  • Summary

    Agreements may be concluded between belligerents during armed conflicts. Whileceasefires and peace agreements may be the best known among these, they are notthe only ones. Parties to armed conflicts may reach agreements on varioussubjects, both in the course of hostilities and, especially in relation toprotected persons who have been detained, after the end of a conflict. Thus,this article, common to all four of the 1949 Geneva Conventions, recognizesthat, despite the detailed nature of the Conventions and their AdditionalProtocols, the Parties to a conflict, as well as other High Contracting Parties,may wish to develop more specific rules to govern particular situations. Specialagreements can be a means of adapting certain provisions of the Conventions andProtocols to specific situations, in the light of prevailing circumstances andmodern technology, a feature that was foreseen and provided for in theConventions themselves.

    Article 132 is part of the system elaborated by the four Geneva Conventionsof 1949, and subsequently by Additional Protocol I, to ensure that Partiesto international armed conflicts comply with their obligations under theseinstruments. The article is common to the four Conventions. It appears underthe heading ‘Repression of abuses and infractions’ in the First and SecondConventions, and ‘Execution of the Convention’ in the Third and FourthConventions.
