Summary
Chapter 3 presents the territorial scope of the EAPO Regulation, which is not expressly defined. The Chapter provides an analysis of the relevant provisions of the Regulation and its preamble that contribute to the definition of its territorial scope of application Several provisions require that authorities intervening in the process of issuance and implementation, as well as the bank accounts to be preserved and the creditor be connected to a Member State participating to the Regulation. The Chapter also looks at the geographical location of the debtor and the claim to be protected. Finally, it specifically addresses the position of the United Kingdom and Denmark.
