L'indépendance judiciaire est un des fondements de notre civilisation. Depuis que cette notion a été posée et développée dans la doctrine de la trias politica, nous avons appris à accepter, depuis des générations, l'indépendance du juge comme une chose naturelle et, dans les nombreux pays où la triple structure des pouvoirs législatifs, judiciaires et exécutifs a été réalisée, il est considéré comme tout à fait normal que le juge, dans l'exercice de ses fonctions, soit mis à l'abri des réactions, suscitées par sa décision, qui pourraient constituer une menace pour sa personne ou ses biens.

In the border-zone between Cambodia and Thailand are located the ruins of an old temple Preah Vihear, over the precincts of which Cambodia claimed territorial sovereignty. Thailand on her side affirmed that the area in question lies on the Thai side of the frontier and on that ground considered herself entitled to station detachments of her armed forces there, as she has in fact done since 1954. With the aim of achieving the recognition of her territorial sovereignty in an international title and the withdrawal of the Thai detachments, Cambodia, on October 6, 1959, seised the International Court of Justice by a unilateral Application. In answer to Cambodia's Memorial which followed that Application, Thailand filed two preliminary objections to the jurisdiction of the Court. Since the proceedings on the merits of the case were eo ipso suspended under the provision of Article 62, paragraph 3, of the Rules of Court, there was a first hearing of the case, confined to those preliminary objections, from 10 to 15 April 1961, followed by a Judgment of the Court dated May 26, 1961*), by which Thailand's preliminary defence was unanimously rejected. After a further exchange of pleadings, this time on the merits of the case, and new hearings, from March 1st to 31st 1962, the Court recently rendered its final Judgment on 15 June 1962**).

On 4th October, 1957, a man-made machine forche first time overrode the age old law proclaiming that everything that goes up must come down. Fifteen months later a means was developed of circumventing the earth's attraction. In September, 1959, the moon was reached and on 12th April, 1961, Major Gagarin orbited the Earth in a space capsule. In the short period of four years man's advance in space has been more rapid than the most sanguine forecaster has dared to predict, and it is now realized that a new phase in the history of mankind of exploration and development has begun in some ways comparable to, but vastly exceeding these in scope, the conquest of the sea and the air. Nobody can visualize the impact the conquest of space is going to have on life on this planet, but it becomes clearer every day that a process of change has started more profound and more sweeping than any which has overtaken the world since the foundation of the modern world.

Artikel 17 van het Handvest legt het primaat van het financiële beleid van de Verenigde Naties in handen van de Algemene Vergadering. Deze heeft op grond van deze bevoegdheid een algemene leidraad in de vorm van “Financial Regulations” vastgesteld (Resolutie 456, V). Bij artikel 13.1 van dit reglement is bepaald, dat geen Raad, Commissie of ander orgaan “een besluit zal nemen dat uitgaven met zich mede brengt, tenzij het een rapport van de Secretaris Generaal betreffende de administratieve en financiële gevolgen van het besluit, voor zich heeft.” Op grond hiervan schrijft het huishoudelijk reglement van de Algemene Vergadering voor, dat dergelijke besluiten in het plenum vergezeld moeten gaan van een door de Secretaris Generaal opgestelde begroting en een rapport daaromtrent van de begrotingscommissie.

En août 1963, il y aura 50 ans que le Palais de la Paix à La Haye a été inauguré en présence de S. M. la Reine Wilhelmine et de M. Andrew Carnegie qui avait fait une donation rendant possible la construction de cet édifice. Pendant 50 ans la Cour permanente d'Arbitrage y a eu son siège, mais sa fondation est d'une date bien antérieure. La Cour doit son origine à la première conférence de la Paix tenue à La Haye en 1899 et dans ses premières années elle se trouvait très modestement hébergée dans une maison de maître située Prinsengracht à La Haye. Le don de Andrew Carnegie avait pour but de donner à la Cour un siège qui serait vraiment digne d'elle et notamment de mettre à sa disposition une bibliothèque spécialisée en matière de droit international à laquelle pourraient avoir recours les tribunaux d'arbitrage appelés à siéger sous les auspices de la Cour.

The prolific growth of international intercourse and concomitant litigation in recent years has greatly increased the need for liberal and efficient procedures of international co-operation in civil litigation. The country in which the litigation is pending must make efficacious and flexible provision for the performance of necessary acts abroad, while the country in which the acts are to be performed should do whatever possible to eliminate unreasonable obstacles and to provide proper co-operation. Unfortunately, however, the procedures in many countries fail to meet these reasonable requirements.

Respektievelijk op 14 november 1960 en 1 juli 1961, heeft het Europees Gerechtshof voor de Mensenrechten te Straatsburg, uitspraak gedaan over de preliminaire excepties en rechtsplegings-kwesties en over de grond van de zaak “Lawless”. Het is de bedoeling van deze Studie om dit belangrijk eerste arrest van het Hof aan een onderzoek te onderwerpen, en zodoende de betekenis ervan te belichten zowel als precedent voor de verdere rechtspraak van het Hof, als op het stuk van de ontwikkeling der volkenrechtelijke Problemen die gesteld waren. Volledigheidshalve wordt echter vooraf gewezen op enkele fundamentele, aan dit Hof eigene bepalingen, die de lezer een duidelijker beeld moeten geven van de te volgen rechtsweg ter bescherming van de mensenrechten en fundamentele vrijheden, en hem aldus toelaten, deze zaak, voornamelijk op het proceduraal vlak, beter te begrijpen. Deze inleidende beschouwingen zullen gevolgd worden door een beknopt overzicht van de status causae et controversiae waarin vanzelfsprekend slechts die elementen zullen worden weerhouden welke voor een beter begrip van beide arresten onmisbaar zijn.

Effectiveness is in essence the expression of the relation between the facts and what is considered as law at a certain moment. This relation can be seen in two ways: on the one hand, the factual circumstances can be completely in accordance with the law in force at a certain moment; on the other hand, there can be a divergence between the two elements. If the first case arises there is no real problem. It is completely different, however, when there is tension between the law and the facts. Such tensions are inherent in every community, even in highly-developed ones. For every community is continuously moving. Due to the repeatedly changing factual circumstances this change is based on the always altering relations between the interests of the members of a community. Moreover, new facts ask for modification of the old rules or creation of new rules.

The U.S. District Court for the Southern District of Florida recently decided a case between a number of foreign airlines and the Dade County Port Authority as operator of the Miami International Airport. This case concerned the question of whether foreign airlines were bound to pay airport charges at a higher rate than some comparable American airlines. The plaintiff airlines claimed that the rates imposed by the Airport violated the applicable provisions of the Chicago Conventions The Port Authority denied this and opposed the claim on factual as well as legal grounds. For a proper understanding of the case we have to turn to the preceding history first.

Met dit academisch proefschrift verkreeg de schrijver de graad van geaggregeerde van het hoger onderwijs bij de Faculteit der Rechts-geleerdheid van de Vrije Universiteit te Brussel en opnieuw verschijnt aldus buiten Nederland een gedegen en voortrefFelijke Studie over Grotius' natuur- en volkenrechtelijke beschouwingen. Remec plaatste Grotius naast Vattel, de Pauw vergelijkt Grotius met Pattijn, die beiden een Mare Liberum schreven. De combinatie is ons vreemd; ter toelichting begint de schrijver als volgt:

“Een bekende episode uit de tachtigjarige oorlog is het beleg van Oostende. Wanneer de stad na een strijd van drie jaar en tachtig dagen door de Spanjaarden op de Staatsen is veroverd (22 September 1604), bezingt een Hollander haar val: de prijsgegeven stad is geteisterd door rampen, verschillende bezettingen, de zee, de pest, ze is doordrenkt met bloed en volledig vergruisd. Het gedieht heet Ostendia loquitur, de dichter is de eeneentwintig-jarige Grotius. Een eeuw later is Oostende het toneel van een nieuw bloeiend bedrijf, de Zuidnederlandse vaart op Indië, gegrondvest op het door dezelfde Grotius in een wereldberoemd boekje meesterlijk verdedigd principe van de vrijheid van handel en zeevaart: Mare liberum sive de iure quod Batavis competit ad Indicana commercia dissertatio (1609). Maar een eeuw is voorbijgegaan, de omstandigheden zijn veranderd, een nieuwe rechtvaardiging van hetzelfde principe is nodig. Een Raadsheer in de Grote Raad te Mechelen schrijft in het belang van een nieuwe Indische Compagnie een nieuw Mare Liberum (1726). Zijn naam is Pattijn.”

L'année qui vient de se terminer a suivi celle où a eu lieu la réunion de la Conférence en session plénière. Comme d'habitude, l'on peut distinguer dans l'activité de la Conférence durant cette période deux éléments, l'un relatif à l'avenir, l'autre à la mise en oeuvre des résultats atteints dans le passé

Examinons d'abord le second élément: les délégués rentrés chez eux après la Session ont consacré une énergie considérable à la publication d'un nombre important d'articles précieux afin de faire connaître à leurs compatriotes, et surtout au monde des juristes intéressés au droit international privé, les résultats atteints à La Haye en 1960. Il y a lieu de faire rentrer dans cette catégorie de conséquences directes de la Neuvième session un événement d'une importance primordiale pour l'efficacité de la Conférence même: le 5 octobre 1961, c'est-à-dire précisément un an après l'ouverture de la Neuvième session, les trois Conventions adoptées par celle-ci furent signées par les Représentants diplomatiques d'un nombre appréciable d'Etats, nombre qui augmenta encore dans les semaines suivant immédiatement cette date. C'est avec quelque étonnement que certains intéressés ont constaté l'absence, jusqu'ici, de toute signature au nom des Pays-Bas, dont cependant la Commission d'Etat pour la codification du droit international privé agit comme organe inspirateur de la Conférence. Nous croyous savoir qu'il ne s'agit ici que de retards dus à des conditions administratives, plutôt que d'objections d'ordre matériel contre les dispositions convenues.
