In Japan, the management of anime series as intellectual properties has developed over a long-time span, growing into a sophisticated system of transmedia serialization professionally known as the “media mix.” Content derived from well-established anime series, however, is not exclusively developed to promote spin-offs and merchandise notoriously associated with fans and otaku subcultures. In a changing domestic market, it is increasingly exploited to add value to products and services in unprecedented commercial spheres, including drinks, tourism, and urban requalification. By taking the 40th anniversary of Mobile Suit Gundam as a case study, this chapter reflects on recent trends in anime licensing, providing a brief introduction to their effects on what might be called “extended” anime distribution. Through this perspective, it becomes possible to identify a series of apparently unrelated phenomena that are nonetheless connected to the aging of anime series and the changing demographics of their consumers.

The early essay in English was a fluid and malleable form. It was thus ‘fugitive’: it could be deeply topical, fleeting, and perishable, taking up the ephemeral and the occasional, and could easily travel across media from reader to reader given its portability. This chapter studies how writers exploited the affordances of the essay, first in seventeenth-century newsbooks and pamphlets, and then in early eighteenth-century periodicals. It retraces the origins of the English newsbook in a highly regulated media ecology, and examines the essayistic writings of Marchamont Nedham as a case study in stylistic innovation and rhetorical self-fashioning. During the era of licensing (1662–95) and the first decades of the eighteenth century, essayists continued to adapt the form, finding in the emergent print media of this period a ready site for politics and polemic.

One of the world’s greatest experiments in open innovation is mobile wireless. Technology enterprises have invested billions of R&D dollars to develop 2G, 3G, 4G, now 5G, and hopefully 6G soon. Technology developers make investments and look to the patent system and associated regulators to reward them for risky investments, should their patented technologies become included in the standards. In recent years there has been an uptick in the number of technology implementers. But because patents are not self-enforcing, unlicensed use occurs, which is corrosive of the open innovation system that allows non-vertically integrated firms to compete at the device level. This chapter reviews antitrust theories that some implementers have used to avoid paying royalties to patent owners. This is examined in the context of the FRAND licensing regime established by ETSI, a standards development organization. “Hold up” and “hold out” theories are examined. Hold up theories lack empirical support and are misused by some implementers—particularly those in China—who would prefer to free ride on the R&D investments of others. Restoring and revitalizing technology markets for mobile wireless likely requires limits to be placed on the availability of FRAND licenses with respect to recalcitrant technology implementers. Otherwise, the innovation ecosystem will be harmed, and open innovation (that is, licensing) business models will collapse.

Times are changing as our global ecosystem for commercializing innovation helps bring new technologies to market, networks grow, and interconnections and transactions become more complex around standards, all to enable vast opportunities to improve the human condition, to further competition, and to improve broad access. The policies that governments use to structure their legal systems for intellectual property, especially patents, as well as for competition—or antitrust—continue to have myriad powerful impacts and raise intense debates over challenging questions. This chapter explores a representative set of debates about policy approaches to patents, to elucidate particular ideas to bear in mind about how adopting a private law, property rights-based approach to patents enables them to better operate as tools for facilitating the commercialization of new technologies in ways that best promote the goals of increasing access while fostering competition and security for a diverse and inclusive society.

This chapter considers the ways in which zoos are organised and regulated under the law. Zoos and zoo organisations produce policies and standards that govern how they operate and behave. National legislation generally regulates zoos via a system of licences and inspections to ensure conformity to a range of animal welfare, public safety and other standards. The licensing systems of the United Kingdom, Sweden and the United States are considered here. In addition to national legislation, zoos are also required to comply with European laws (in the European Union), such as the Zoos Directive, and international laws such as the Convention on International Trade in Endangered Species of Wild Fauna and Flora. Some individuals keep private collections of exotic animals and these are generally regulated by national or state legislation intended to ensure that animals are suitably housed, have adequate veterinary care and are being safely contained to prevent a risk to the public or the environment if they escape.

The calls for freedom of press in the mid-seventeenth century, like the earlier calls for freedom of speech, also came mostly from devoutly religious people: Puritans and Nonconformists and their religious-based demands. That religious basis was mostly a desire to disseminate religious preaching and knowledge, and an imperative to do that not only by preaching and other speech but by publishing religious books and pamphlets, in addition to a religious basis in freedom of conscience. John Milton, the trailblazer in seeking "the liberty to know, to utter, and to argue freely according to conscience," tried to extend parrhesia from speech to publications, and built his case in Areopagitica and in other pamphlets on freedom of conscience, on Bible passages, and on similar religious messages. Though Areopagitica is generally described in scholarly literature as unnoticed and overlooked until the end of the seventeenth century, it in fact was relatively widely known, as nearly fifty quotations or allusions show before that century’s end. Besides Milton, other Puritans were the dominant advocates for freedom of press before the end of the seventeenth century, including three who wrote a generation before Milton (an anonymous minister, Leonard Busher, and William Ames), and Levellers and others.

In recent years, there have been many accounts of extreme prescription drug prices that have raised issues of equity, price gouging, social conscience, and demands for relief. In part, these prices arise due to the inelastic demand for lifesaving drugs and the patents that create short-term legal monopolies. The economic rationale for patent protection flows from the fact that the investment made by inventors necessarily precedes any financial benefits received from the discovery of new products or more efficient production processes. Patent law prevents copiers from free riding so that innovators can reap the reward of monopoly profits for their innovation. Thus, there is a trade-off between innovation and affordability. Antitrust law cannot be used to disrupt legal monopolies, so the US government has turned to congressional proposals that would mitigate extreme drug pricing. We also review the policies of other countries that are aimed at reducing pharmaceutical drug prices and consider whether such policies would work in the US market.

It is hard to reconcile the research university’s supposed reason for being – the reasoned pursuit of knowledge – with its methods for building brand awareness and equity. Just like pitches for other luxury goods, the selling of higher education depends on irrational appeals devoid of information and marketing missives meant to hug the line between legally protected puffery and outright fraud. Although universities have always borrowed from the selling strategies of the commercial sphere, in recent years, there has been a sea change in the prevalence and degree of less-than-truthful content in higher educational self-promotion. How do university constituents – administrators, professors, students – interpret this gap between their institutions’ traditionally understood role and the logic of today’s academic branding strategies? The chapter chronicles the main rationalizations these actors deploy to reduce the tension between academic mission and academic marketing. By telling themselves that their school’s advertising efforts can be quarantined from the university’s larger purpose or actually provide tangible and truthful information to outside audiences or are a necessary evil, university constituents reduce their internal dissonance but fail to confront the realities of academic branding.

In 1929, J. M. Barrie made a bequest to the Great Ormond Street Hospital for Sick Children of his most popular creation, ‘Peter Pan’. Chapter 5 explores the dynamic of gift-giving for the benefit of vulnerable children and how this translated into licensing practices. A Peter Pan movie, to be directed by George Cukor and starring Audrey Hepburn, was never made because of the bitter relationship that developed between the licensor, the Great Ormond Street Hospital, and its licensee, the Disney Corporation, which resulted in litigation in the 1960s. By looking at the misfortune of a film that was never made, the chapter shows how licensing intangible properties involved not only a question of contract and property, but also a more complicated question of trust, sociality and the etiquette of managing commercial opportunities. The chapter engages in a deeper consideration of the impact of the Disney Corporation, not just in creating a highly effective managerial infrastructure to exploit the child as a consumer, but also in developing intellectual property strategies to gain a privileged position with consumers, who were now conceived of as being included within the Disney family.

In this chapter, we discuss three classes of phenomena that are captured by the terms dependency and licensing, in clauses and nominal expressions: (i) the structural relation between a lexical head (e.g., V, N, A) and the functional structure projected by it such as the relation between a verb and an auxiliary or between a noun and a determiner; (ii) the selectional relation between a lexical head and the constituents that are combined with it to satisfy its argument structure, as in the case of the verb and the direct object; and (iii) the structural relation created by two different constituents that share the same referential index. In the third case, we observe two major types: a constituent is displaced, as in the case of the subject of a passive clause or a wh-constituent; or two constituents share the same referent but have different functions in the clause (or in different clauses), as is the case of pronouns and their antecedents. The dependencies dealt with in the first two cases are ‘local’, while the others can be long distance. Most of the analyses of the dependency phenomena relate the relative richness in inflexional morphology to variation in word order, argument marking, agreement, and the realization of pronominal reference.

Chapter 3 covers theoretical issues surrounding the nature of a “license” of IP and how it compares to similar rights of usage in the context of real and personal property. It considers whether, as some courts have held, a license is a covenant not to sue, or a property right with more substantial ties to the underlying IP rights. It next addresses the law governing IP transactions, including state contract law, property law, the Uniform Commercial Code and federal common law. It concludes with a discussion of the effects of transfers of IP on underlying license rights.

Chapter 1 presents an overview of the IP licensing industry and covers the business assumptions and goals of IP transactions, including market and geographic expansion, modularization, monetization, rights aggregation and platform leadership.

Chapter 2 covers issues surrounding the assignment of IP (i.e., fixing its ownership as a prerequisite to transacting in it), and contrasts ownership with licensing of IP. It specifically covers the assignment of rights in patents, copyrights, trademarks and trade secrets, including within the employment context (i.e., shop rights , individuals hired to invent and works made for hire). The Supreme Court decision in Stanford v. Roche is considered at length. The chapter concludes with a thorough discussion of the issues presented by joint ownership of IP.

This chapter examines an apparent paradox, the existence and further development of significant body of laws prohibiting different forms of gambling and gambling in certain places, and their overwhelming inefficacy. The law provides, nevertheless, a very useful prism through which to plot changing and fluctuating attitudes towards gambling among the authorities and politically powerful, and, indeed, rather lower down in society. The heart of this chapter is an analysis of successive drives to clamp down on gaming houses in London and their fairly negligible impact viewed in the longer term. This is partly a story of the resourcefulness and resources of the gaming house keepers, and their ability to evade or blunt the effects of law and magisterial campaigns to enforce the law. But it is also a story of how ineffective the law and contemporary forms of policing were when faced with an extensive, well-embedded and well-capitalized gambling industry, often supported by or at least tolerated by local communities. This is quite apart from the flagrant double standards which were entertained by the state and Parliament towards gambling.
