On March 26, 1951, three years before the historic Brown decision, in Gonzales v. Sheeley (1951), Judge Dave Ling of the United States District Court of Arizona ruled that the segregation of Mexican American students in a separate “Mexican School” was unconstitutional. In this article, we trace the legal arguments in Gonzales through two prior cases, Mendez v. Westminster (1946) and Delgado v. Bastrop (1948). We analyze how racialism, the social science critique of racism and legalism, shaped the arguments in the three cases. Our analysis suggests that Gonzales was a departure from Mendez and Delgado because it was the first case in which a court made an unqualified argument against segregation. The trajectory of the legal arguments across the three cases highlights how new cultural ideas about race were slowly incorporated into civil rights case law, a process that was also shaped by the institutional norms and practices of the legal system.

This article considers the role of Bella Abzug, lead counsel for Willie McGee from 1948–1951, in shaping the defense of this Cold War era Mississippi rape case. Representing McGee left an indelible mark on Abzug: she made her first trip south, wrote her first Supreme Court petition, and faced her first death threat. Participation in the Left legal bar—especially the National Lawyers Guild and Left feminist circles—shaped Abzug's legal consciousness as she redirected the McGee defense significantly in 1950. By joining race and sex, Abzug's legal argument zeroed in on the taboo of interracial sexual relations at the heart of Southern rape cases, thereby exposing the innermost sexual color line. She urged the courts and cause lawyers—albeit unsuccessfully—to pursue a more radical civil rights agenda than outlawing public segregation, as ultimately achieved in Brown v. Board of Education (1954), and typically recognized in Cold War civil rights scholarship.

This essay reviews the arguments and impacts of the classic work, The Process Is the Punishment by Malcolm Feeley, originally published in 1979 and republished with a new foreword and preface in 1992. This essay examines how the book has been used in sociolegal research since 1979 by empirically tracing its citation in published work. I also examine missed opportunities where The Process Is the Punishment could still expand its impact in the literature, as well as reviewing the major arguments and criticisms of the book.

Sociologists of law have long been concerned with the effectiveness of rights; the emergence of diversity training in the 1990s spurred renewed attention to questions of how laws are enacted in daily life. Much scholarship has constructed the managerialization of civil rights law and popularization of diversity concepts as diluting efforts to redress structural discrimination. In studying diversity and antiharassment trainings in practice, I argue that these are sites where civil rights find expression of their obligations, and I find that much of the “dilution” of content stems from diversity trainers’ efforts to negotiate with the resistance of trainees to their new obligations under civil rights law. The trainees evince a variable legal consciousness in relationship to this legality of rights-promotion, to which they are being exposed in these trainings; the findings suggest further research is needed into the legal consciousness of the privileged.

This essay reviews the recent volume edited by Ronald Kahn and Ken I. Kersch, The Supreme Court and American Political Development (2006), as well as the broader literature by law scholars interested in American Political Development (APD). The Law and APD literature has advanced our knowledge about courts by placing attention on the importance of executive and legislative actors, and by providing political context to our understanding of judicial decision making. But this knowledge would be more powerful if it would embrace the broader APD field's orientation toward the importance of state and institutional autonomy for understanding politics and political change. Law and APD scholars could go further in examining the ways in which courts and judges act institutionally, and how the legal branch as an institution impacts American politics and state-building. In doing so, Law and APD scholars would contribute not only to our understanding of judicial decision making but also to our understanding of the place and importance of courts in American politics.

Two correlational studies test the hypothesis that procedural justice, or fairness of process, plays a role in acceptance of agreements reached through bilateral negotiation. Both studies test the relationship between the fairness of the process used to resolve a dispute, objective monetary outcomes, subjective assessments of outcome favorability, and subjective assessments of outcome fairness. Additionally, the second study tests the hypothesis that negotiations characterized by greater procedural justice result in more potential for integrative bargaining. The results suggest that procedural justice encourages the acceptance of negotiated agreements, as well as leading to the opportunity for increased integrative bargaining.

While developments in intellectual property have opened the door for trademarking color alone or color per se, it is important to observe that color codification is not a new phenomenon. This article outlines the quest to metaphorically trademark purple in antiquity and to provide it with clear “secondary meaning.” It highlights how language, literature, and sumptuary law was deployed to infuse purple with the appropriate symbolism, and it links contemporary debates to some of the historic moves to sequester color.

Although feature films may overpraise lawyers and civil courts as means of securing justice, they caricature lawyers and litigation. Analysis of Erin Brockovich (directed by Steven Soderbergh and produced by Danny DeVito, et al., 2000) reveals four motifs—two favorable and two unfavorable to public‐interest litigants and litigation—that characterize similar films in the last decades: Class Action (1991), The Rainmaker (1997), The Sweet Hereafter (1997), A Civil Action (1998), The Insider (1999), Runaway Jury (2003), and North Country (2005). These filmic populist romances promote ordinary heroines (mostly) who redeem a problematic system through common sense and everyday virtue rather than through laws, lawyers, and litigation.

This essay provides an overview of actor-network theory (ANT) and its potential interest for sociolegal scholars. It focuses on Bruno Latour's 2002 ethnography of La fabrique du droit: une ethnographie du Conseil d’État [The factory of law: an ethnography of the Conseil d’État] (2002b), which provides an analysis of the workings of the French Conseil d’État. The essay seeks to introduce non-French-reading sociolegal researchers to this work and draws out methodological and theoretical implications for research on legal institutions, legal knowledge, and bureaucracies.

In recent years scholars from neighboring disciplines have emphasized the importance of conceptual rigor in designing, administering, and interpreting research in the social sciences. Drawing on this new conceptualism, this article analyzes the much talked about notion of “reconciliation.” In an effort at structuring a useful debate on possible departures from historic injustice, the article formulates a systematized concept of reconciliation based on the multitude of meanings contained in theory and practice. It distinguishes varieties of reconciliation, organizing these varieties into types and subtypes. The article argues that while most varieties of reconciliation emanate from the same root concept, the various outer layers of meaning do not overlap. This hampers not only our understanding of reconciliation, but its promotion in the international system as well. In response to this methodological malaise, the article prescribes friendly amendments—conceptual modifications and refinements designed to increase measurement validation of reconciliation as a conceptual variable.

In this article, I critically examine two bodies of scholarship: negotiation literature and new governance literature. To that end, I consider The Negotiator's Fieldbook (2006), an ambitious survey of negotiation theory and practice edited by Andrea Kupfer Schneider and Christopher Honeyman, and key works by U.S. new governance architects, Michael Dorf, Charles Sabel, and William Simon. This comparison may surprise readers since negotiation literature largely focuses on interpersonal dynamics, and new governance literature aims at institutional change. I argue that these two literatures share similar assumptions about subjectivity that drive their sense of political hopefulness. In short, both envision a flexible problem-solving subject—shaped in negotiation by a discourse of skills and in new governance by a discourse of institutional design. Based on this descriptive claim, I illustrate how reading these literatures together suggests alternative perspectives from which to consider questions of power, inequality, and distribution relevant to both fields.

The last ten years have witnessed the reemergence of fears of judicial power among scholars on the left. This renewed “Anti‐Court” movement includes the minimalism of Cass Sunstein, the popular constitutionalism of Mark Tushnet and Larry Kramer, and the bipartisan judicial restraint of Jeffrey Rosen. This essay traces the origin, development, and implications of this movement, noting its particular ties to historic trends in the academy: the Legal Process School, critical theory, and the positivist work of Gerald Rosenberg and Michael Klarman. The essay also considers the movement's preference for majoritarian politics—a partiality borne of dissatisfaction with the Rehnquist Court, but also, conversely, recognition of the failures of conservative attempts at policy making. The essay concludes by considering the ambitions of these scholars to develop a truly apolitical theory of judicial power. In light of the furious debate over the purported “minimalism” of John Roberts, severing theory from politics may prove impossible.

In How the Indians Lost Their Land, Law and Power on the Frontier (2005), Stuart Banner weaves together a perceptive interpretation of the historical record, with a novel economic analysis of conflicts, to create a sophisticated narrative of the process by which European colonists took control of the lands that now comprise the United States. Banner's view of expropriation falls somewhere between the parsimony of an economic model and the richness of a traditional historical account. It forms part of a growing trend to focus on finding positive facts about the taking of Indian lands, as opposed to making normative judgments.

This article reviews Bernard Harcourt's Against Prediction: Profiling, Policing, and Punishing in an Actuarial Age (2007). It places the rise of actuarialism in criminal law in the United States in the context of trends in other areas of law, as well as in penology. It further suggests that this move toward actuarial thinking cannot in fact be separated from race; that prediction has always involved racial profiling, and that it is no accident that it does so.

This article discusses Bernard E. Harcourt's Against Prediction: Profiling, Policing, and Punishing in an Actuarial Age (2007). The book opposes the use of probabilistic methods, such as profiling, on efficiency, equity, and jurisprudence grounds. By contrast I argue that profiling is always efficient, that there is no theoretical flaw in reliance on actuarial methods, as long as they are implemented properly. I also show that the equity-based criticism of reliance on actuarial methods (Harcourt's ratchet effect argument) is based on two questionable assumptions: that profiling is perfectly efficient (as zero deterrence is assumed), and that the police are making an obvious logical mistake, by gradually increasing the extent to which they target the group with the higher offending rate instead of targeting only them in the first place.
