Summary
In case of the restructuring of an enterprise there are provisions that deviate from ‘ordinary’ dismissal law.
Employers who proceed to collective dismissal, closure of the enterprise or who transfer their enterprise, either completely or partially, must – depending on the case – inform the public authorities and employees’ organisations beforehand. Apart from this, in certain cases employees receive specific compensation. In the case of bankruptcy, too, there is a special arrangement for regulating employees’ rights after the take-over of the healthy parts of the bankrupt company. This arrangement was inspired by Chapter 11 of the US Bankruptcy Code. Because of the specificity this matter will not be discussed further.
