Summary

On March 31st, 2005, UN Security Council Resolution 1593 referred the humanitarian crisis in Darfur to the Office of the Prosecutor at the International Criminal Court in The Hague. Three months earlier, Sudan, a non-party to the Rome Statute, had signed a Comprehensive Peace Agreement that was intended to end decades of regional conflict in Sudan. This chapter examines timing and sequencing in the case of the ICC indictment of Sudan President Omar Hassan al-Bashir and the effects of two separate but interconnected processes, namely the ICC investigation seeking accountability in the “interests of justice” and diplomatic efforts to end the conflict “and guarantee lasting peace.” The case raises several critical questions: Why did the Security Council pass Resolution 1593 at such a fragile moment in the peace process? What were the diplomatic and political considerations of key state actors? What were the judicial considerations? How were the resulting signals interpreted by various parties and what were the consequences? What lessons can be derived for responses to future situations?
