    Article 29 details the hygiene measures the Detaining Power must taketo fulfil its general obligation under Article 15 to provide for themaintenance of prisoners of war and for the medical attention requiredby their state of health. These measures may also contribute tocompliance, pursuant to Article 13, with the general obligation ofhumane treatment, based on respect for prisoners’ inherent humandignity, and with the prohibition of any unlawful act or omission by theDetaining Power causing death or seriously endangering the health of aprisoner of war in its custody.

    Article 57 provides that prisoners of war who work for private personsremain entitled to the same protections as other prisoners of war under theresponsibility of the Detaining Power, including the right to communicatewith the prisoners’ representatives. There is therefore no change in thelegal status of this category of prisoners of war as regards the principleswhich the Convention makes applicable to captivity. Prisoners working forprivate persons may not be subject to lesser protections.

  • Summary

    Article 95 deals with confinement of prisoners of war who areawaiting a hearing and is the first of two provisions regulating theprocedure for imposing disciplinary punishment. Where suchconfinement is permissible, Article 95 provides that it must be keptto an absolute minimum and last no longer than 14 days. It furtherrequires that prisoners be afforded the same minimum standards oftreatment and conditions of confinement as for any otherdisciplinary confinement. The reason for this restrictive frameworkis that the offences punishable by disciplinary measures are of arelatively minor character.
