To support carbon markets, regulators must engage in a continuous process of learning. This article explores offsets regulation in the compliance markets of Europe, the United States and China, alongside the Clean Development Mechanism, to identify what has been learnt since offsets were initiated. We argue that offsets regulation must learn to work with demands for commercial viability, environmental sustainability and political legitimacy. We find that the learning here recommends greater control of the shares, sectors, sources and standards of offsets than was initially chosen. The findings provide some cautious optimism about the scope for improvements to such market mechanisms.

Under what conditions should epistemic institutions (institutions that provide policy-relevant scientific advice) be integrated into international legal institutions – for example, the Conference of the Parties to the United Nations Framework Convention on Climate Change? Following work in law and economics on the theory of the firm, this article argues that where states will not implement environmental policies absent a collective decision to do so, greater hierarchical control of epistemic institutions by legal institutions may be necessary to ensure the credibility and availability of a usable scientific record. Hierarchy creates credibility because it allows all states necessary for cooperation in the legal institution to oversee the production of the scientific record that provides the basis for international legal rules. Hierarchy thus enhances the effectiveness of international law as a coordination tool, even at the expense of the autonomy of the scientific process. By contrast, where collective action is not necessary because states will unilaterally regulate an environmental problem once scientific uncertainty has been reduced, epistemic and legal institutions should be fragmented to ensure the unbiased production and dissemination of scientific information. In such situations, the credibility of the scientific record is demonstrated by decentralized adoption of science-based regulation.

This article examines ‘essential use’ as a novel form of regulatory control. An essential use approach to the regulation of potentially hazardous chemicals has not been used extensively (if at all) in European Union (EU) regulatory law and warrants further consideration. Essential use, as initially proposed by scientists and later referred to in the EU 2020 Chemicals Strategy for Sustainability, is a radical departure from the current method of regulating hazardous substances. The purpose of this article is to contribute to legal scholarship on essential use by (i) scoping its origins in United States law and subsequently in international law; (ii) noting its limited incorporation into the EU legal order over the past 30 years; (iii) analyzing how it could be further incorporated into the EU legal order; and (iv) considering the impact of such a move on the future regulation of hazardous substances in the EU.

The European Union (EU) aims to ensure a high level of environmental protection. This is a key message of primary EU law. This article explores the purpose and meaning of this explicit ambition. It deciphers its influence on case law and on judicial review of legislative and administrative discretion. It argues that the requirement goes beyond window dressing and that its added value lies both in supporting the legitimacy of bold decisions and in preventing a manifest dismissal of the requisites of environmental protection.

Although primarily focused on EU law and on its technicalities, the article may offer helpful insights to other transnational or federal systems. It may help to build a better understanding of some of the challenges facing any environmental law regime confronted with the sensitive issue of ‘ambition’.

This article examines the role of environmental non-governmental organizations (ENGOs) in Russia and the impact of tightening governmental accountability measures. Drawing on 18 interviews conducted in 2012–13 with Russian and international ENGOs, the article examines three key governance issues, namely: the collaborative relationship between the state and ENGOs, the impact of accountability measures on ENGO activities, and the relationships between ENGOs themselves. The findings reveal that ENGOs maintain a legitimate and effective role within Russian environmental governance. However, their legitimacy and success is significantly limited and threatened by increasing accountability measures and state actions. The article accordingly identifies a number of recommendations for increasing the likelihood of successful ENGO action in Russian environmental governance, including improving ENGO collaboration with the state and resolving tensions between participation and accountability.

This article proposes an Arctic Ocean Coordinating Agreement (AOCA) as a framework for more effective coordination and sharing of practices regarding national conservation and management policies in the marine Arctic. It envisions a nimble, versatile body that operates without creating new institutions and focuses instead on convening and coordinating existing individuals and institutions whose expertise can assist the Arctic states with questions that the Arctic states define. The AOCA could incorporate aspects of regional seas agreements (RSAs) into a less formal regional arrangement that would differ significantly from traditional RSAs. Identifying the Arctic Council as the right entity to launch AOCA discussions, the article proposes that an AOCA should draw on entities already engaged in work relevant to the emerging challenges in the Arctic Ocean: the Helsinki and OSPAR Commissions, the International Council for the Exploration of the Sea (ICES), the North Pacific Marine Science Organization (PICES), and other institutions that have successfully convened appropriate sets of actors for targeted responses to shared marine management concerns around the world.

Scholars of environmental law are gaining comfort with looking for law in unusual places. As a result, lists and maps of the environmental content of contractual provisions are emerging. What these lists and maps largely miss, however, is the powerful dynamic of how legal norms move across borders through contract. This article argues that contractual provisions operate as critical platforms for the migration of legal norms, ideas and technologies between project and transactional settings. Three dynamics of how this movement takes place (transfer from contract to contract, migration from contract to legislation, and entrenching private standards through contract) are explored – each revealing how contractual practices reproduce selective visions of what counts as the ‘environment’ worth protecting.

Following the European Union (EU) experience, an increasing number of countries are establishing an Emissions Trading Scheme (ETS). The EU ETS often serves as a ‘model’ despite fundamental differences in the receiving environment. In the EU liberalized energy markets, carbon prices are intended to raise the cost of carbon-intensive energy and thereby stimulate cleaner alternatives. In contrast, many emerging economies continue to regulate energy investments and prices, which may insulate consumers and producers from the impact of an ETS. To avoid this risk, energy economists advocate EU-style energy market reforms as a prerequisite to the introduction of the ETS concept abroad. By focusing on the cases of China, Kazakhstan, and Russia, this article highlights the limits on the exportation of the EU liberalization model and argues that, instead of energy reform, the ETS must be reconceptualized as a mechanism that integrates the regulated energy market paradigm in emerging economies.

International wildlife law is concerned with the conservation of sentient species, but generally ignores the welfare of individual animals. It therefore does not reflect a recognition of the moral worth of animals and perpetuates the dichotomy between conservation and welfare. It is the primary goal of this article to ascertain how welfare concerns may be incorporated into international wildlife law in order to ensure that it takes cognizance of the moral worth of animals. The article advocates an injection of ethics, via a welfare-centric approach, into wildlife law in order to escape the dichotomy between conservation and welfare in relation to wild animals, and so to advance the progressive development of law that is conducive to wildlife protection rather than merely to its conservation.

A widespread response to the pressures placed on the ecological condition of rivers is the design and implementation of environmental flow regimes in domestic regulatory frameworks for water. Environmental interests in water are not confined to hydrological functioning but include relationships between water resources and human cultural and economic livelihoods, including those of Indigenous communities. Since the mid-1980s there has been some provision for environmental flows in Chilean law. However, the legal and policy requirements are limited in scope and have been poorly implemented by regulatory institutions. In this article we critically examine the treatment of environmental flows in Chilean legal and policy frameworks. We argue that there is an urgent need for a comprehensive minimum flow regime in Chile to protect the environmental qualities of rivers, which must also reflect and provide for Indigenous water rights and interests. The developing constitutional crisis in Chile, the most significant political crisis since the end of the Pinochet dictatorship (1973–90), highlights the need to revisit the sensitive and unresolved issues of water governance and equity.

Over several years, the European Union (EU) has gradually developed its legal framework to assist in the proper application of EU environmental protection rules, both at Member State as well as at EU institutional levels. This article focuses on one particular and relatively recent emerging element of that supranational framework, namely the range of EU secondary legislative measures and provisions concerning the management of environmental inspections. In addition to appraising the extent of EU legislative engagement in relation to environmental inspections, this article reflects on certain challenges of a constitutional nature that the EU will need to address in the future if its intervention in this particular policy field is to continue to develop.

The regulation of short-lived climate pollutants (SLCPs) is widely seen as an important dimension of global atmospheric pollution control and climate change governance. SLCPs emitted outside the Arctic influence the Arctic atmosphere, Arctic communities, and the rate of ice melt. As an intergovernmental forum that brings together three of the world’s major petroleum producers (Russia, the United States, and Canada), the Arctic Council has a pivotal role in reducing the rate of Arctic warming through SLCP mitigation. This article explores the Arctic Council’s approach to SLCP mitigation. It begins by addressing the current status of black carbon and methane in international legal instruments, and goes on to explore the important regime linkages that are set in place through the Arctic Council’s Framework for Action on Enhanced Black Carbon and Methane Emission Reductions. The article suggests that the Arctic Council provides an experimental platform that may catalyze SLCP regulation not only in Arctic jurisdictions but also in Arctic Council observer states, such as China and India. The transnational and inclusive character of the Arctic Council’s constitutional framework and knowledge-generating mechanisms enables new pathways for global action on climate change and air pollution governance.

In light of the urgent need for coastal adaptation policies and the impediments to their implementation, this article examines the early experience with coastal adaptation policies in the EU (in particular the Netherlands and the UK) and Australia, with a view to identifying the important features of an effective regulatory framework for coastal adaptation. We conclude that an integrated approach to coastal adaptation law is currently needed to lay the foundations for the required long-term strategy. Such an approach would establish processes by which adaptation objectives are agreed for each part of the coast, ensure land use planning that can accommodate future change and does not expose new communities to risk, integrate coastal adaptation with biodiversity and coastal zone policy, allocate regulatory responsibility in a way that promotes subsidiarity and consistency, and ensure that funds are available for future measures.

This article describes the challenges of using the constrained tools of international law to negotiate a sustainable framework to address climate change. It sets out to show how the particularities of the problem have led to creative and innovative solutions expanding the borders of international law. To this end, the article discusses carbon market mechanisms, the compliance regime of the Kyoto Protocol, and the emerging framework to create incentives to reduce land-based emissions in developing countries. These examples illustrate that the recognition of the role of sub-national and private entities in mitigating climate change has had significant impact on the rules of the climate regime. But the article also asserts that the un process, while recognizing the role of private actors, is still inadequately equipped to involve non-state actors in a meaningful way. The climate regime therefore challenges the traditional thinking about interstate relationships. No longer solely a matter for international environmental law, contemporary environmental governance has become a global affair, which makes the lens of transnational law a useful tool to think about these issues in practice in a more intellectually fruitful and relevant way. This article thereby provides a snapshot of the type of issues and discussion that readers of this journal can look forward to in the years to come.

This article argues that the rise of transnational regulation has a transformative impact on law. It examines the field of transnational environmental regulation to show that its proliferation challenges the continued appropriateness of representations of law as (i) territorial, (ii) emanating from the state, (iii) composed of a public and private sphere, (iv) constitutive and regulatory in function, and (v) cohesive and regimented. Instead, law is increasingly perceived as (i) delocalized, (ii) flowing from a plurality of sources, (iii) organizationally inchoate, (iv) reflexive and coordinating in function, and (v) polycentric. Together, these shifts in perception amount to a transformation that the article identifies as the transnationalization of law. The article then explores three responses to the transnationalization of law. It distinguishes responses motivated by a desire to reclaim the traditional conception of law from those that seek to reconstruct law at the transnational level and responses that advocate a context-responsive reconceptualization of law. Each response, it will be shown, creates a different set of opportunities for, and challenges to, the relevance of law for transnational regulation.

While legal scholarship seeks mainly to assess the impact of climate change litigation (CCL) on the regulatory state and on climate change policy in common law countries, the potential influence of government climate policy on the judicial practices of jurisdictions with different legal traditions attracts much less attention. This article fills the gaps by exploring how courts in China, an authoritarian country with a civil law tradition, react to government climate policies and how this judicial response might affect relevant legal rules and eventually contribute to climate regulation. An empirical analysis of 177 Chinese judicial cases reveals that CCL in China consists mostly of contract-based civil actions steered by the government's low-carbon policies. Moreover, although the prospects of CCL against public authorities in China remain very bleak, there is scope for the emergence of tort-based CCL, backed by government policies. In this respect, recent tort-based public interest litigation on air pollution in China may serve as a substitute or, more promisingly, a gateway to the emergence of a tort-based branch of Chinese CCL.

Reducing emissions of short-lived climate pollutants (SLCPs) – in particular, black carbon and methane – is a promising option for slowing global and regional warming in the short term, while at the same time reducing local air pollution. This mitigation opportunity seems to be particularly relevant in the Arctic context. The article provides a comprehensive overview and a critical assessment of the state of international law and governance relevant to the reduction of SLCP emissions in the Arctic. The article demonstrates that current legal and governance regimes for reducing SLCP emissions in the Arctic are complex and fragmented, which raises questions about the scope for this option for climate change and air pollution mitigation to reach its full potential. Nevertheless, the article concludes that fragmentation in this policy domain is of a cooperative or synergistic nature and therefore not problematic, provided that greater harmonization of legal instruments and enhanced cooperation between institutions are achieved. It also suggests options for strengthening international law and governance on SLCPs. Although the focus of the article is regional, many of its conclusions are relevant for the global regulation of SLCPs.

A study of the rights regime for environmental protection in India indicates that such protections overlap with constitutional rights guaranteed primarily to citizens or persons under the law. Contemporary jurisprudence has aggressively developed this intersectionality, declaring natural entities to be living persons with fundamental rights analogous to those of human beings. This article explores the role played by two judgments delivered by the Uttarakhand High Court – Mohammed Salim v. State of Uttarakhand and Lalit Miglani v. State of Uttarakhand – in the establishment of an effective framework for environmental protection. This is effectuated in both cases by assigning legal personality to rivers and articulating a conceptual shift from the human-centric approach. Accounting for the socio-cultural and spiritual relationships that have received legal protection, this article critically analyzes the judgments, their rationale and contributions to environmental protection. As the judgments articulate a paradigm shift in environmental protection, their effectiveness is best assessed through analyzing the frameworks created for their implementation. While the pronouncement of the Indian courts on the legal personality of rivers is an encouraging paradigm shift in environmental commitment, establishing the rights of nature was undertaken without due attention to the complexities that characterize the Indian socio-politico-religious context and to the legal consequences of bestowing vaguely contoured rights upon natural entities.

In recent years, climate citizens’ assemblies – randomly selected representative citizens gathered to make policy recommendations on greenhouse gas emissions targets – have gained in popularity as a potential innovative solution to the failure of governments to design and adopt ambitious climate change laws and policies. This article appraises the process and outcomes of three climate citizens’ assemblies held at the national level – in Ireland, France and the United Kingdom – and evaluates their contributions to the making of climate law and policy. In doing so, it first looks at whether citizens’ assemblies have the ability to improve the substance of climate law and suggests that they face difficulties in providing an integrated, holistic response to the climate problem. It then explores how citizens’ assemblies have fed into subsequent legislative processes to show their positive influence and draws lessons for our understanding of the role of citizens’ assemblies in climate lawmaking.

Legal scholars rely heavily on vocabularies of ‘actors’, ‘agents’, and ‘experts’ to account for the fact that law does not develop by itself. However, the identities, idiosyncrasies, and individual professional contributions of law's people are rarely illuminated. This article suggests that the relative absence of people in transnational legal scholarship helps to explain some of its gaps. The task of bringing ‘human actors back on stage’ creates some new opportunities for transnational environmental law scholarship. It invites attention to both dominant and excluded voices. It offers a way of bridging the gap between the bureaucratic language of law and its lived reality. It also provides an understanding of why, despite ferocious attempts to roll back the advances of environmental law in some places, many scholars and practitioners find reason to be optimistic about the future of environmental law.
