L'affaire de la Société néerlandaise pour l'exploitation de réclame (Reklame Exploitatie Maatschappij R.E.M.) laquelle, en érigeant une installation fixe en haute mer devant la côte néerlandaise à la limite de la mer territoriale, envisageait de réaliser des émissions de télévision destinées à être reçues sur le territoire néerlandais, a suscité l'intérêt dans les milieux néerlandais les plus divers. C'est notamment à l'intention de nos lecteurs à l'étranger que nous nous proposons de relater dans le présent article les faits tels qu'ils se sont produits. Nous allons faire suivre cet exposé d'un commentaire qui exposera quelques aspects du droit international relatifs à cette affaire. Nous avons fondé nos observations en grande partie sur le rapport de la Commission consultative néerlandaise en matière de droit international, rapport qui a reçu l'approbation unanime de ses membres et dont quelques extraits seront reproduits textuellement dans l'exposé qui va suivre. Le texte intégral de ce rapport est publié ci-après dans la section « Documents ».

Aux termes de l'article premier de la Convention sur la haute mer conclue à Genève le 29 avril 1958, «on entend par «haute mer» toutes les parties de la mer n'appartenant pas à la mer territoriale ou aux eaux intérieures d'un Etat ».

Ce qui frappe à la lecture de cet article, c'est le caractère négatif de la définition qu'elle contient: la haute mer y est décrite comme ce qui reste de « la mer », déduction faite de « la mer territoriale » et des « eaux intérieures ».

Non pas le droit de vente internationale tout entier. Un contrat de vente est international aussitôt qu'un seul de ses éléments a des rattachements avec un Etat (et, par conséquent, avec le droit en vigueur dans cet Etat) autre que l'Etat ou les Etats au(x)quel(s) se rattachent ses autres éléments. l'achat fait dans un magasin aux Pays-Bas par un Français établi aux Pays-Bas appartient à la catégorie de la vente internationale pour la raison que ce rapport de vente, par suite de la nationalité de l'acheteur, se rattache à l'Etat franàais et par conséquent n'est pas une vente interne néerlandaise. A juste titre les projets de conventions ne veulent pas faire une réglementation pour tous les contrats de vente internationale, mais uniquement pour ce que, d'une façon peu juridique, nous pourrions appeler les ventes commerciales internationalement importantes. C'est pourquoi les conventions ont ellesmêmes défini — et ce de manière très juridique — les contrats de vente internationale sur lesquels elles portent. l'art, premier, premier alinéa, de la loi uniforme qu'on a élaborée est libellé comme suit (Tr. Bl. 117):

“La présente loi est applicable aux contrats de vente d'objets mobiliers corporels passés entre des parties ayant leur établissement sur le territoire d'Etats différents, dans chacun des cas suivants:

a. lorsque le contrat implique que la chose fait, lors de la conclusion du contrat, ou fera l'objet d'un transport du territoire d'un Etat dans le territoire d'un autre Etat;

b. lorsque les actes constituant l'offre et l'acceptation ont été accomplis sur le territoire d'Etats différents;

c. lorsque la délivrance de la chose doit se réaliser sur le territoire d'un Etat autre que celui où ont été accomplis les actes constituant l'offre et l'acceptation du contrat.”

The phenomenon of a pirate radio station operating from a ship strategically anchored on the high seas is graphic testimony to man's irrepressible ingenuity as well as to the truism that a legal norm can never anticipate every possible contingency.

The circumstances are remarkable in that in order to evade the prohibitions of a municipal legal system, individuals have sought shelter under the protective umbrella of international law, confident that the states concerned, particularly the United Kingdom and the Netherlands, would acknowledge the inviolability of their activities.

Rabel stated in his basic comparative study on the conflict of laws the following “dominant principle” in the field of torts:

“The principle unanimously established by the canonists and later the statutists since the 13th century and generally adopted today is that the lex loci delicti commissi governs.”

In recent publications this general principle has been widely discussed and it appears that neither the historical background of the rule nor its theoretical justification is entirely free from doubt. Some legal writers have pointed out that the lex loci delicti rule in its present form is of relatively recent origin. The main issue of the modern discussion, however, is concentrated on the theoretical bases of the rule. The following study will be restricted to this problem and there will be a comparison of the laws of some continental European countries and the law of the United States.

The Belgo-Spanish case concerning the Barcelona Traction, Light and Power Company, Ltd. (hereafter called Barcelona Traction), terminated in its preliminary phase by the Judgment of 24 July 1964, had had a prelude in 1958–1961, hence its official sub-title “New Application: 1962.” A corresponding action was in fact already instituted by a unilateral Belgian Application against Spain, dated 15 September 1958, filed on the following 23 September, but the proceedings thus initiated were discontinued by a unilateral communication addressed to the President of the Court by the Belgian Government on 23 March 1961, not opposed by the Spanish Government, and officially recorded by Order of the Court of 10 April 1961 (I.C.J. Reports 1961, p. 9).

In Shakespeare's tragedy “Antony and Cleopatra” the heroine of the play, Cleopatra, on the point of committing suicide, exclaims: “I am fire and air, the other elements I give to baser life!” It seems that mankind to-day is also giving the element of air to baser life, and is moving into spheres far away from our global environment, spheres above the earthly atmosphere, spheres which are commonly called outer space, as distinguished from airspace proper. In the beginning of this century the conquest of airspace was hailed as a major achievement in the history of mankind. Now already our dominion over the skies is regarded as something quite normal, and we are striving after greatly more ambitious projects. to wit the conquest of the universe.

“Pays hors Chrétienté,” wel een uitdrukking uit de oude doos! In net speciale onderwerp van volkenrecht voor mijn doctoraal namen die niet-christelijke, niet-westerse landen een belangrijke plaats in. Maar heden ten dage, waar komen we ze nog tegen? Lauterpacht heeft in zijn bewerking van Oppenheims boek de desbetreffende paragrafen laten vervallen (zie in de 6e druk de inhoudsopgaaf bij §§ 102–103, en blz. 225). De uitdrukking hoort nu in een bejaardentehuis van het volkenrecht. Ze voert een ietwat koloniale damp met zich van ongelijkheid en discriminatie. Nu, de discriminatie en een versluierd koloniale geur hingen inderdaad over die “Pays hors Chrétienté” in de 19e en onze eeuw.

The present writer examines the validity of a particular trust under Netherlands conflict of law and internal civil law rules. The trust in question is the following: A (married to B with two children C and D) assigns certain monies and securities in trust to a bank X under the following provisions:

(a) The trustee is free to hold, manage, invest and reinvest the trust property to the best of his ability; the trustee however requires the approval of the beneficiaries to pledge the trust property;

(b) The trustee shall pay all of the income and so much of the capital as he may deem desirable for the support and maintenance of the settlor during his life;

(c) Upon the death of the settlor the trustee shall pay all of the income and so much of the capital of the trust as he shall deem desirable to the wife of the settlor if she survives him; if she shall not survive him, then the trustee shall divide the trust fund between C and D and shall pay the income of each part and so much of the capital of each part as he shall deem desirable to the child who is the beneficiary of each such part; if she shall survive him this same provision will apply upon her death;

(d) The trustee shall pay out to each child the part of which it is the beneficiary upon the expiration of x years after the death of the surviving spouse, A or B.

(e) The trust is subject to the laws of the State of New York.

La Cour s'est réunie en 1964 pour une seule session, qui a duré du 9 mars au 24 juillet (138 jours). Elle a donné une décision dans l'affaire Belgo-Espagnole de la «BARCELONA TRACTION LIGHT AND POWER co.» Les exceptions préliminaires, présentées par l'Espagne, ont été rejetées. The problem of financing the United Nations—a recurrent problem in fact since 1945—has become an acute financial and political one, since 1956. In November 1956 and in December 1960, the General Assembly decided to assess UN members part of the expenditures incurred for peace-keeping operations in the Middle East and Congo in accord with the scale approved for raising the ordinary annual budget.

It was during the first world war that a Netherlands author, Dr. Jacob ter Meulen, published a study of one of the oldest documents in existence relating to the history of the age-old struggle for peace in Europe. The document concerned a project dating from the years 1462–1464, and linked with the name of King George of Bohemia, for the establishment of a universal organization for the maintenance of peace. Dr. ter Meulen deserves our gratitude inter alia for his attempt to portray this event in the context of world history.
