In the Magistrate'S Cottrt Op The County of Renfrew, Ontario [October 7, 1943]

Prisoner of war not punishable at common law for attempting to escape or for doing anythingreasonably calculated to assist in that escape or preserve his liberty.

Magistrate THOMAS GALLIGAN rendered judgement as follows.

Two weeks ago this accused was brought before me on a charge of breakingand entering and theft and elected for trial before me. On hearing the evidenceI reserved judgment until today.
