This chapter examines whether, and to what extent, human rights could be said to fit within the contemporary compromise of embedded liberalism. In contrast to the view that embedded liberalism is a dialectic between competing national and international forces, Harris argues that embedded liberalism relates to the fragmentation of international law more broadly. She interprets embedded liberalism as a framework of description, critique and advocacy. In order to gauge the extent to which the trade liberalization agenda is embedded within other legitimate societal purposes today, such as human rights, Harris argues we need to understand the ‘inter-subjective framework of meaning’ that constitutes the international trade law regime.
