This chapter will focus on the attention given by the judge/arbitrator to equity in their decisions since Libya/Malta. The purpose is to identify which nature and which function is given nowadays to equity in the jurisprudence. A preliminary assessment of the case law suggests a tendency to rationalize the use of equity in maritime delimitation through the reintroduction of elements of objectivity in the delimitation process. But this apparent objectivity through a mathematical analysis barely hides discretion which remains a decisive element in deciding the individual case. In that respect, delimitation remains largely associated with equity, which is still part of the legal norm relating to maritime delimitation. Much more than a method, equity, while introducing some flexibility, is an important aim of maritime delimitation that the judge takes into account without occulting  that predictability and consistency are the best guarantees of a sustainable solution in maritime disputes.
