The phenomenon of 24-hour global coverage of world events has arguably made it more difficult for journalists to remain true to the deontology of their profession. At the same time, humanitarians are at pains to defend the concept of neutral independent action in armed conflicts that have global reverberations. Moral dilemma is often the order of the day for those who have to report on increasingly complex emergencies in war zones or to attempt to alleviate the suffering of victims. With examples from recent conflicts, this article asks whether there are ways in which journalists and humanitarians can contribute to saving lives.

There is great concern that terrorists could obtain nuclear or radiological weapons and detonate them in a large city. The authors analyse the technical requirements for and obstacles to obtaining such weapons. What difficulties would have to be surmounted? Could these problems be solved by a terrorist organization without direct support from a State possessing nuclear weapons? The authors conclude that nuclear weapons are most likely out of reach for terrorists. However, radiological weapons may well be used by terrorists in the future. The possible consequences of such an attack are discussed.

The article surveys Jewish sources relating to the justification and conduct of war, from the Bible and rabbinic interpretation to recent times, including special problems of the State of Israel. It concludes with the suggestion that there is convergence between contemporary Jewish teaching, modern human rights doctrine and international law.

The author describes the history and the premises and characteristics of the action of the ICRC in favour of persons deprived of liberty. He believes that the efficiency of its approach, in particular the visits to detainees, is closely linked to the respect of a constant and rigorous working method including the modalities of the visits and the confidentiality of the interventions to the authorities. Finally, the implication of the ICRC is to be inscribed in a large process and is complementary to the efforts of the authorities, other organizations and mechanisms as well as of the international community at large. Its approach however remains unique in several aspects.

The article studies the public communication strategies of large humanitarian NGOs as well as UN organizations with regard to the humanitarian principles. It shows that different strategies concerning impartiality vs. solidarity and independence vs. subcontracting cause a wide diversity of humanitarian positions, which lead to different types of public communication strategies. It also discusses several recent trends and three scenarios concerning humanitarian public communication, focusing on interaction with donors and the military, as well as the security situation on the ground. The article concludes that it is essential for humanitarian organizations to understand the different interpretations of the humanitarian principles and that this will help in establishing a strategic approach toward public communication at headquarters, as well as in the field.

Acts of torture are conceptualized as crimes of obedience, which are inevitably linked to crimes at higher levels of the hierarchy, where orders are issued, policy is formulated, and the atmosphere conducive to acts of torture is created. The present analysis suggests several conditions under which torture becomes an instrument of State policy and the authority structure of the State is fully utilized to implement that policy: the perception by State authorities that the security of the State is under severe threat — which, at the macro-level, can justify torture and, at the micro-level, contribute to its authorization; the existence of an elaborate and powerful apparatus charged with protecting the security of the State — which, at the macro-level, may lead to the recruitment and training of professional torturers as part of that apparatus and, at the micro-level, contribute to the routinization of torture; and the existence of disaffected ethnic, religious, political, or other groups within (or under the control) of the State that do not enjoy full citizenship rights — which, at the macro-level, may lead to their designation as enemies of the State and appropriate targets for torture and, at the micro-level, their dehumanization.

This article examines the role of faith-based organizations, particularly Christian organizations, in humanitarian assistance within the broader context of the NGO world. Following an overview of the historical development of these organizations, the article examines the current context in which faith-based and secular humanitarian organizations operate. The different roles played by these organizations are explored, as are some of the difficulties they encounter. The article suggests that much more work is needed in the area of capacity-building of local humanitarian organizations and in the coordination of NGO programmatic work.

Nuclear weapons raise fundamental questions which go to the very heart of international humanitarian law and of Red Cross assistance activities. Sixty years after Hiroshima and Nagasaki, the author describes the attempts of the International Committee of the Red Cross to deal with these weapons.

Acts of humanitarianism are an essential element of religious practice for the Muslim. The Quranic and prophetic texts calling for humanitarian action, defining and ordering it are numerous. They are either of an obligatory or an inciting nature and do not exclude the non-Muslims from humanitarian aid. For the Muslim to undertake a humanitarian act is a way of receiving help from heaven, of erasing sins, and of meriting Paradise. The mechanisms established by the religion (e.g. zakat, waqf, kaffara) had an unprecedented impact on the lives of the population: the freeing of slaves, a significant support for the most vulnerable, and the expansion of the educational and health-care system. Nowadays faith based Muslim NGOs follow these texts to launch varied humanitarian programmes in different domains.

Despite the recurrence of hostage-taking through the ages, the subject of hostages themselves has thus far received little analysis. Classically, there are two distinct types of hostages: voluntary hostages, as was common practice during the Ancien Régime of pre-Revolution France, when high-ranking individuals handed themselves over to benevolent jailers as guarantors for the proper execution of treaties; and involuntary hostages, whose seizure is a typical procedure in all-out war where individuals are held indiscriminately and without consideration, like living pawns, to gain a decisive military upper hand. Today the status of “hostage” is a combination of both categories taken to extremes. Though chosen for pecuniary, symbolic or political reasons, hostages are generally mistreated. They are in fact both the reflection and the favoured instrument of a major moral dichotomy: that of the increasing globalization of European and American principles and the resultant opposition to it — an opposition that plays precisely on the western adherence to human and democratic values. In the eyes of his countrymen, the hostage thus becomes the very personification of the innocent victim, a troubling and haunting image.

At the intersection of new weapon technologies and international humanitarian law, so-called “non-lethal” weapons have become an area of particular interest. This article analyses the relationship between “non-lethal” weapons and international law in the early 21st century by focusing on the most seminal incident to date in the short history of the “non-lethal” weapons debate, the use of an incapacitating chemical to end a terrorist attack on a Moscow theatre in October 2002. This tragic incident has shown that rapid technological change will continue to stress international law on the development and use of weaponry but in ways more politically charged, legally complicated and ethically challenging than the application of international humanitarian law in the past.

The environment in which the ICRC works and communicates is constantly changing. The ICRC is also constantly seeking support that will allow it to gain access to victims, carry out its work, generate the diplomatic and financial backing needed for that work and ensure the safety of its delegates. The primary aim of communication is not merely to pass on messages from the organization effectively. It is just as necessary to understand the issues concerning the various audiences and how they perceive those issues as it is to inform them. The ICRC draws on a wide array of communication strategies and resources, depending on their complementarity and their potential impact, ranging from meetings with local armed groups to the use of mass communication tools. Communication is thus an integral part of the ICRC's decision-making process, both at headquarters and in each context in the field.

The revolution in biology, including advances in genomics, will lead to rapid progress in the treatment of mental illness by advancing the discovery of highly specific ligands that affect specific neurological pathways. The status of brain science and its potential for military application to enhance soldier performance, to develop new weapons and to facilitate interrogation are discussed. If such applications are pursued, they will also expand the options available to torturers, dictators and terrorists. Several generic approaches to containing the malign applications of biology are shown, and it is concluded that success or failure in doing so will be significantly dependent on the active involvement of the scientific and medical communities.

“The understanding of war among people who have not experienced war is now chiefly a product of the impact of […] images.” Some images have marked our memories and others shape our opinions by appealing to our emotions. The impact of images can be very far-reaching. “In contrast to a written account — which, depending on its complexity of thought, reference, and vocabulary, is pitched at a larger or smaller readership a photograph has only one language and is destined potentially for all.”

Warring parties are increasingly unequal and the principle of equality of arms does not apply to them. This asymmetry in warfare has many ramifications. The militarily weaker party is tempted to have recourse to unlawful methods of warfare in order to overcome the adversaries' strength. The expectation of reciprocity as a fundamental motivation for respecting the law is often illusory and replaced instead with perfidious behaviour; covert operations substitute for open battles, “special rules” are made for “special situations”. The fight against international terrorism seems to constitute the epitome of this kind of warfare. “Elementary considerations of humanity” as enshrined in article 3 common to the 1949 Geneva Conventions however constitute universally binding rules for all — even unequal and asymmetrical — parties to any situation of armed violence. Furthermore, attacks on humanitarian organizations have showed that humanitarian relief may be contrary to belligerents' interests, or, even worse, that attacks on humanitarian workers may be part of their agenda. Humanitarian actors must be aware of these facts and adapt their working methods so as to be able to continue to provide impartial assistance, based solely on the needs of the victims of armed violence.

The growing and intensified manifestations of religion in politics and vice versa are part of the environment of ICRC operations in Muslim countries and mark especially the interaction with Islamists. Different perceptions held by Muslims are examined, problem areas regarding interaction with the ICRC are analysed and aspects are mentioned which, in the opinion of the author, can help the ICRC improve its activities in Muslim countries. The conclusions of the examination could be relevant in any relationship with conservative movements within other religions.

This article explains the rationale behind a study on customary international humanitarian law recently undertaken by the ICRC at the request of the International Conference of the Red Cross and Red Crescent. It describes the methodology used and how the study was organized and summarizes some major findings. It does not, however, purport to provide a complete overview or analysis of these findings.

This article analyses recurring misconceptions about the questioning of prisoners of war. The author takes a two fold approach, first considering matters relating to the identification of prisoners of war, namely contemporary issues such as the use of modern identification techniques, and then discussing interrogation procedures that go beyond the establishment of a prisoner's identity. In this context particular attention is given to the question whether and, if so, at which point in time a prisoner of war starts to benefit from fair trial rights, namely the right to remain silent, the right not to incriminate oneself and the corresponding right to be informed about these fair trial protections.

For decades it has been taboo to mention the role played by religious organizations in development cooperation. Today, however, there is growing awareness of the contribution that these organizations can make to sustainable development, just as there is of the risk they pose of abuse and conflict aggravation. Those involved in development therefore have to learn to cope with the double-edged nature of these organizations. Government donor agencies and faith-based organizations should jointly monitor their work in conflict-prone areas to ascertain whether it fosters peaceful settlement of conflict or whether, in fact, it aggravates the violence.
