Bearing in mind the plethora of rules applicable in time of war, jurists define international law rather elaborately as follows:

“International humanitarian law applicable in armed conflict means international rules, established by treaties or custom, which are specifically intended to solve humanitarian problems directly arising from international or non-international armed conflicts and which, for humanitarian reasons, limit the right of Parties to a conflict to use the methods and means of warfare of their choice or protect persons and property that are, or may be, affected by conflict”.

Eradicating and addressing child marriage in situations of armed conflict requires that stakeholders increase their attention, knowledge, evidence-based protection measures, and resources in a coordinated fashion. To this end, this article examines what constitutes child marriage within the international legal framework. It then presents a concise analysis of what is known about child marriage in development contexts, before moving on to discuss the (limited) state of knowledge on child marriage in humanitarian settings, and the global response. It presents information on different married child populations, including child brides and grooms, girls forcibly married to armed actors, child widows, and child marriage within natural disasters. It concludes with ideas on the information and knowledge that is still needed to inform effective response.

The ‘protection of civilians’ mandate in United Nations (UN) peacekeeping operations fulfils a critical role in realising broader protection objectives, which have in recent years become an important focus of international relations and international law. The concepts of the ‘protection of civilians’ constructed by the humanitarian, human rights and peacekeeping communities have evolved somewhat separately, resulting in disparate understandings of the associated normative bases, substance and responsibilities. If UN peacekeepers are to effectively provide physical protection to civilians under threat of violence, it is necessary to untangle this conceptual and normative confusion. The practical expectations of the use of force to protect civilians must be clear, and an overarching framework is needed to facilitate the spectrum of actors working in a complementary way towards the common objectives of the broader protection agenda.

The world is rapidly urbanizing, and so is internal displacement. However, knowledge about the specific situation of internally displaced persons (IDPs) in urban settings and how it differs from, and impacts on, their host communities is still limited, and responses continue to be inadequate. This article analyzes the particular needs of urban IDPs by taking into account how the various contexts and patterns of urban internal displacement contribute to shaping people's experience. It discusses three key challenges that humanitarian actors are faced with in developing effective responses: identifying and reaching IDPs in urban settings, addressing their urgent protection concerns, and supporting their local integration. It concludes by pointing out the need for methodological and operational guidance on how to bring together area-based approaches that account for the impact of displacement on entire urban communities, and tailored approaches addressing IDPs’ specific needs in urban settings. The need for stocktaking exercises and more effective sharing of experiences among practitioners, municipal authorities and policy-makers is also underlined.

Growing reliance on ‘multi-stakeholder initiatives’ (MSIs) aimed at improving business performance with respect to specific human rights-related challenges has become a significant dimension of the evolving corporate responsibility agenda over recent decades. A number of such initiatives have developed in direct response to calls for greater state and corporate accountability in areas of weak governance and violent conflict. This article examines the evolution of key MSIs in light of the 2011 adoption of the United Nations (UN) Guiding Principles on Business and Human Rights and addresses challenges facing these initiatives in the future.

Looking at the physical damage caused by the Syrian war, one can begin to imagine the scale of the psychological toll that eight years of crisis have taken on the Syrian people. In a country where mental health was still considered an emerging field before the war, Syrians are working to address and manage the mental health and psychological effects of war. Despite this disastrous situation, there appears to have been significant progress in the field of mental health during the crisis. This article explores the mental health situation in Syria prior to 2011, the effects of the crisis on Syrians, and how these have been managed in recent years. It concludes by citing some examples of progress that have been made in mental health care in Syria and discussing some of the challenges that remain to be addressed.

On 13 March 2004, the Special Court for Sierra Leone (SCSL) rendered an important decision on the validity of amnesties under international law. The Appeals Chamber of the SCSL ruled that amnesties granted to persons of the warring factions in the Sierra Leone civil war by the so-called Lomé Peace Agreement are no bar to prosecution before it. This decision is the first ruling of an international criminal tribunal unequivocally stating that amnesties do not bar the prosecution of international crimes before international or foreign courts. The following article will briefly discuss this significant and controversial decision for the development of international humanitarian law and will then examine the most important and critical findings of the ruling, after first giving a brief summary of the legal background to the SCSL, the Lomé Peace Agreement and the Appeals Chamber decision (Lome Decision) itself.

Health-care workers face ethical dilemmas in their decision-making in every clinical intervention they make. In times of armed conflict the decisions may be different, and the circumstances can combine to raise ethical tensions. This article looks at the tensions in peacetime and in times of armed conflict and examines the types of cases that doctors and other health-care workers will face. It also discusses the common ethical decision-making framework and the role of communication within both clinical care and ethical analysis.

Comme le rappelle Françoise Perret dans son étude sur l'action du CICR en Hongrie, 1956 est d'abord l'année de la déstalinisation, lancée par le fameux rapport de Khrouchtchev devant le XXe Congrès du Parti communiste de l' Union soviétique. Cet événement a changé le cours de I'histoire du XXe siècle, et l'insurrection qui a éclaté en octobre 1956 à Budapest en a été une conséquence directe. Avec son étude intitulée «L' action du CICR en Hongrie», Françoise Perret, chargée de recherches au CICR, rappelle l' intervention du CICR pendant ces journées dramatiques pour la Hongrie. Depuis lors, l'histoire a une fois de plus changé de cap, avec l'écroulement du régime communiste en 1989.

Reparations are essential to establishing justice after armed conflicts. The question whether international law endorses an individual right to reparation has been a focal point of recent discussion in that regard. The victims of armed conflicts are, however, not only individuals but also collectives. The present article therefore examines the issue of collective reparation. While it is submitted that the question whether there is a right to such a remedy is not yet settled, it is argued that responsible parties should develop robust programmes of collective reparation.

How do the dynamics of contemporary armed conflict shape, and constrain, humanitarian action? Is the international humanitarian “system”1 really at breaking point, as is often claimed? Or will it adapt to the changing realities not just of warfare but of global geopolitical shifts – as it has done repeatedly in the past – and evolve into something different? By way of response, the first part of this article offers a snapshot of today's armed conflicts and other situations of violence, focusing initially on the trends and features apparent in the Syrian conflict – which has in many ways come to define twenty-first-century warfare – and moving on to other countries and regions, many of which share at least some of these features, albeit in varying degrees. It considers the humanitarian consequences of today's armed conflicts and other situations of violence, and the implications for humanitarian response – which, at least on an international level, is indeed facing a watershed. The second part aims to show that even a glance back at key aspects of the evolution of humanitarian action over the past century – largely in response to the evolving nature of warfare and the developing international system – will remind us of quite radical changes in the face of major upheavals and challenges, not all of them dissimilar to those of today. The third part suggests that in today's global environment, international humanitarian response will continue to evolve and ultimately take on a different shape: one that reflects the changing nature of conflict and the geopolitical power shifts that go with it. With the rise of the global South, and the increasing recognition of the importance of local actors to humanitarian action, particular attention is given to the evolving relationship between local and international actors. In conclusion, the article reiterates some of the main reasons why humanitarian action – and international humanitarian actors in particular – will likely continue to adapt (albeit with varying degrees of success) to a changing world.

The principle of humane treatment, as Jean Pictet wrote in 1958, is in truth the leitmotiv of the four Geneva Conventions of 1949. Article 3 common to these Conventions and other provisions of International Humanitarian Law embody this absolute and minimum rule by prohibiting torture, cruel or inhuman treatment and outrages upon personal dignity. These notions can be interpreted in meaningful and practical ways through the existing instruments and jurisprudence on the prohibition of ill-treatment. Their assessment must take into account the need to respect the human being in all his or her physical, mental and moral integrity, mindful of all the circumstances of the case.

Two prominent events that occurred midway through this century had a great impact on international criminal law. The first milestone in this area was the trials of the major war criminals held in Nuremberg and Tokyo in the wake of the Second World War. They highlighted the principle of individual criminal responsibility for certain serious violations of the rules of international law applicable in armed conflict; the terms “crimes against the peace”, “war crimes”, and “crimes against humanity” found formal recognition. The second event, following closely on the first, was the adoption of the four Geneva Conventions of 12 August 1949 for the protection of war victims. These instruments established a specific framework for the prevention and punishment of the most serious violations of the provisions they contain; the technical term “grave breach” was coined.

This article analyzes the Draft Articles on the Protection of Persons in the Event of Disasters adopted by the International Law Commission in 2016 in light of the recommendation made by the Commission to elaborate a convention on the basis of this project. While the latter proposal is still under evaluation by the United Nations General Assembly, which has recently decided to postpone its decision until 2020, such a potential outcome would represent a significant novelty in the area of disaster law, currently characterized by a fragmented legal framework and the lack of a universal flagship treaty. The Draft Articles thus aim to provide a systematization of the main legal issues relevant in the so-called disaster cycle, with solutions that accommodate the different interests of actors involved in a disaster scenario – namely, the affected State, external assisting actors and disaster victims – using a complex “checks and balances” approach.

Since their publication in 1950s and 1980s, respectively, the Commentaries on the Geneva Conventions of 1949 and their Additional Protocols of 1977 have become a major reference for the application and interpretation of these treaties. The International Committee of the Red Cross (ICRC), together with a team of renowned experts, is currently updating these Commentaries in order to document developments and provide up-to-date interpretations. The work on the first updated Commentary, the Commentary on the First Geneva Convention relating to the protection of the wounded and sick in the armed forces, has already been finalized. This article provides an overview of the methodology and process of the update and summarizes the main evolutions in the interpretation of the treaty norms reflected in the updated Commentary.

On 27 April 1994, all South Africans were permitted to vote for the first time, signalling the birth of a democratic state built on a constitutional democracy. Yet the wrath of gang-related activities in townships and other urban areas was clearly visible, as was the xenophobic violence that shocked the world. Very often the vast majority of victims have been innocent civilians, and especially women and children. This article gives an overview of the various forms of violence in South Africa and also briefly considers the state's responses to them within the various legal frameworks.

In war, individuals are vulnerable not only physically but also in terms of their cultural identity, and the obliteration of cultural heritage often becomes a central issue. This is particularly the case in armed conflicts with an ethnic, cultural or religious character. In some regions, cultural heritage consists more of monuments and objects; it is a “tangible” heritage, mostly protected by the law of armed conflict. Elsewhere, where structures are impermanent, cultural heritage is mainly expressed through orality, gestures, rituals, music and other forms of expression that individuals create using various media and instruments. Such heritage is mainly “intangible”. This essay aims to show that cultural heritage is both tangible and intangible, and that the law which protects such heritage is not limited to the law of armed conflict. Cultural heritage also benefits from the protection of other applicable instruments, such as human rights treaties and the UNESCO cultural heritage conventions.

Millions are displaced by climate-related disasters each year, and this trend is set to increase as climate change accelerates. It raises important questions about how well existing instruments actually protect people driven from their homes by climate change and natural disasters. This article first examines current protection instruments and points out gaps in them. There follows an exploration of various proposals for filling those protection gaps, with the focus on cross-border natural-disaster-induced displacement. A multi-track approach is recommended, including context-oriented and dynamic interpretation of existing law, and creation of new law. Adhering to the principle of non-refoulement, and focusing on whether return is possible, permissible, or reasonable, could be a realistic way to begin developing protection regimes for victims of natural-disaster-induced displacement.
