  • Customary international law is based on State practice. This book presents the international law practice of Germany, the world's fourth-largest economy and powerhouse of the European Union, which makes an important contribution to the creation and development of customary international law. It is the first and only presentation of German practice in international law in English. The book combines a case study approach, providing analysis and commentary on Germany's practice, with a classic digest of primary materials, including diplomatic correspondence, statements, and court decisions.     Outcome reporting is an essential element of quality assurance. Evaluation of the information needs of stakeholders of outcome reporting is limited. This study aimed to examine stakeholder preferences for the content, format, and dissemination of paediatric cardiac surgery performance data in Australia and New Zealand.

    Methods:

    Semi-structured interviews were completed with a purposive sample of Queensland stakeholders to evaluate their attitudes and expectations regarding reporting of paediatric cardiac surgery outcomes. The interviews were audio-recorded and transcribed. Two researchers used an interpretive description approach to analyse the transcripts qualitatively.

    Results:

    Nineteen stakeholders were interviewed including fifteen clinicians, four parents, one hospital administrator, and one consumer advocate were interviewed. Mortality was highlighted as the area of greatest interest in reports by clinical and consumer groups. The majority preferred hospital rather than individual/clinician-level reporting. Annual reports were preferred by clinicians who requested reports be distributed electronically.

    Conclusions:

    The evidence generated from outcome reporting in paediatric cardiac surgery is highly desired by clinicians, administrators, parents, families, and advocacy groups. Clinical users prefer information to assist in clinical decision-making, while families seek personalised information at crucial time points in their clinical journey.

  • Summary

    Chapter 13 provides an overview of the institutional framework provided by the Committee on Safeguards, and a description of its multiple functions. Some of these functions ensure that Members exert real surveillance over safeguard actions, and others provide a rather adjudicating function to the Committee, which may collide with the exclusive jurisdiction of the WTO dispute settlement system to adjudicate safeguard-related claims of infringement.

  • Narrating in protective order interviews: A source of interactional trouble

  • This study examines the types of interactional trouble that arise from narrative variation in institutional interviews. Specifically, we examine protective order interviews in which Latina women tell of domestic violence to paralegal interviewers charged with the duty of helping them obtain a protective order. Victims' narratives are shown to take different shapes, and paralegals respond to them in different pragmalinguistic ways, depending on how they diverge from institutional needs. The factors found most heavily to influence narrative outcomes are contextual ones, related to participant social roles, the type of communicative activity interlocutors perceive themselves to be engaged in, and their interactional goals. An additional finding is that when expectations of what constitutes appropriate speech behavior differ, the interlocutor holding greater institutional power will try to constrain the speech of the other, despite the fact that both appear to share an extralinguistic goal, in this case obtaining a protective order.
