequality’ of poverty has become the third ‘I’ of poverty, which together with the ‘Incidence’ and the ‘Intensity’ of it constitute the dimensions deemed relevant for poverty evaluation. In this paper, we first argue that the interest in the third ‘I’ of poverty actually originates from a prioritarian (Parfit 1995) rather than an egalitarian attitude. Further, we illustrate the inability of the three ‘I's to fully comprise the criteria for the assessment of poverty which are de facto adopted by existing poverty indices. Some of them resolve distributional conflicts by following leximin, hence assigning a pivotal role to the worst off. We question the desirability of leximin, and conclude that giving absolute priority to the worst off is plausible only in cases where the latter has been identified by an exogenous threshold demarcating a significant difference in human suffering. Finally, we explore to what extent prioritarianism and the sufficiency argument of Frankfurt (1987), Crisp (2003) and Casal (2007) can help conceptualize giving absolute priority to individuals or groups indentified by exogenous (poverty and ultra-poverty) thresholds.

This paper discusses the definition of the state space and corresponding choice sets that figure in the theory of decision making under uncertainty. It elucidates an approach that overcomes some conceptual difficulties with the standard models and accommodates a procedure for expanding the state space in the wake of growing awareness.

We address the question, in decision theory, of how the value of risky options (gambles) should be assessed when they have no finite standard expected value, that is, where the sum of the probability-weighted payoffs is infinite or not well defined. We endorse, combine and extend (1) the proposal of Easwaran (2008) to evaluate options on the basis of their weak expected value, and (2) the proposal of Colyvan (2008) to rank options on the basis of their relative expected value.

While ordinary decision theory focuses on empirical uncertainty, real decision-makers also face normative uncertainty: uncertainty about value itself. From a purely formal perspective, normative uncertainty is comparable to (Harsanyian or Rawlsian) identity uncertainty in the ‘original position’, where one’s future values are unknown. A comprehensive decision theory must address twofold uncertainty – normative and empirical. We present a simple model of twofold uncertainty, and show that the most popular decision principle – maximizing expected value (‘Expectationalism’) – has different formulations, namely Ex-Ante Expectationalism, Ex-Post Expectationalism, and hybrid theories. These alternative theories recommend different decisions, reasoning modes, and attitudes to risk. But they converge under an interesting (necessary and sufficient) condition.

Trygve Haavelmo's 1944 article ‘The Probability Approach in Econometrics’ is considered by most to have provided the foundations for present day econometrics (Morgan, 1990, Chapters 8 and 9). Since Haavelmo (1944), extraordinary advances have been made in econometrics. However, over the last two decades the efficacy and scientific status of econometrics has become questionable. Not surprisingly, the growing discontent with econometrics has been accompanied by a growing interest in econometric methodology.

Juries, committees and experts panels commonly appraise things of one kind or another on the basis of grades awarded by several people. When everybody's grading thresholds are known to be the same, the results sometimes can be counted on to reflect the graders’ opinion. Otherwise, they often cannot. Under certain conditions, Arrow's ‘impossibility’ theorem entails that judgements reached by aggregating grades do not reliably track any collective sense of better and worse at all. These claims are made by adapting the Arrow–Sen framework for social choice to study grading in groups.

Professor Hausman has written an interesting and instructive book. Though I am by no means favourably disposed to methodology for economists, (its results seem to have been pretty disastrous), I found reading Hausman enjoyable and I came away having learned things worth learning. But not all is well, largely because Hausman is a philosopher first and an economist a poor second. There are also important questions where one would have expected philosophic help which are not asked at all.

Hobbes believed that the state of nature would be a war of all against all. Locke denied this, but acknowledged that in the absence of government, peace is insecure. In this paper, I analyse both accounts of the state of nature through the lens of classical and experimental game theory, drawing especially on evidence concerning the effects of punishment in public goods games. My analysis suggests that we need government not to keep wicked or relentlessly self-interested individuals in line, but rather to maintain peace among those who disagree about morality.

Are foundations of models of ambiguity-sensitive preferences too flawed to be usefully applied to economic models? Al-Najjar and Weinstein (2009) say such is indeed the case. In this paper, first, we point out that many of the key arguments by Al-Najjar and Weinstein do not apply to quite a few of the ambiguity preference models of more recent vintage, and therefore to that extent do not undermine the foundational aspects or applicability of ambiguity models in general. Second, we argue the focus in that paper on Ellsberg examples is an overly narrow concern; the Ellsberg examples have their uses but they are not the best context to understand why reasonable real-world agents may find acting in an ambiguity-sensitive manner normatively or prescriptively appealing. Finally, normative considerations aside, we submit that Al-Najjar and Weinstein are unduly dismissive of the power of such preferences to provide illuminating positive analyses of economic phenomena.

In a contribution to this journal Amos Witzum has challenged a common interpretation of Adam Smith's theory of justice, according to which Smith ‘employed a concept of justice – in the tradition of natural laws theories – whereby rights are related to guarding what is one's own rather than to what is one's due’ (Witzum, 1997, p. 242). Witzum claims that not only does Smith's conception of justice include one's due, and hence, distributional considerations, but the right to one's own ‘stems from the right to what is one's due’ (p. 244). Furthermore, he asserts that ‘as all members of society own their natural faculties, which presumably were given to them to enable them to survive, the fruits of their labour up to subsistence level belong to them by virtue of their ownership of their own faculties’ (p. 259). This leads him to the conclusion that property acquisition gives rise to a duty, on the part of property holders, to ‘distribute subsistence’ and that when wages fall below the subsistence level, the rights of workers have been violated ‘in exactly the same sense that taking an acquired asset away from its owner constitutes a violation of justice’ (p. 244).

In criticizing communitarian views of justice, Amartya Sen argues that identity is not merely a matter of discovery but an object of reasoned choice subject to constraints. Distinguishing three notions of identity – self-perception, perceived identity and social affiliation – I claim that the relevant constraints implied by this argument are minimal. Some of Sen's arguments about perceived identity and social context do not establish any further constraints. Sen also argues that a model of multiculturalism and some forms of education can restrict, or fail to promote, reasoned and informed identity choice. This argument is better understood in the light of Sen's work on capability and justice, notably his concern with ways in which underdogs can adapt and his emphasis on public reasoning. It highlights limitations on information and opportunities for reasoning. I suggest that these lead to genuine constraints on (reasoned and informed) identity choice. The paper focuses on Sen's work, though its claims are also relevant to George Akerlof and Rachel Kranton's analysis of identity.
