Summary
For hundreds of years, European immigrants to America have persistently attempted to eradicate the lives or culture of indigenous tribal nations by means of disease, warfare, forced relocation, or forced assimilation. Several methods of assimilation (including kidnapping, boarding schools, and forced adoption) targeted Native children with an eye toward killing Native culture at its root. In 1978, after hundreds of years of forced assimilation that tore apart countless Native families and tribes, Congress passed the Indian Child Welfare Act (“ICWA” or “Act”). This ground-breaking legislation has three objectives: (1) eliminate out-of-family placements of Native children; (2) place Native children who must be removed from their homes with other Native families; and (3) encourage tribal court adjudication of custody proceedings involving Native children.
